October 18, 2016 Minutes CITY OF DENTON CITY COUNCIL MINUTES October 18, 2016 After determining that a quorum was present, the City Council convened in a Work Session on Tuesday, October 18, 2016 at 12:00 p.m. in the Council Work Session Room at City Hall. PRESENT: Council Member Wazny, Council Member Briggs, Council Member Hawkins, Council Member Bagheri, and Mayor Watts. ABSENT: Mayor Pro Tem Roden; Council Member Gregory. 1. Citizen Comments on Consent Agenda Items There were no citizen comments on Consent Agenda Items. 2. Requests for clarification of agenda items listed on the agenda for October 18, 2016. Staff responded to Council requests for clarification on the following items: Council Member Briggs – Pull Item F for presentation in regular session Council Member Hawkins – Consent Agenda R. Council Member Bagheri – Pull Consent Item B for separate consideration Interim City Manager Martin indicated that Closed Meeting Items 1B and Individual Consideration Item 5A had been pulled from consideration. 3. Work Session Reports A. ID 16-1167 Receive a report, hold a discussion, and give staff direction regarding the establishment of periphery development annexation criteria in the Denton Development Code. Ron Menguita, Long Range Planning Administrator, presented information on annexation criteria and procedure. Development activity was reviewed in terms of character, land use, intensity, infrastructure, public services and certificate of convenience and necessity for water, wastewater and electricity. He reviewed the background of municipal ordinances and the Denton Development Code regulations for annexations which also included the 2009 Annexation Strategy Report and the Denton Plan 2030. He also presented information on procedures for annexation. He noted that staff would be bringing forward a code amendment to address the issues presented. Council discussed Council involvement in the process and benefits for voluntary annexation and whether voluntary annexation would allow for additional provisions for the property. Consensus was to move forward with proposed changes. B. ID 16-1297 Receive a report and hold a discussion on the review of the housing programs and other activities carried out by the Denton Housing Authority (DHA). Dr. Kathryn Stream, Chair-Denton Housing Authority, stated that there were issues surfacing in Denton regarding low income housing. She introduced Sherri McDade, CEO-Denton Housing Authority, for the presentation. City of Denton City Council Minutes October 18, 2016 Page 2 Sherri McDade stated that the purpose of her presentation was to update the Council regarding the Denton Housing Authority and provide information on the community's housing needs, low income housing tax credit and strategy to address the need for more types of housing. She reviewed the makeup of the Board and the appointment process as well as the main purpose of the program. She presented information on the waiting list, landlords, Fair Market Rents and Housing Assistance Payments. DHA revenue sources were presented. Ramon Guajardo reviewed The Veranda Project which was a workforce housing development. He discussed with Council the workforce income percentages; the rental housing demand in Denton and information on the low income housing tax credits. He asked Council to consider continuation of the low income housing tax credit program through the Denton Housing Authority. C. ID 16-1303 Receive a report and hold a discussion regarding a six-month progress report of the jointly funded Homeless Coordinator position including local efforts to provide assistance to the homeless and those at-risk of becoming homeless. Courtney Cross, Community Impact Coordinator with United Way, reviewed the Leadership Team of the Homeless Task Force and associated work groups. She presented the vision and mission of the Homelessness Leadership Team. The Workgroups included housing, data, and consumer groups. She also presented the accomplishments of the Team and the next steps in their goals and information on the Homelessness Summit that would be held on November 12th. D. ID 16-1310 Receive a report, hold a discussion, and give direction to staff and Waters & Company on the City Manager interview process. Carla Romine, Director of Human Resources, presented a proposed interview schedule for the City Manager search. Direction was needed from Council on whether to hold a community reception and where. After discussion, consensus of the Council was to open the reception to the entire community and hold it at the Patterson-Appleton Arts Center. E. ID 16-1128 Receive a report, hold a discussion and give staff direction regarding the amendment of Chapter 18, Section 18-38, of the Code of Ordinances, Use of Wireless Communication Devices While