AN ORDINANCE PARTIALLY VACATING A CERTAIN UTILITY EASEMENT
RECORDED IN THE DEED RECORDS OF DENTON COUNTY, TEXAS AT VOLUME
1953, PAGE 268, AS IT PERTAINS TO LOT 11, BLOCK 6, OF THE HANNAH ESTATES,
PHASE II ADDITION TO THE CITY OF DENTON AND KNOWN AS 1401 OXFORD
LANE, AND PROVIDING FOR AN EFFECTIVE DATE
WHEREAS, the City of Denton has received a request for the partial abandonment of a
certain utility easement, and
WHEREAS, the Development Review Committee (DRC) for the City of Denton, Texas
reviewed the requested abandonment and recommended approval, and
WHEREAS, the Council of the City of Denton, Texas has determined that the utility
easement being partially vacated is no longer needed for public use since another utility
easement (16 foot) is located at the front of the lot, and
WHEREAS, the fair market value of the utility easement being abandoned has been
determmed and received, as required by section 272 001 of the Texas Local Government Code,
NOW, THERFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS
SECTION I. That the south 10 feet of a 16-foot utility easement at the rear of Lot 11,
Block 6 of the Hannah Estates, Phase II Addition recorded in Cabinet D, Page 173 of the Plat
Records of Denton County, Texas, known as 1401 Oxford and being more particularly described
in Exhibit A, attached hereto and incorporated herein by referenced, and pertaining to a portion
of property out of the J Carter Survey, Abstract No 274 recorded in Volume 1953, Page 268 of
the Real Property Records of Denton County, Texas, is permanently vacated and extinguished as
a public utility easement, to the extent described in said exhibit
SECTION II That by reason of such vacation the City of Denton's property interest in
the vacated portion of said easement shall, by operation of law, revert to the owner or owners
abutting the easement herein abandoned, and the City of Denton releases any and all claims to
the use of the vacated portion of said property as a public easement
SECTION III That this ordinance shall become effective immediately upon its passage
and approval

a distance of 121.86 feet to a point at the intersection of the
south line of said 16 foot utility easement, same being the POINT
OF BEGINNING;
THENCE North 020 01. 45" East, continuing along the west line of
said Lot 11, a distance of 10.00 feet to a point for corner on the
west line of said Lot 11;
THENCE South 870 46' 00" East, parallel to the north line of said
Lot 11, a distance of 75.51 feet to a point for corner on the east
line of said Lot 11;
THENCE South 020 01' 45" West, along the east line of said Lot 11,
a distance of 10.00 feet to a point for corner at the intersection
of the south line of said 16 foot utility easement;
THENCE North 870 46. 000 west, parallel to the north line of said
Lot 11 and along the south line of said 16 foot utility easement,
a distance of 75.51 feet to the POINT OF BEGINNING and containing
