CITY OF DENTON CITY COUNCIL MINUTES
'July 31, 2001
After determining that a quorum was present and convening in an Open Meeting, the City
Council convened in a Closed Meeting on Tuesday, July 31, 2001, at 4:45 p.m. in the City of
Denton Council Work Session Room, Denton City Hall
1. The Council considered the following in Closed Meeting:

Deliberations regarding real property - Under TEXAS GOVERNMENT CODE
Section 551.072.
Deliberated the purchase and value of real property, located in the N. H.
Meisenheimer Survey, Abstract No. 810 and being an 8.3271 acre tract
along Riney Road and adjacent to Northlakes Park, within the City and
County of Denton, Texas; which acquisition was for a public purpose.
Deliberated the exchange and value of real property and easement
interests, located in the N. Britton Survey, Abstract No. 51 and being a
0.474 acre tract and a 0.02 acre tract along the north line Hickory Creek
Road, approximately 2,500 feet west of the Hickory Creek Road/F.M.
2181 intersection, within the City and County of Denton, Texas; which
transaction is for a public purpose.

Discussed and considered strategy and status of litigation with the City's
attorneys in litigation styled City of Denton, et al v. TXU Electric

litigation with the attorneys where to discuss these matters in public would
conflict with the duty of the City's attorneys to the City Council under the
Texas Disciplinary Rules of Professional Conduct of the State Bar of

Deliberated the purchase and value of an easement in conjunction with the
Nottingham Extension Project for the relocation of a TXU gas
transmission line located at or near a point that Audra Lane intersects with

Nottingham Road in the City of Denton. Consultation with the City
Attorney regarding legal issues and matters pertaining to this project in
which the attorney owes a duty to the governmental body under the Texas
Disciplinary Rules of Professional Conduct that clearly conflict with
Chapter 551 of the Government Code.
Special Called Meeting of the City of Denton City Council on Tuesday, July 31, 2001 at 6:00
p.m. in the Council Chambers at City Hall.
1. Pledge of Allegiance
The Council and members of the Council recited the Pledge of Allegiance to the U.S. and Texas
flags.
2. The Council considered approval of the minutes of June 15-16, June 19, and June 26,
2001.
Beasley motioned, Burroughs seconded to approve the minutes as presented. On roll vote,
Beasley "aye", Burroughs "aye", Fulton "aye", McNeill "aye", Phillips "aye", Redmon "aye", and
Mayor Brock "aye". Motion carried unanimously.
PROCLAMATIONS
3. Mayor Brock presented a proclamation for National KidsDay
CITIZEN REPORTS
4. Audrey Franks regarding utility bills.
Ms. Franks stated that she had been having problems with her utility bills. She had been without
lights and water for a month. She felt that someone was misusing her utility expenses.
5. Ashley Swanson regarding animal cruelty at the pound.
Ms. Swanson stated that she had adopted a cat from the City pound and found out later that it had
a deadly infectious disease. She felt there were simple basic changes that could be done at the
pound to make the adoption of animals safer for citizens. She suggested that the City spend
more money in this area so as to improve the quality of the animals in the pound.
6. Terry Kafka regarding the billboard on Loop 288 and Colorado on the MKT Raikoad
property.
Mr. Kafka stated that he was the owner of a billboard on property that the City had. acquired for
the rails to trails program. In March 2000 he was notified that the City wanted the sign removed
from the site. Since that time he had only been able to address the issue through legal channels.
He felt that it was unproductive and time consuming to deal with the issues in this manner. He
requested time for the Council to address and consider this manner.

7. Arnold Velez regarding the billboard on Loop 288 and Colorado on the MKT Railroad
property.
Mr. Valez expressed a concern regarding the matter of the billboard and felt that they had not
been able to present their case regarding the locations of the billboards.
8. Donald Cox regarding follow-up on drag enforcement activities.
Mr. Cox felt that the City had missed the point of his earlier comments regarding a recent drug
enfomement activity. He was concerned about the condition of the children who were present
during the raid and still had emotional needs to be dealt with.

