HomeMy WebLinkAbout1999-211\\ON LOLWOLIWae WgALGLWut OmumeulPANmmuAMXM" ubmWmmium4oc ORDINANCE NO Wi a /i AN ORDINANCE PARTIALLY VACATING A CERTAIN UTILITY EASEMENT RECORDED IN THE DEED RECORDS OF DENTON COUNTY, TEXAS AT VOLUME 1953, PAGE 268, AS IT PERTAINS TO LOT 11, BLOCK 6, OF THE HANNAH ESTATES, PHASE II ADDITION TO THE CITY OF DENTON AND KNOWN AS 1401 OXFORD LANE, AND PROVIDING FOR AN EFFECTIVE DATE WHEREAS, the City of Denton has received a request for the partial abandonment of a certain utility easement, and WHEREAS, the Development Review Committee (DRC) for the City of Denton, Texas reviewed the requested abandonment and recommended approval, and WHEREAS, the Council of the City of Denton, Texas has determined that the utility easement being partially vacated is no longer needed for public use since another utility easement (16 foot) is located at the front of the lot, and WHEREAS, the fair market value of the utility easement being abandoned has been determmed and received, as required by section 272 001 of the Texas Local Government Code, NOW, THERFORE, THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS SECTION I. That the south 10 feet of a 16-foot utility easement at the rear of Lot 11, Block 6 of the Hannah Estates, Phase II Addition recorded in Cabinet D, Page 173 of the Plat Records of Denton County, Texas, known as 1401 Oxford and being more particularly described in Exhibit A, attached hereto and incorporated herein by referenced, and pertaining to a portion of property out of the J Carter Survey, Abstract No 274 recorded in Volume 1953, Page 268 of the Real Property Records of Denton County, Texas, is permanently vacated and extinguished as a public utility easement, to the extent described in said exhibit SECTION II That by reason of such vacation the City of Denton's property interest in the vacated portion of said easement shall, by operation of law, revert to the owner or owners abutting the easement herein abandoned, and the City of Denton releases any and all claims to the use of the vacated portion of said property as a public easement SECTION III That this ordinance shall become effective immediately upon its passage and approval \\CH LOLIVOLI Ku4dgN LG O monMftNnoM XMRO Am onmw doo PASSED AND APPROVED this the � day of 1999 MAYOR ATTEST' JENNIFER WALTERS, CITY SECRETARY APPROVED AS TO LEGAL FORM HERBERT L PROUTY, CITY ATTORNEY BY AeJA � ' arc c Page 2 of 2 EXHIBIT ^A" ALL that certain lot, tract or parcel of land lying and being situated in the City and County of Denton, State of Texas, in the J.
