HomeMy WebLinkAbout1999-240\\CH LGL\VOLI\SHARED\DEPnLGL\Our Documents\0rdtnances\99\Z-99 027 Ordinance doe ORDINANCE NO — O AN ORDINANCE OF THE CITY OF DENTON, TEXAS, PROVIDING FOR A CHANGE FROM AGRICULTURAL (A) ZONING DISTRICT CLASSIFICATION AND USE DESIGNATION TO A LIGHYINDUSTRIAL WITH CONDITIONS (LI[C]) ZONING DISTRICT CLASSIFICATION AND USE DESIGNATION FOR 2 39 ACRES OF LAND LOCATED AT 4401 EAST MCKINNEY STREET ON THE NORTHEAST CORNER OF MAYHILL ROAD AND MCKINNEY STREET, PROVIDING FOR A PENALTY IN THE MAXIMUM AMOUNT OF $2,000 00 FOR VIOLATIONS THEREOF, AND PROVIDING FOR AN EFFECTIVE DATE (Z- 99-027) WHEREAS, Troy Glenn, the owner of the subject property, has applied for a change in zoning for 2 39 acres of land from Agricultural (A) zoning district classification and use designation to Light Industrial (LI) zoning district classification and use designation, and WHEREAS, on May 12, 1999, the Planning and Zoning Commission recommended approval of the requested change in zoning, and WHEREAS, the City Council finds that the change in zoning will be in compliance with the 1988 Denton Development Plan, the 1998 Denton Plan Policies, and the 1999 Growth Management Strategies and Plan, NOW, THEREFORE THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS SECTION 1 That the zoning district classification and use designation of the 2 39 acre property described in the legal description attached hereto and incorporated herein as Exhibit A is changed from Agricultural (A) zoning district classification and use designation to Light Industrial with conditions (LI[c]) zoning district classification and use designation under the comprehensive zoning ordinance of the City of Denton, Texas, subject to the following conditions Floor Area Ratio. Total developed floor area shall not exceed a 0 50 10 floor -to -area ratio (F A R ) or 52,054 square feet Lighting Lighting on the property shall be designed and maintained so as not to shine on, or otherwise disturb, adjoining property or to shine and project upward to prevent the diffusion into the night sky SECTION 2 That the City's official zoning map is amended to show the change in zoning district classification SECTION 3 That any person violating any provision of this ordinance shall, upon conviction, be fined a sum not exceeding $2,000 00 Each day that a provision of this ordinance is violated shall constitute a separate and distinct offense SECTION 4 That this ordinance shall become effective fourteen (14) days from the date of its passage, and the City Secretary is hereby directed to cause the caption of this ordinance to be published twice in the Denton Record -Chronicle, a daily newspaper published in the City of Denton, Texas, within ten (10) days of the date of its passage PASSED AND APPROVED this the Ad—o day of 1999 ATTEST JENNIFER WALTERS, CITY SECRETARY BY APPROVED AS TO LEGAL FORM HERBERT L PROUTY, CITY ATTORNEY BY &44� / JAC LER, MAYOR PAGE 2 EXHIBIT A (Z-99-027) 2.39 Acres more or less All that certain tract of land situated in the M Forrest Survey, Abstract No 417, City of Denton, Denton County, Texas and being all of the called one acre tract described in the deed from D B Boyd at ux to Troy Glenn et ux recorded in Volume 389, Page 144, of the Deed Records of Denton County, Texas, and all of the (called) one and one-half acre First tract described in the deed from John G Freeman et ux to Troy D Glenn, recorded in Volume 1756, Page 964, of the Real Property Records of Denton County, Texas, being more particularly described as follows BEGINNING for the Northwest corner of the tract being described herein, at a 1/2 inch iron rod at the Southwest comer of a (called) 2 267 acre tract described in a deed from Mildred Moms to Carl Beuchamp et ux recorded in Volume 2138, Page 400, of the Real Property Records of Denton County, Texas, and at the occupied and recognized Northwest comer of the said one acre tract on the East side of Maylull Road, THENCE South 86 Degrees 27 Minutes 06 Seconds East with the South line of the said 2 267 acre tract and the agreed North line of the two Glenn tracts a distance of 314 30 feet to a 1/2 inch iron rod at the occupied and recognized Northeast corner of the said one and one-half acre First tract and the Southeast comer of the 2 267 acre tract on the West line of a (called) one acre Second tract described in the deed from John G Freeman et ux to Troy D Glenn, recorded in Volume 11765, Page 964, of the Real Property Records of Denton County, Texas, THENCE South 04 Degrees 41 Minutes West with the West line of the one acre Second tract and the East line of the one and one-half acre First tract a distance of 37140 feet more or less to the Southeast comer thereof on the North right-of-way of FM Highway 426 (East McKinney Street), THENCE North 73 Degrees 56 Minutes West with the North right-of-way of FM ighway 426 a total distance of 309 80 feet more or less to the Southwest comer of the said one acre tract on the East side of Mayhrll Road, THENCE North 02 Degrees 42 Minutes East along the East side of Mayhill road with the East line of the one acre tract, a distance of 304.20 feet more or less to the POINT OF BEGINNING and enclosing 2 39 acres of land more or less
