CITY OF DENTON CITY COUNCIL MINUTES
March 16, 2001
After determining that a quorum was present and convening in an Open Meeting, the City
Council convened in a Closed Meeting on Friday, March 16, 2001 at 9:00 a.m. in the City
of Denton Council Work Session Room, Denton City Hall.
PRESENT: Mayor Brock; Council Members Burroughs, Cochran, and Kristoferson
ABSENT: Mayor Pro Tem Beasley; Council Members Durrance and Young

The Council held consultation with the City Attorney --Under TEXAS
GOVERNMENT CODE Section 551.071

Received legal advice from the City Attorney or his staff
concerning legal issues regarding adoption of the Denton
Development Code and legal advice concerning nonconforming
uses where to discuss these matters in public would conflict with
the duty of the City's attomeys under Texas Disciplinary Rules of
Professional Conduct of the State Bar of Texas including but not
limited to legal advice relating to various planned developments
including the following:
1. PD-20 Unicom Lake
2. PD-139 The Vintage
3. PD 142 Hillcrest Center
4. PD 138 Hunter Ranch Business and Industrial Park
5. PD 120 North Pointe
Council Member Durrance arrived during the Closed Session.
Following the conclusion of the Closed Meeting, the Council convened into a Special
Called Meeting on Friday, March 16, 2001 in the Council Work Session Room.
1. The Council received a report, held a discussion and gave staff direction
regarding the draft Development Code, including the review of public comments, draft
code policy issues, zoning map revisions, and various planned development districts
including PD-20, PD-139, PD-142, PD-138, and PD-120.
Doug Powell, Director of Planning and Development, reviewed schedule for future
meetings.
Mayor Brock suggested that staff include the changes Council had made on the zoning
maps for the Planning and Zoning Commission to review with a possible time frame of
the end of April for that review.

Powel indicated that the Commission would forward any completed chapters or maps for
Council to review.
Mayor Brock suggested that after all recommendations and changes were final that a
public hearing be held before adoption of the Code.
Powell suggested a letter from the Mayor to the Commission outlining a proposed
schedule and Council's concerns indicating a possible ordinance detailing the adoption
process.
Ed Snyder, Assistant City Attorney, stated that the Council could direct staff to identify
all planned developments within the City and bring them back to Council for a decision
whether to keep them in the same classifications on the zoning map.
Council Member Cochran felt that the master plan standards were in line with what
Council was trying to achieve and felt that those should be honored.
Don Dillard, developer, was allowed to address the Council. He reviewed the details of
PD-14 and PD-142 relative to development.
Council discussed non-conforming uses.
Powell indicated that Legal was researching further information for Council regarding
non-conforming uses. The language in the Code was such because Council wanted a
tough non-conforming standard.
Mayor Brock asked for a clarification of role of the Board of Adjustment in terms of state
statutes.
Powell indicated that it heard appeals from decisions by the Building Official.
Council Member Cochran asked about issue #17 on the Closed Issue list.
Powell stated that decorate block would be deleted for residential use and added for non-
residential use.
Council Member Cochran asked about the process for comprehensive plan amendments.
Powell stated that comprehensive plan amendments would only take place four times per
year. Zoning and plat changes would remain the same. It was still a Development
Review Committee process for all applications. Site plan reviews would now be required
and administrated at a staff level with an appeal to the Planning and Zoning Commission.
The Zoning Board of Adjustment would still be in place

2. The Council continued their earlier Closed Meeting under Sections 551.071-
551.086 of the Texas Open Meetings Act.
3. Them was no official action on Closed Meeting Item(s) under Sections 551.071-
551.086 of the Texas Open Meetings Act.
4. The Council was to have participated in on-site visits of various properties being
affected by the adoption of the Development Code.
Council did not go on the tour.
With no further business, the meeting was adjourned at 2:00 p.m.
