Historic Landmark Commission
October 9, 2017
The Historic Landmark Commission of the City of Denton, Texas convened in Regular Meeting
on Monday, October 9, 2017 at 5:30 p.m. in the City Council Work Session Room at City Hall,
215 E. McKinney Street, Denton, Texas at which time the following items were considered:
PRESENT: Chair Peggy Riddle, Vice-Chair Deb Conte, Commissioners: Helen
Bailey, Scott Campbell, John Morris, Alyssa Stevenson, Roy Anderson,
and Daniel Abasolo.
ABSENT: Commissioner Kenneth Williamson.
STAFF: Richard Cannone, Scott McDonald, Ron Menguita, Roman McAllen,
Trey Lansford, and Athenia Green.
WORK SESSION
1. Receive a report and hold a discussion regarding the restoration of 2212 W. Oak. (Roman
McAllen)
Roman McAllen, Historic Preservation Officer, provided the presentation for this item, including
site photos and photos underneath the house. McAllen stated there is a hole under the house created
by the collapsing of a cistern. He stated some of the piers have also collapsed. McAllen stated the
applicant, Dan Fette, was also present. Fette did not wish to speak. McAllen stated work has begun
on the house, and the tax credits are in the application process.
Chair Riddle questioned if there are any transients residing at the property. Property owner, Randy
Park, stated the Denton Police Department have tended to one that was trespassing on the property.
He stated locks have been added to all the doors to prevent this from occurring again.
Vice-Chair Conte stated she is glad to see progress being made on this house. Chair Riddle stated
she will assist in any way possible to help gather research for the property. There was no further
discussion. Chair Riddle closed the Work Session at 5:40 p.m.
Following the completion of the Work Session, the Historic Landmark Commission convened in
a Regular Meeting of the Historic Landmark Commission in the City Council Work Session Room,
215 E. McKinney at which time the following items were considered:

B. Hold a public hearing and consider making a recommendation to the Planning and
Zoning Commission and City Council regarding repealing and replacing Section
35.7.6, repealing Sections 35.7.7 and 35.7.8, adding Section 35.3.15, adding
definitions to Section 35.23.2 and making changes to Section 35.4.3. of the Denton
Development Code (DCA17-0009, Historic Preservation Code Amendments,
Roman McAllen)
Chair Riddle stated she hopes the Commission has had time to review this document. She stated
staff has put a lot of work into this item. Roman McAllen, Historic Preservation Officer, provided
the proposed revisions, timeline and next steps for the process. McAllen stated staff recommends
approval of this request.
Chair Riddle referred to Section 35.7.6.2 of the Denton Development Code (DDC), regarding the
Proposed Penalty section, she stated page one (1) refers to Section 35.1.10.4, however that
information is not included. Ron Menguita, Long Range Planning Administrator, stated it is
referring to the section of the DDC.
Chair Riddle questioned the Commission if they are aware of the penalty amount. She stated there
is a $2,000 fine per violation and up to $500 per day thereafter. She questioned who would handle
the violation. Menguita stated the Community Improvement Services Division would handle the
code violations.
Commissioner Conte referred to 1807 N. Bell Avenue as being a good resource to refer back to in
this situation. She stated she feels that the fines were discretionary during that project, since the
owner/applicant was in compliance at some point during the process, therefore, the City worked
with them regarding their noncompliance.
Trey Lansford, Deputy City Attorney, read Section 35.1.10.4.B into the record: Each day any
violation or noncompliance continues shall constitute a separate and distinct offense.
Chair Riddle stated she hopes the individuals within the historic districts would report
noncompliant work to the Historic Preservation Officer. She stated McAllen is good about getting
out into the community and resolving problems.
McAllen stated he would like to come back before this Commission soon, with the Commissioners
support to designate a downtown district, as a conservation district perhaps. Commissioner
Abasolo stated this has been an issue since he has served on this Commission.
Commissioner Anderson questioned if the portion of the square is not considered a historic district.
Chair Riddle stated no, the individual buildings are designated.
Commissioner Stevenson commended McAllen and staff on their work with this item.
Chair Riddle opened the Public Hearing. There was no one to speak. Chair Riddle closed the Public
Hearing.

4. HISTORIC LANDMARK COMMISSION PROJECT MATRIX
A. Historic Landmark Commission project matrix.
Roman McAllen, Historic Preservation Officer, stated additional items that have been requested
will be sent to the Commission in the form of an email. He stated he will add an item regarding
the local district for the square.
McAllen gave a brief presentation to the memorandums that were provided to the Commission.
Chair Riddle informed the Commission of the National Preservation Conference in Des Moines,
Iowa in 2018. She stated it would be a good experience if most of the Commission could attend.
There was no further discussion. Chair Riddle adjourned the meeting at 6:25 p.m.