RAILROAD COMPANY FOR A SANITARY SEWER PIPELINE LOCATED AT
MILE POST 726.36, CHOCTAW SUBDIVISION, TOWN OF ARGYLE, DENTON
COUNTY, TEXAS; AUTHORIZING THE EXPENDITURE OF FUNDS THEREFORE;

PUBLIC HEARINGS
15. The Council held a public hearing and considered adoption of an ordinance of the City of
Denton, Texas designating a certain area within the city limits of Denton as Reinvestment Zone
No. IV for commercial/industrial tax abatement; establishing the boundaries of such zone;
making findings required in accordance with Chapters 311 and 312 of the Texas Tax Code;
ordaining other matters relating thereto; providing a severability clause; providing for repeal; and
providing an effective date.
Linda Ratliff, Director of Community Development, stated that this public hearing was to
establish a reinvestment zone in order to consider a tax abatement for Sally Beauty Supply.
The Mayor opened the public hearing.

reinvestment zone to allow Peterbilt to apply for a tax abatement in order to expand its office
building location on 135.

17. The Council held the second of two public hearings regarding a proposed voluntary
annexation of an approximately 72.3 acre tract of land generally located north of Loop 288, east
of Stuart Road and west of Sherman Drive in the extraterritorial jurisdiction of the City of
Denton, Texas. (A-01-0001)
Larry Reichhart, Assistant Director of Planning and Development, stated that this was the second
of the two required public hearings. The site was owned by the DISD and would be the location
of a school site along with the joint project with the City of an aquatic center.

18. The Council held a public hearing and considered adoption of an ordinance approving a
Detailed Plan for The Preserve at Pecan Creek Section C, in a Planned Development (PD-132)
zoning district. The 25.9-acre property was located on the north side of Shady Shores Road west
of Swisher Road and east of Lakeview Boulevard. Multi-family residential development was
proposed. The Planning and Zoning Commission recommended approval (5-2). (Z-01-0006)

detailed plan for the multifamily portion of the Preserve.

19. The Council held a public hearing and considered adoption of an ordinance rezoning a
2.17 acre property, commonly known as 2329 Hinkle, from Two-Family Dwelling conditioned
(2F[c]) and One-Family Dwelling conditioned (SF-10[c]) zoning districts to a Planned
Development (PD) zoning district allowing multifamily uses and approving a Concept Plan for
that purpose. A 20-unit multifamily housing development was proposed. The Planning and
Zoning Commission recommended approval (6-1) with conditions. (Z-01-0012)
Larry Reichhart, Assistant Director of Planning and Development, stated that there were 5
properties within 200 feet of the proposal resulting in a 9.53% opposition that did not require a
supermajority for this case. The Planning and Zoning Commission recommended approval with
two conditions. Residents would have to be 62 years old and older and a drainage study would
be required at the time of approval of the detailed plan that could further limit density.

Council Member Redmon left the meeting with a potential conflict of interest. He read the
following statement: "I have signed and filed with the City Secretary four affidavits under
Chapter 171 of the Local Government Code regarding four zoning cases filed by the Denton
Housing Authority. Those zoning cases are as follows: Z-01-0011 - 702, 714 and 718 Lakey
Street; Z- Wilson Street; Z-01-0009 - 1710 Morse Street; Z-01-0013 - 1340
Morse Street. My father owns real property within 200 feet of the first three zoning cases just
mentioned. Therefore, I am abstaining from any further participation in those cases as required
by Chapter 171. I am abstaining from the 1340 Morse Street zoning case so as to avoid even the
appearance or perception of impropriety since my father owns property in the area."
20. The Council held a public hearing and considered adoption of an ordinance rezoning
approximately 5.5 acres, commonly known as 1710 Morse Street, from Single-family-7 (SF-7)
zoning district to Planned Development (PD) zoning district allowing multifamily uses and
providing a Concept Plan for that purpose. Approximately 64 town home units were proposed.
The Planning and Zoning Commission recommended approval (4-3) with conditions. (Z-01-
0009)
Larry Reichhart, Assistant Director of Planning and Development, stated that the updated
opposition included 15.3% of the adjoining property owners, therefore a supermajority vote
would not be required. The Planning and Zoning Commission recommended approval with two
conditions of height restrictions at the detailed plan stage, and the two story units were restricted
to townhomes with the second floor part of first floor.
Herb Prouty, City Attorney, statcd that as this property was close to thc property on 1340 Morse
Street, the Council could combine the public heatings and hold only one public hearing.
Separate votes should be taken as one of the heatings required a supermajority vote.
Council consensus was to keep the two public heatings separate.

