HomeMy WebLinkAbout2000-263b Wm DxummWONIMncMOPubwOomneoi ofm@"y.--I Houft EM., din ORDINANCE NO AN ORDINANCE VACATING A UTILITY EASEMENT AFFECTING THE SOUTHERN BOUNDARIES, BLOCK 3, LOTS 1-13 OF HANNAH ESTATES, AN ADDITION TO THE CITY OF DENTON, TEXAS, ACCORDING TO THE PLAT THEREOF, RECORDED IN CABINET C, PAGE 381 OF THE PLAT RECORDS OF DENTON COUNTY, TEXAS AND PROVIDING FOR AN EFFECTIVE DATE WHEREAS, the City of Denton has received a request for the abandonment of a certain utility easement, and WHEREAS, the Development Review Committee of the City of Denton, Texas reviewed the requested abandonment and recommended approval, and WHEREAS, the Council of the City of Denton, Texas has determined that the utility easement being vacated is no longer needed for public use, and WHEREAS, the fair market value of the utility easement has been determined and received, as required by section 272 001 of the Texas Local Government Code, NOW THERFORE, THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS SECTION 1 A 16 foot wide utility easement along the southern boundaries of Block 3, lots 1 through 13 of Hannah Estates, an addition to the City of Denton, Texas, according to the plat thereof recorded in cabinet C page 381 of the Plat Records of the Denton County, Texas (the "Easement"), is permanently vacated, abandoned, and extinguished as a public easement SECTION 2 By reason of such vacation the City of Denton's property interest in the Easement shall, by operation of law, revert to the owner or owners abutting the easement herein abandoned, and the City of Denton releases any and all claims to the use of the vacated property as a public easement SECTION 3 This ordinance shall become effective immediately upon its passage and approval PASSED AND APPROVED this the /✓ —day of 2000 S \Our Uocwuenu\OOLnm<er\OA\ebmtlomnmf of doY m o- Henneb U000a oc &_ Am EULINE BROCK, MAYOR ATTEST JENNMER WALTERS, CITY SECRETARY :?4 VED AS TO LEGAL FOPM HERBERT L-9RMJTY, CI ATTORNEY m Page 2
