After determining that a quorum was present and convening in an Open Meeting, the City
Council convened in a Closed Meeting on Friday, March 9, 2001 at 9:00 a.m. in the City
of Denton Council Work Session Room.
PRESENT: Mayor Brock; Council Members Burroughs, Cochran, Durrance, and
Kristoferson
ABSENT: Mayor Pro Tem Beasley; Council Member Young
1. The Council considered the following in Closed Meeting
Consultation with the City Attorney --Under TEXAS 'GOVERNMENT
CODE Section 551.071

Received legal advise from the City Attorney or his staff
concerning legal issues regarding adoption of the Denton
Development Code, where to discuss these matters in public would
conflict with the duty of the City's attorneys under the Texas
Disciplinary Rules of Professional Conduct of the State Bar of
Texas.
Following the conclusion of the Closed Meeting, the Council convened into a Special
Called Meeting on Friday, March 9, 2001 in the Council Work Session Room.
Council Member Burroughs left the meeting.
1. The Council received a report, held a discussion and gave staff direction
regarding the draft Development Code, including the review of public comments, draft
code policy issues, zoning map revision requests, and the options for providing additional
notice for properties that would become legal, non-conforming land uses.
Doug Powell, Director of Planning and Development, presented Council with
information regarding unresolved planned developments. He presented an update on the
unresolved issues that Council may want to consider.
Council held a discussion involving the development code and included such topics as:
definition of outdoor storage, distinction between outdoor storage and outdoor sales area
of a business; and whether to allow a drive-through in the downtown university core
district.
Council reached a consensus on the following items:
Outside storage would be allowed with screening
Mini-warehouses would be allowed with architectural guidelines
Outside storage in the Downtown Core District would be allowed

Drive through facilities would be limited in the Downtown Core District to be not
located on the street side, integrated into the facility and would be an SUP process
The Pruitt property, the area adjacent to North Lakes Park would remain NR2
The Fulton property south of Jagoe would be changed to ECI
#8 on the List of Outstanding Issues would be deleted.
Council still wanted to do site visits and would try and schedule next Friday.
Julie Smith, Environmental Compliance Manager, presented a summary on
Environmentally Sensitive Areas and the benefits of the Eastern Cross Timbers for the
City.
Council Member Cochran requested more information on the specific benefits involved
with environmentally sensitive areas for the individual property owner such as benefits
for maintaining trees vs. stormwater management.
Smith indicated that she would provide that type of information and would continue to
work on an environmentally sensitive area overlay map with parcels.
Consensus of Council was to allow oil and gas drilling in rural districts, agricultural
areas, and industrial districts with a specific use permit.
Staff would survey the Shady Oaks/Duncan/Smith Street area to determine non-
conforming uses and ownership of the property.
Smith presented a handout regarding the regulations associated with Green Builders and
green building practices. She indicated that these regulations could be used with
environmentally sensitive area constraints on particular pieces of property.
2. There was no continuation of Closed Meeting under Sections 551.071-551.086 of
the Texas Open Meetings Act.
3. Them was no official action on Closed Meeting Item(s) under Sections 551.071-
551.086 of the Texas Open Meetings Act.
With no further business, the meeting was adjourned at 2:00 p.m.
