WHEREAS, on June 15, 1999, by Ordinance 99-205, the City Council approved a
change in zoning for 396 7 acres of land to Planned Development 174 (PD-174) Zoning District,
and
WHEREAS, on December 19, 1999, Carter & Burgess Engineering, on behalf of
Wynne/Jackson Lakes Development, submitted a Detailed Plan for n a 1 acres of land located
within PD-174 with the Intent to develop single family residences on a variety of lot sizes and
open spaces; and
WHEREAS, on June 28, 2000, the Planning and Zoning Commission recommended
approval of a Detailed Plan for such 378 1 acres, and
WHEREAS, the City Council front ha ed at the condition

WHEREAS, the City Council finds that the Detailed Plan is consistent with the approved
Concept Plan for PD-174, NOW, THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS

include (1) the "15 0 ACRE SCHOOL SITE", Lot 49, Block B, in the Country
Lakes West Preliminary Plat, (2) a one -hundred (100) foot right-of-way through
and across lot 41 and across part of lot 40 with the eastern boundary of the 100
foot right-of-way being the common boundary of Lots 41 and 42 of Block B of
that same Preliminary Plat, and (3) all public streets, water and wastewater
servicing the 15 0 ACRE SCHOOL SITE

1 final plat for Country Lakes North

SECTION 2 The provisions of this ordinance as they apply to the 378 1 acres shown in
the detailed plan herein approved, shall govern and control over any conflicting
p provisions of
Ordinance No 99-205, but all the provisions of Ordinance No 99-205 as the apply to that
remaining portion of the district not herein amended, shall continue in force and effect and shall
apply to the remainder of said district
SECTION 3 A copy of this ordinance shall be attached to Ordinance No 99-205
showing the amendment herein approved
SECTION 4 If any provision of this ordinance or the application thereof to any person
or circumstance is held invalid by any court, such invalidity shall not affect the validity of other
provisions or applications, and to this end the provisions of this ordinance are severable
SECTION 5 Any person violating any provision of this ordinance shall, upon
conviction, be fined a sum not exceeding $2,000 00 Each day that a provision of this ordinance
is violated shall constitute a separate and distinct offense
SECTION 6 this ordinance shall become effective fourteen (14) days from the date of
its passage, and the City Secretary is hereby directed to cause the caption of this ordinance to be
published twice in the Denton Record Chronicle, official newspaper of the City of Denton,
Texas, within ten (10) days of the date of its passage
