Minutes May 29, 20011:7. 4 CITY OF DENTO~ CITY COUNCIL Mi'N~JTES May 29, 2001 After determining that a quorum was present the City Council convened in a Special Called Meeting on Tuesday, May 29, 2001 at 6:00 p.m. in the Council Work Session Room. PRESENT: Mayor Pro Tern Beasley; Council Members Burroughs, Fulton, McNeill, Phillips, and Redmon. ABSENT: Mayor Brock 1. The Council considered and took action on Board and Commission nominations and appointments. Council voted on the following nominations: Harry Phillips to the Traffic Safety Commission. On roll vote, Beasley "aye", Burroughs "aye", Fulton "aye", McNeill "aye", Phillips "aye", and Redmon "aye". Motion carried unanimously. Don White, Sr. to the Public Utilities Board. On roll vote, Beasley "nay", Burroughs "aye", Fulton "aye", McNeill "aye", Phillips "aye", and Redmon "aye". Motion carried with a 5-1 vote. Joe Mulroy to the Planning and Zoning Commission. On roll vote, Beasley "aye", Burroughs "aye", Fulton "aye", McNeill "aye", Phillips "aye", and Redmon "aye". Motion carded unanimously. Lucretia Jones to the Library Board. On roll vote, Beasley "aye", Burroughs "aye", Fulton "aye", McNeill "aye", Phillips "aye", and Redmon "aye". Motion carded unanimously. 2. The Council considered adoption of an ordinance amending Ordinance 2001-193 to amend Section 6.1 of the Rules of Procedure to increase the number of council appointees to the Agenda committee; to correct a reference to a statute in Section 4.2 of the ordinance; providing a saving clause; providing for retroactive effect; and providing an effective date. The following ordinance was considered: NO. 2001-204 AN ORDINANCE AMENDING ORDINANCE 2001-193 TO AMEND SECTION 6.1 OF THE RULES OF PROCEDURE TO INCREASE THE NUMBER OF COUNCIL APPOINTEES TO THE AGENDA COMMITTEE; TO CORRECT A REFERENCE TO A STATUTE IN SECTION 4.2 OF THE ORDINANCE; PROVIDING A SAVING CLAUSE; PROVIDING FOR RETROACTIVE EFFECT; AND PROVIDING AN EFFECTIVE DATE McNeill motioned, Redmon seconded to adopt the ordinance. Council Member Burroughs suggested a friendly amendment to change the wording to "up to two" council members on the committee so that future councils would not be required to have two additional members. Council Members McNeill and Redmon agreed with the amendment. On roll vote, Beasley "aye", Burroughs "aye", Fulton "aye", McNeill "aye", Phillips "aye", and Redmon "aye". Motion carried unanimously. Closed Meeting: Deliberations Regarding Certain Public Power Utilities Competitive Matters --- Under TEX. GOV'T. CODE Section 551.086.**Consultation with Attorney --- Under TEX. GOV'T. CODE Section 551.071. 1. Received competitive electric market information and directed questions to potential purchasers, discussed and deliberated the same. Received a confidential competitive electric utility presentation and received competitive electric market information from Staff and City's consultants; discussed and deliberated the same; considered, provided Staffwith direction, and took action as necessary, regarding future wholesale power purchase transactions and strategies including, but not limited to the replacement of electric generation resources; and the proposed sale, transfer, assignment, or other divestiture of a part of the City of Denton's electric utility system, including, without limitation: the Spencer generation facility located on Spencer Road in the City of Denton, Denton County, Texas; and the two hydroelectric facilities owned by the City located in Denton County, Texas. Conducted a consultation with the City's attorneys and its outside legal counsel in order to obtain the advice and recommendations of the City's attorneys concerning the above-referenced issues, where to discuss such issues and matters in a public meeting would conflict with the attorney's duties and professional responsibilities to their client under the Texas Disciplinary Rules of Professional Conduct. 2. There was no continuation of Closed Meeting under Sections 551.071-551.086 of the Texas Open Meetings Act. 3. There was no official action on Closed Meeting Item(s) under Sections 551.071-551.086 of the Texas Open Meetings Act. With no further business, the meeting was adjourned.
