ORDINANCE NO V�'Z_
AN ORDINANCE OF THE CITY OF DENTON, TEXAS LIFTING SUSPENSION OF THE
PROPOSED TIME -OF -USE RATE OPTIONS SET FORTH IN THE STATEMENT OF
INTENT AND APPLICATION OF TEXAS UTILITIES ELECTRIC COMPANY
HERETOFORE FILED WITH THE CITY ON JANUARY 15, 1999, SUCH SUSPENSION
BEING SET FORTH IN ORDINANCE NUMBER 99-058, PROVIDING FOR APPROVAL OF
RATE SCHEDULES FOR TEXAS UTILITIES ELECTRIC COMPANY RESPECTING TIME -
OF -USE RATE OPTIONS PERTAINING TO THE SALE OF ELECTRIC SERVICE TO
RESIDENTIAL, COMMERCIAL, AND INDUSTRIAL CUSTOMERS WITHIN ITS DULY -
CERTIFICATED AREA IN THE CITY OF DENTON, TEXAS, PROVIDING CONDITIONS
UNDER WHICH SUCH RATE SCHEDULES MAY BE CHANGED, MODIFIED,
AMENDED OR WITHDRAWN, FINDING AND DETERMINING THAT THE MEETING AT
WHICH THIS ORDINANCE IS PASSED IS OPEN TO THE PUBLIC AS REQUIRED BY
LAW, ADOPTING DECLARATIONS AND FINDINGS IN THE PREAMBLE, AND
PROVIDING FOR AN EFFECTIVE DATE
WHEREAS, on January 15, 1999, Texas Utilities Electric Company (hereinafter referred
to as "TU Electric') filed with the City Council, being the governing body of the City of Denton,
a Home -Rule City, proposed new rate schedules that provide additional rate options for its
customers, which options are entirely voluntary on the part of the customer, namely its proposed
Rate GTU-M — General Service Time -of -Use -Municipality, proposed Rate RTU1-M -
Residential Time -of -Use Service -Municipality, and proposed rate GTUC-M — General Service
Time -of -Use Voluntary Curtailable-Municipality (said three proposed new rate schedules are
hereinafter collectively referred to as the "Time -of -Use Rate Schedules")
WHEREAS, the City Council, after initially considering the proposed "Time -of -Use Rate
Schedules", enacted Ordinance No 99-058 on February 16, 1999 which suspended the proposed
rate changes for a period of ninety (90) days, as permitted by Section 36 108(a) Texas Utilities
Code, V T C A (1997), until May 20, 1999, in order to make a reasonable determination of all
relevant factors involved with the proposed rates and to await the determination and approval of
the Public Utilities Commission of Texas ("PUC") in Docket No 17942 Thereafter, on April
14, 1999, the PUC entered its Order in Docket No 17942, and made Findings of Fact and
Conclusions of Law respecting the proposed "Time -of -Use Rate Schedules " The City has
determined that the three attached "Time -of -Use Rate Schedules" identified as [1] Tariff for
Electric Service 3 18 Rate RTU1-M — Residential Time -of -Use Service — Municipality, [2]
Tariff for Electric Service 3 2 25 Rate GTU-M — General Service Time -of -Use — Municipality,
and [3] Tariff for Electric Service 3 2 26 Rate GTUC-M — General Service Time -of -Use
Voluntary Curtailable — Municipality, should be approved, subject to the provisions of this
Ordinance, and that the rate suspension described hereinabove should be in all things, lifted and
terminated, NOW, THEREFORE,
THE CITY COUNCIL OF THE CITY OF DENTON, TEXAS HEREBY ORDAINS
SECTION I The City Council accordingly hereby lifts and terminates the suspension of
the proposed "Time -of -Use Rate Schedules" heretofore enacted by the Council by Ordinance
No 99-058, effective this date,
SECTION II That all of the declarations and findings contained in the preamble to this
ordinance are made a part hereof and shall be fully effective as a part of the ordained subject
matter of this ordinance
SECTION III The City Council hereby approves the three above -described Time -of -Use
Rate Schedules attached hereto and incorporated herewith by reference, and TU Electric is
authorized to render service and to collect charges as specified in the Time -of -Use Rate
Schedules from its customers electing to receive electric service under said Time -of -Use Rate
Schedules within the corporate limits of this municipality until such time as said rate schedules
may be changed, modified, amended or withdrawn with the approval of the City Council
SECTION IV The three Time -of -Use Rate Schedules herein approved shall be effective
from and after the final passage and approval of this Ordinance
SECTION V The filing of said Time -of -Use Rate Schedules shall constitute notice to
the consumers of electricity within the City of Denton, Texas, of the availability and application
of such Time -of -Use Rate Schedules
SSECTION VI TU Electric shall not seek any additional rate or surcharge mechanism in
order to recover any revenues lost on account of the application of these time -of -use rates, and
there shall be no imputed revenues on account of any reduction in TU Electric's revenues that
may result from the application of these time -of -use rates
SECTION VII The rate reductions approved by the Public Utility Commission of
Texas in Docket No 18490 shall be applied to the time -of -use rates approved herein, such that
Rider RRD shall be applicable to Rate RTUI-M, Rider GSRD shall be applied to all customers
taking secondary service under either Rate GTU-M designated as GTU-M-SEC or under Rate
GTUC-M designated as GTUC-M-SEC, and Rider RD shall be applied to all other customers on
Rate GTU-M or Rate GTUC-M
SECTION VIII In its next general base rate case in which the time -of -use rates
herein approved are at issue, TU Electric will either (a) include all customers taking service
under Rate GTUC or GTUC-M during the test year involved in such base rate case as a separate
rate class in its cost allocation study, or (b) include in its cost allocation study the load and
revenue data applicable to each GTUC or GTUC-M customer taking service under Rate GTUC
or GTUC-M during the test year involved in such base rate case with the load and revenue data
of the rate class applicable to such GTUC or GTUC-M customer immediately prior to such
customer's taking service under Rate GTUC or GTUC-M In the event, however, that industry
restructuring is mandated by legislative changes prior to the time that TU Electric has another
general base rate case and such legislation authorizes the recovery by TU Electric of any
stranded costs from its various customer classes in accordance with its last approved cost of
service study, the customers then receiving service under the time -of -use rates will be included
in the customer classes reflected in TU Electric's most recent cost of service study as follows
(A) Customers on rate RTUI-M shall be included in Rate Class RTU,
(B) Customers on Rate GTU-M shall be included in Rate Class HV, GP, or GS,
depending upon the voltage level of the service, such that customers on Rate GTU-M receiving
service at high voltages shall be included in Rate Class HV, customers receiving service at
primary distribution voltages shall be included in Rate Class GP, and customers receiving service
at secondary distribution voltages shall be included in Rate Class GS, and
(C) Customers on Rate GTUC-M shall be included in Rate Class NI (Noticed
Interruptible) depending upon the voltage level of the service, such that customers on Rate
GTUC-M receiving service at high voltages shall be included in Rate Class NI (High Voltage),
customers on Rate GTUC-M receiving service at primary distribution voltages shall be included
in Rate NI (Primary), and Customers on Rate GTUC-M receiving service at secondary
distribution voltages shall be included in Rate NI (Secondary)
SECTION IX Nothing in this Ordinance contained shall be construed now or hereafter as
limiting or modifying in any manner the right and power of the City Council of the City of
Denton, Texas, under the law, to regulate the rates, operations, and services of TU Electric
SECTION X It is hereby officially found and determined that the meeting at which this
Ordinance is passed is open to the public, and as required by law and that public notice of the
time, place, and purpose of said meeting was given as required

