February 13, 2001
After determining that a quorum was present and convening in an Open Meeting, the City
Council convened in a Closed Meeting of the City of Denton City Council on Tuesday, February
13, 2001 at 5:15 p.m. in the City of Denton Council Work Session Room.
PRESENT: Mayor Brock; Mayor Pro Tem Beasley; Council Members Burroughs, Cochran,
Durrance, Kristoferson and Young.
ABSENT: None
1. The Council considered the following in Closed Meeting:
A. Deliberations Regarding Real Property --- Under TEXAS GOVERNMENT
CODE Section 551.072.
(1)
The Council received information from Staff, discussed and deliberated
concerning the possible purchase of real property containing
approximately 40 acres for a community park located on Ryan Road
approximately one half mile west of Teasley in the City of Denton.
(2)
The Council received information from Staff, discussed and deliberated
concerning possible options for the purchase of real property for park and
transportation purposes with respect to Hickory Creek Road realignment
alternatives.

2. The Council received a report and gave staff direction regarding the FY 2001-2002
Budget Calendar.
Anna Mosqueda, Director of Management and Budget, presented the budget calendar. She
stated that March 1 was the target date for returning the Budget Priority Questionnaire to staff.
Friday, August 3, 2001 has been targeted for the City Council budget workshop. August 10 has
been reserved as an extra day for City Council budget deliberations if needed. August 28 would
be the public hearing on the tax rate and the budget. Final adoption of the budget was scheduled
for September 4.
Council Member Durrance asked that the August 10 date be scheduled as a budget workshop and
not be a tentative date.
1. The Council received a report and held a discussion on the City of Denton
Comprehensive Annual Financial Report (CAFR) for the fiscal year ended September 30, 2000.
Kathy DuBose, Assistant City Manager of Fiscal and Municipal Services, introduced Terry Kyle
of Deloitte and Touche. Kyle presented the Comprehensive Annual Financial Report, Report to
Management, and Single Audit Reports for the year ended September 30, 2000. He stated that
the Audit Committee had unanimously approved these reports.

DuBose briefly reviewed the Comprehensive Annual Financial Report. She pointed out the
Combined Balance Sheet for all fund types and account groups and stated that the Excess of
Revenues for the fiscal year ended with over $1,000,000. She reviewed the Utility System
Funds---electric, water, and wastewater. She also reviewed the Solid Waste Fund.
3. The Council received a report and gave staff direction regarding the potential rezoning of
1808 N. Elm from a General Retail (GR) zoning district to a Planned Development (PD) zoning
district. (SI-01-002)
Doug Powell, Director of Planning and Development, stated that the property was currently
zoned as Planned Development. The property owners wanted to convert the existing structures
for residential purposes, but still maintain the potential for future office uses. A Planned
Development was the only zoning district that would allow mixed uses to exist on the same
property. Staff recommended a zoning change be initiated for the property.
Consensus of the Council was to follow staff recommendation.
4. The Council received a report, held a discussion and gave staff direction regarding the
draft Development Code, including the review of public comments, draft code policy issues,
zoning map revision requests, and the options for providing additional notice for properties that
would become legal, non-conforming land uses.
Doug Powell, Director of Planning and Development, presented the Council with a memo
regarding non-conforming industrial uses. He stated that several areas of the city contained light
industrial uses and would be impacted by the draft Development Code and Zoning Map. He
stated that if these areas were left with the proposed zoning, most would be non-conforming uses
under the new Development Code.
The Council reviewed issues identified by the Chamber's Development Code Sub-Committee.
5. There was no official action on Closed Meeting Item(s) under Sections 551.071-551.086
of the Texas Open Meetings Act.
With no further business, the meeting was adjourned at 9:15 p.m.
