AN ORDINANCE OF THE CITY OF DENTON, TEXAS, AMENDING ORDINANCE 2000-311
TO PROVIDE FOR A DETAILED/PROJECT PLAN FOR 18 2 ACRES LOCATED WITHIN
PLANNED DEVELOPMENT 188 (PD-188) ZONING DISTRICT, THE SUBJECT PROPERTY
BEING LOCATED AT THE SOUTHWEST CORNER OF HICKORY AND BONNIE BRAE
STREET, PROVIDING FOR A PENALTY IN THE MAXIMUM AMOUNT OF $2,000 00 FOR
VIOLATIONS THEREOF, PROVIDING A SEVERABILITY CLAUSE AND AN EFFECTIVE
DATE (Z-00-014)
WHEREAS, on September 5, 2000, by Ordinance 2000-311, the City council approved a
Zoning Plan for a change in zoning for 18 2 acres of land to Planned Development 188 (PD-188)
Zoning District, and
WHEREAS, on June 28, 2000 Ambling Development Company, on behalf of J Newton
Rayzor submitted a Detailed/Project Plan for 18 2 acres of land zoned Planned Development 188
(PD-188) for development of multi family residences, and
WHEREAS, on August 23, 2000, the Planning and Zoning Commission concluded a public
hearing as required by law, after which a motion to recommend approval of the Detailed/Project
Plan passed, and
WHEREAS, the City Council finds that the Detailed/Project Plan is consistent with the
approved Zoning Plan for PD -188, NOW, THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS
SECTION 1 Ordinance No 2000-311 providing for the approval of a Planned Development
Zoning District Classification and Use Designation for the property described as PD-188 is amended
by approving the Detailed/Project Plan attached hereto and incorporated herein by reference as
Exhibit B for 18 2 acres located at the southwest comer of Hickory and Bonnie Brae (Lot 1, Block
A, University Courtyard Addition), more particularly described by the legal description attached
hereto and incorporated herein by reference as Exhibit A, subject to the following conditions
The project plan/detailed plan shall be revised to include the same stone pavers at the
northern driveway on Bonnie Brae, as are shown on the detailed landscape plan
2 The masonry of the proposed monument signs shall be of the same masonry proposed for the
buildings
3 Add a note to the plan that states "Based on current requirements on median openings, the
northern entrance may need to be converted to a right -in right -out only entrance at such time
that Bonnie Brae is widened, at the discretion of the City "

4 Provide trees within the parking lot islands The landscape plan will be equal to or better
than the landscape plan introduced into the record at the City Council public hearing on
September 26, 2000, a copy of which is on file in the City Secretary's Office
Require the development of an access easement to the property to the west Such access
easement is to be barricaded until the property to the west of the subject property is
developed
SECTION 2 The provisions of this ordinance as they apply to the 18 2 acres shown in the
Detailed/Project Plan herein approved shall govern and control over any conflicting provisions of
Ordinance No 2000-311, but all the provisions of Ordinance No 2000-311 not in conflict with this
ordinance shall continue in force and effect and shall apply to the subject property
SECTION 3 If any provision of this ordinance or the application thereof to any person or
circumstance is held invalid by any court, such invalidity shall not affect the validity of other
provisions or applications, and to this end the provisions of this ordinance are severable
SECTION 4 Any person violating any provision of this ordinance shall, upon conviction, be
fined a sum not exceeding $2,000 00 Each day that a provision of this ordinance is violated shall
constitute a separate and distinct offense
SECTION 5 That this ordinance shall become effective fourteen (14) days from the date of
its passage, and the City Secretary is hereby directed to cause the caption of this ordinance to be
published twice in the Denton Record -Chronicle, a daily newspaper published in the City of Denton,
Texas, within ten (10) days of the date of its passage

LEGAL DESCRIPTION
BEING a tract of land situated in the Eugene Puchalski Survey, Abstract No 966, City of
Denton, Denton County, Texas, being part of that called 29 172 acre tract described in
Deed to Rayzor Investments, Limited as recorded in Volume 1796, Page 601, Denton
County Deed Records and being more particularly described as follows
BEGINNING at a 1/2" inch iron rod found for the most easterly northeast corner of said
29 172 acre tract, said point being at the intersection of the south line of Hickory Street
with the west line of Bonnie Brae Street,
THE South 01 degrees 48 minutes 45 seconds West, 867 71 feet to a 2-1/2" metal
fence post found for comer in the north line of a called 7 06 acre tract of land described
in Deed to the State of Texas as recorded in Volume 382, Page 598, Denton County Deed
Records,
THENCE North 87 degrees 36 minutes 30 seconds West, 47153 feet along the north
line of said 7 06 acre tract to a one-half inch iron set for corner, said point being the
southeast corner of a called 5 000 acre tract described in Deed to Wolf Cub Properties,
Limited Partnership as recorded in Document No 97-0046080, Denton County Deed
Records,
THENCE North 02 degrees 19 minutes 35 seconds East, 258 96 feet along the east line of
said 5 000 acre tract to a 1/2" iron rod set for corner,
THENCE North 87 degrees 37 minutes 00 seconds West, 557 85 feet along the north line
of said 5 000 acre tract to a 1/2" iron rod set for corner,
THENCE North 01 degrees 48 minutes 45 seconds East, 656 68 feet to a 1/2" iron rod set
for corner, said point being in the south line of a called 3 640 acre tract described in Deed
to Walter Hesse as recorded in Volume 3191, Page 980, Denton County Deed Records,
THENCE South 87 degrees 35 minutes 10 seconds east, 92132 feet along the south line
of said 3 640 acre tract to a point for corner, said being in south line of Hickory Street,
THENCE South 63 degrees 30 minutes 50 seconds East, 116 35 feet along the south line
of Hickory street to the Point of Beginning and containing 793,449 square feet or 18 215
acres of land