Curtailment Provisions
Customer's lad will be subject to no more than 700 boon of wttatlment during the 12 months ending with the current month and no more
than 12 hours to any 24 hour period, except when the Company has made public pleas to mina electric energy usage to essential needs
because of an am or aatawide shortage of electric power and/or energy, then the 12 hour Irma no longer applies Customer will have 15
manures in which to volunanly curtail all of the load at the pond of delivery or, if Customer chooses not to curtail all of the load at the point
of delivery, all kWh used dunes the curtailment period will be billed at an energy charge of 700 per kWh, rather than at the energy charge
specified above, provided that, in the event the Customer cunatis 3S% or mom of the total lad at a point of delivery not included in the
Aggngate1ilidag Option, or 35 % or room of the total lad at all points of delivery to the Customer aggregated under the Aggmgae Billing
Option, throughout the curtailment period, the energy charge for W kWh used during the curtailment period at such point(s) of delivery will
be billed at an energy charge of 50o per kWh Total load (ether at a single point of delivery or as of customer's points of delivery under
the Aggregate Billing Option) is defined as the Customer's 15-minute demand recorded immediately prior to Customer s receipt of the mum

Curtailments will occur during the following conditions
(a) when the Company is required by the Electric Reliability Council of Texas (ERGOT) Operating Guides or the ERCOT
Independent System Operator (ISO) to interrupt interruptible loads The cum lmem period is the enure period during which

(b) when the Company's system load is at or above 95% of the higher of (1) the estimated system annual peak lad for the current
calendar year or (2) the actual system peak load for the current calendar year In the event that the actual system peak load in the
calendar year exceeds the previously saturated system annual peak load for that calendar year, web actual system peak load shall
become the new estimated system annual peak load beginning on the following day The curtadmem period is the enure period
during which Use Company's system lad is at or above 95 R of the saturated system amoral peak load for the current year
beginning 15 minutes after Costumer is raquested to curtail lad
Aggregate Billing Option
An ennty with multiple pomis of delivery moelving service under Rate GTUC M MAY elect to receive an aggregate summary bill Aggregate
billing is available to station that meet all of the following criteria
a) all points of delivery are billed on the acme voltage level service,
b) all points of delivery are on the same billing cycle, and
c) all points of dahvery are under the mine ownership
A one-time charge of $25 per point of delivery is nude when Customer selects the Aggregate Billing option

d) If it is determined at any time by Company that the Customer has failed to operate and maintain mmmumatiom equipment in such a
manner so that them an be compliance with the provisions of this r9te then the Customer will be immediately billed on the rate
schedule for firm power for the petod since service was first commenced under the rate, or for the one year period just prior to such
determination, whichever period is lei The difference between the actual bills tendered and the amount an calculated shall be adjusted
each month to cover the Company's amoral ones of capita, compounded monthly from such month to date, as determined in the