Driving. Lee Howell, Police Chief, stated that the discussion would center on a complete ban of wireless devices in motor vehicles. He reviewed the history of the issue including the presentation at the Traffic Safety Commission. Mayor Watts indicated that he was not sure about extending the regulations to all cell phone usage at this time. Council Member Hawkins stated that he was in favor of the complete ban as this was a public safety issue. He suggested setting a date far enough out so people would know that it was coming. Council Member Wazny indicated that she was in favor of the ban. City of Denton City Council Minutes October 18, 2016 Page 3 Council Member Bagheri felt that an important role was one of education and that it was already illegal to cause injury with a vehicle. Howell reviewed the number of educational tools that had been used in connection with the issue. Council Member Bagheri stated that it was already illegal to do this and suggested not doing the most restrictive layer of regulation as it could be a tool to pull anyone over. She was against the proposal. Howell questioned whether Council wanted to continue with exemption of I35. Consensus of the Council was to put it in the ordinance to see if whole Council would want to keep it included. Following the completion of the Work Session, the City Council convened in a Closed Meeting to consider the specific items listed below under the Closed Meeting section of this agenda. 1. Closed Meeting: A. ID 16-1256 Deliberations Regarding Personnel Matters - Under Texas Government Code Section 551.074. Discuss and deliberate regarding the evaluation of candidates and the appointment/employment of a City Manager. B. ID 16-1351 Deliberations Regarding Real Property - Under Texas Government Code Section 551.072; Consultation with Attorneys - Under Texas Government Code Section 551.071. Receive information from staff and discuss, deliberate, and provide staff with direction regarding the potential acquisition of real property interests located from North Lakes Substation of Denton Municipal Electric and proceeding east along Riney Rd, then turning north along Nicosia St., then east along W. Hercules Lane and terminating at the Denton North Substation of Denton Municipal Electric, in the City of Denton, Denton County, Texas; where discussion had, deliberation, and direction given, by the Denton City Council in an open meeting would have a detrimental effect on the position of the governmental body in negotiations with a third party. Consultation with the City’s attorneys regarding legal issues associated with the acquisition of the real property interests described above; discussion of these legal matters in an open meeting would conflict with the duty of the City’s attorneys to the City of Denton and the Denton City Council under the Texas Disciplinary Rules of Professional Conduct of the State Bar of Texas, or would jeopardize the City’s legal position in any administrative proceeding or potential litigation. \[North Lakes to Denton North TM Line\] This item was not considered. C. ID 16-1240 Consultation with Attorneys - Under Texas Government Code, Section 551.071. City of Denton City Council Minutes October 18, 2016 Page 4 Consultation, discussion, deliberation and receipt of information from the City’s attorneys involving legal matters regarding guidelines for determining when an annexation study should be considered and the criteria for annexation, and to provide the City’s attorneys with direction, where a public discussion of these legal matters would clearly conflict with the duty of the City’s attorneys to the City of Denton and the Denton City Council under the Texas Disciplinary Rules of Professional Conduct of the State Bar of Texas. Council Member Roden arrived at the meeting. D. ID 16-1301 Deliberations regarding Economic Development Negotiations - Under Texas Government Code Section 551.087. Receive a report and hold a discussion regarding a proposed economic development program grant agreement between the City of Denton and Sally Beauty Supply LLC. This discussion shall include commercial and financial information the City Council has received from Sally Beauty Supply LLC, a business prospect which the City Council seeks to have locate, stay, or expand in or near the territory of the city, and with which the City Council is conducting economic development negotiations; deliberate the economic development program grant agreement between the City of Denton and Sally Beauty Supply LLC. Council Member Briggs left the meeting with a conflict of interest. E. ID 16-1312 Deliberations Regarding Real Property - Under Texas Government Code Section 551.072; Consultation with Attorneys - Under Texas Government Code Section 551.071. Receive information from