AN ORDINANCE OF THE CITY OF DENTON, TEXAS PROVIDING FOR THE PAYMENT
OF AN ADMINISTRATIVE FEE TO THE CITY FOR REVIEW OF TRAFFIC IMPACT
ANALYSES REQUIRED BY CITY ORDINANCE OR AS MAY BE REQUIRED AS A PART
OF ZONING APPROVAL, AND PROVIDING FOR AN EFFECTIVE DATE
WHEREAS, Chapters 34 and 35 of the Code of Ordinances and in some instances as a
part of zoning approvals, a traffic impact analysis ("TIA") under certain circumstances are
required to be provided to the City as a condition of development approval in order to determine
the traffic impacts created by new development on the traffic infrastructure of the City, and
WHEREAS, the City incurs administrative expenses in analyzing TIA's which should be
properly born by the developer, and
WHEREAS, the City Council finds that it is in the public interest to require that the
developer/applicant pay to the City an administrative fee of $500 00 for review of a TIA, and
WHEREAS, the City Council finds that such $500 00 fee bears a reasonable relationship
to the actual administrative costs incurred by the City to conduct such reviews, NOW,
THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS
SECTION 1 A $500 00 TIA Review Fee is hereby established, which must be paid to
the City by the developer/applicant of any new development when such a TIA is required by City
ordinance or as may be required as a part of zoning approval The fee shall be paid to the City's
Engineering Department prior to or contemporaneous with the submittal of the TIA
SECTION 2 This ordinance shall become effective immediately from and after its
passage and approval LL