and providing a Concept Plan for that purpose. Elderly housing was proposed. The Planning
and Zoning Commission recommended denial (6-1). (Z-01-0010)

22. The Council held a public hearing and considered adoption of an ordinance rezoning
approximately 0.8 acres, commonly known as 702, 714, and 718 Lakey Street, from Single-
family-7 (SF-7) zoning district to Planned Development (PD) zoning district allowing
multifamily uses and providing a Concept Plan for that purpose. Approximately 2 quadraplexes
were proposed. The Planning and Zoning Commission recommended approval of 702 Lakey
with conditions and denial of 714 and 718 Lakey (6-1). (Z-01-0011)
This item was not considered due to an error in the advertising of the public heating.
23. The Council held a public hearing and considered adoption of an ordinance rezoning
approximately 3.0 acres, commonly known as 1340 Morse Street, from Single-family-7 (SF-7)
zoning district to Planned Development (PD) zoning district allowing multifamily uses and
providing a Concept Plan for that purpose. Approximately 41 town home units were proposed.
The Planning and Zoning Commission recommended approval (4-3) with conditions. (Z-01-
0023)
Larry Reichhart, Assistant Director of Planning and Development, stated that the Planning and
Zoning Commission recommended approval of a PD Concept Plan. Twenty-one property
owners were in opposition to the proposal which resulted in a 46.29% and would require a
Council supermajofity vote. Two conditions were placed on the concept plan for multi family
zoning and a limit of 10 units per acre.

waive application, processing, building permit, inspection, park dedication, park improvement
and impact fees associated with the proposed development of 500 S. Ruddell, 1340 and 1710
Morse Street, 1005-1009 Wilson Street, 710 Lakey Street and 2329 Hinkle Drive. Multi-family
housing developments were proposed. (SI-00-0006)
McNeill motioned, Burroughs seconded to postpone consideration of this item until the other
zoning cases associated with the ordinance were considered. On roll vote, Beasley "aye",

28. The Council considered adoption of an ordinance of the City of Denton, Texas amending
Chapter 20 relating to noise violations by amending Section 20-1 in its entirety; providing for a
severability clause; providing a savings clause; providing for a penalty not to exceed $500 for
violations of this ordinance; and providing for an effective date.
Mayor Pro Tern Beasley stated that she would be in favor of reducing the decibel level amount to
65 db except for outdoor music festivals and change the wording on page 6 #3 to take out "other
than" and put in "and".

unanimously.
29. The Council considered approval of a resolution of the City of Denton, Texas requesting
the Denton County Commissioners Court and the Denton County Redistricting Committee to
adopt a Denton County Redistricting Plan; and providing an effective date.
Dottie Palumbo, Assistant City Attorney, presented the resolution and map for Council
consideration.
Rick Salazar, representing LULAC, reviewed the current county maps and proposed maps by
LULA and the NAACP.
Carl Williams, representing the NAACP, expressed a concern that no City of Denton elected
official was on the redistricting committee for the County. He stated that he was in favor of the
LULCA map as it did not dilute minorities or protected classes.
Mayor Brock felt that the proposed LULCA map presented a clear distribution of voting
population.
Council Member McNeill stated that he agreed with the idea of two county commissions
representing Denton. He would like to see equal distribution of Denton's population.
