MInutes February 20, 200138¸ CITY OF DENTON CITY COUNCIL MINUTES February 20, 2001 After determining that a quorum was present and convening in an Open Meeting, the City Council convened in a Closed Meeting on Tuesday, February 20. 2001 at 5:15 p.m. in the Work Session Room. PRESENT: Mayor Brock; Mayor Pro Tem Beasley; Council Members Burroughs, Cochran, Durrance, Kristoferson and Young. ABSENT: None 1. The Council considered the following in Closed Meeting: Deliberations Regarding Certain Public Power Utilities: Competitive Matters --- Under TEX. GOV'T. CODE Section 551.086.** Deliberations Concerning Real Property --- Under TEX. GOV'T. CODE Section 551.072. (1) Received confidential competitive electric utility information from Staff and the City's outside consultants, discussed, deliberated, considered, provided Staff with direction, voted, and took action as necessary respecting the valuation of, and the possible sale, transfer, assignment, or other divestiture of real property pertaining to the City of Denton's electric utility system, including, without limitation: the Gibbons Creek generation facility located in Grimes County, Texas; the Spencer generation facility located on Spencer Road in Denton County, Texas; the two hydroelectric facilities located in Denton County, Texas; and other components of the City's electric generation assets. Deliberations Regarding Certain Public Power Utilities: Competitive Matters --- Under TEX. GOV'T. CODE Section 551.086.** (1) Received a presentation and information from Staff respecting issues relating to Denton Municipal Electric's (DME) deregulation market plan; and discussed, deliberated, considered, and provided Staff with direction respecting such issues. Deliberations Regarding Real Property --- Under TEXAS GOVERNMENT CODE Section 551.072. and receipt of legal advice from the City Attorney under TEXAS GOVERNMENT CODE section 551.071 (1) Received information from Staff, discussed and deliberated conceming the value of real property at 1036 Reed Street in the City of Denton owned by the City of Denton. Receipt of legal advice from the City Attorney or an Assistant City Attorney on legal matters pertaining to the sale of said real property for low to moderate-income housing. D. Pledge of Allegiance The Council and members of the audience recited the Pledge of Allegiance to the U.S. and Texas flags. PROCLAMATIONS/PRESENTATIONS 2. February Yard of the Month Awards Mayor Brock presented the Yard of the Month Awards to: Mona and Jim Alexander Jerry and Vivian Romine Effie McQueen Stephen and Amy Shepherd Mickey Wheatley Norma Carrell Ben E. Keith Beers CITIZEN REPORTS 3. Ed Soph regarding recent spraying of herbicide in city parks. Mr. Soph stated his wife had suffered side effects from herbicide spraying after walking through Avondale Park after it had been sprayed for broad weed control. He felt the weed control could be done with other alternatives. He requested a moratorium on spraying of weeds in the parks until safe alternatives could be determined for weed control. 4. Gary Taylor regarding the two-hour parking limit on the square. Mr. Taylor stated that employees in his office were receiving parking tickets for violation of the two hour parking restrictions on the Square. He asked for some sort of relief for the parking restrictions on the Square as it was an inconvenience to have to move their cars every two hours. He indicated that the County employees working in the Courthouse experienced the same problems. 5. Ross Melton regarding lawyers and code enforcement. Mr. Melton stated that he was still trying to find out who was in charge of Code Enforcement, what were the definitions of weeds and trash and what were the procedures used for code enforcement. 6. John Ryan regarding City of Denton transportation and SPAN. 39 40 City of Denton City Council Minutes February 20, 2001 Page 3 Mr. Ryan stated that the present service was unreliable and had difficult access to Dial-A-Ride. His wife would have to call two hours ahead before getting the Dial-A-Ride service. The bus stops keep changing further and further from their home that made it extremely difficult for them. He presented Council with an alternate route that would better serve his area of the city. 7. Carol Ryan regarding City of Denton transportation and SPAN. Ms. Ryan stated that she had a visual handicap and could not drive. She had to rely on others for her transportation. The bus stop had been changed and she now needed to use the Dial-A-Ride service that took away from her independence as she had to make prior arrangements for the ride. CONSENT AGENDA Council Member Cochran asked to pull Items #15, #17, # 18, #20 and #30. Council Member Young asked to pull Items #30 and 31. Beasley motioned, Burroughs seconded to approve the Consent Agenda and accompanying ordinances with the exception of Items #15, #17, #18, #20, #30 and #31. On roll vote, Beasley "aye", Burroughs "aye", Cochran "aye", Durrance "aye", Kristoferson "aye", and Mayor Brock "aye". Motion carried unanimously. Approved a tax refund to James N. John in the amount of $700.26. The 2000 property tax was paid twice. Approved a tax refund to Pascal & Samantha Zaklama in the amount of $817.62. The 2000 property tax was paid twice. 10. Approved a tax refund to Robert Moses in the amount of $5,714.91. Mr. Moses erroneously paid his Denton County taxes to the City of Denton. 11. NO. 2001-061 AN ORDINANCE ACCEPTING SEALED COMPETITIVE BIDS AND AWARDING A CONTRACT FOR THE SERVICES OF A THIRD PARTY ADMINISTRATION FOR WORKERS COMPENSATION FOR THE CITY OF DENTON; PROVIDING FOR THE EXPENDITURE OF FUNDS THEREFORE AND PROVIDING AN EFFECTIVE DATE (RFSP 2624 - WORKERS COMPENSATION THIRD PARTY ADMINISTRATION AWARDED TO CCS CONSULTING, LP IN THE AMOUNT OF $108,650 OVER A 3-YEAR TIME PERIOD). 12. The Council considered approval of the second reading of an annexation ordinance of the City of Denton, Texas, which was amended on January 9, 2001, and was published on January 20, 2001 and which passed on first reading on November 28, 2000 and was published on December 8, 2000 to annex two tracts of land, comprising 672 acres; Tract One being located on the on the southwestern side of the City of Dentoffs extraterritorial jurisdiction east of U.S. Highway 377, south of Regency Court on each side of Country Club Road, west of Montecito along Ryan Road and mostly north of Brush Creek Road; and Tract Two being located west of Montecito, south of El Paseo and east of Santa Monica; and providing an effective date (4-100. The Council considered adoption of an ordinance authorizing the Mayor to execute an Interlocal Agreement with Denton County for road improvements; providing for the expenditure of funds therefor; and providing an effective date.