staff and discuss, deliberate, and provide staff with direction regarding the potential acquisition of real property interests located in Lot 1, Block 2 of the Municipal Utility Addition as shown by the plat thereof recorded in Cabinet G Page 346 of the P.R.D.C.T., in the City of Denton, Denton County, Texas; where discussion had, deliberation, and direction given, by the Denton City Council in an open meeting would have a detrimental effect on the position of the governmental body in negotiations with a third party. Consultation with the City’s attorneys regarding legal issues associated with the acquisition of the real property interests described above; discussion of these legal matters in an open meeting would conflict with the duty of the City’s attorneys to the City of Denton and the Denton City Council under the Texas Disciplinary Rules of Professional Conduct of the State Bar of Texas, or would jeopardize the City’s legal position in any administrative proceeding or potential litigation. \[Brinker Substation\] Council Member Briggs returned to the meeting. Consult with City’s Attorneys regarding development review fees and schedules, as it concerns legal issues associated with that item where a public discussion of this legal matter would conflict with the duty of the City’s attorneys under the Texas Disciplinary Rules of Professional Conduct of the State Bar of Texas. ID 16-1343 Deliberations regarding consultation with the City Attorney - Under Texas Government Code Section 551.071, Deliberations regarding Economic Development Negotiations - Under Texas Government Code Section 551.087. Receive a report and hold a discussion regarding legal and economic development issues regarding a proposed economic development incentive agreement for West Gate Business Park (WGBP Investments, LTD). This discussion shall include commercial and financial information the City Council has received from West Gate Business Park which the City Council seeks to have locate, stay, or expand in or near the territory of the city, and with which the City Council is conducting economic development negotiations; including the offer of financial or other incentive; consultation with attorneys regarding legal aspects of proposed economic incentive agreements where the duty of the attorney to the governmental body under the Texas Disciplinary Rules of Professional Conduct of the State Bar of Texas clearly conflicts with the provisions of the Texas Open Meetings Act, Chapter 551 of the Texas Government Code. Regular Meeting of the City of Denton City Council at 6:30 p.m. in the Council Chambers at City Hall. 1.PLEDGE OF ALLEGIANCE The Council and members of the audience recited the Pledge of Allegiance to the U.S. and Texas flags. 2.PROCLAMATIONS/PRESENTATIONS A. ID 16-1234 Fire Prevention Month The Mayor presented the proclamation for Fire Prevention Month. 3. PRESENTATION FROM MEMBERS OF THE PUBLIC A. Review of procedures for addressing the City Council. B. Receive Scheduled Citizen Reports from Members of the Public. 1. ID 16-1277 Willie Hudspeth regarding the City Charter and Closed Sessions. Mr. Hudspeth spoke regarding the Closed Session and the number of people who attended those sessions. He felt too many staff members attended the Closed Sessions. He also spoke against the Work Sessions and the lack of citizen comment at those sessions. C. Additional Citizen Reports 1. Paul Meltzer spoke of the progress report of the Homeless Coordinator. He asked that the Coordinator target timing for solving the problem and target timing for plans to meet that timing. City of Denton City Council Minutes October 18, 2016 Page 6 2. Chris Martin, Denton County Veterans Homeless Coalition, presented accomplishments of the VA and United Way in terms of helping the homeless veterans. He thanked the Council for its efforts to help with the homeless. 4.CONSENT AGENDA Council Member Hawkins motioned, Council Member Wazny seconded to approve the Consent Agenda and accompanying ordinances and resolutions with the exception of Items B and F which would be pulled for separate consideration. ID 16-712 Consider approval of the New Cingular Wireless PCS, LLC (Cingular Wireless) third lease amendment for property that is located at the McKenna Park Tower in the City of Denton, Denton County, Texas for an additional thirty (30) years term. Ordinance No. 2016-315 C. ID 16-1244 Consider adoption of an ordinance of the City of Denton authorizing the City Manager, or his designee, to execute on behalf of the City of Denton an acceptance of an offer from the Texas Department of Transportation relating to a grant for Routine Airport Maintenance Program; authorizing the City Manager to expend funds provided for in the grant program; and declaring an effective date (TxDOT CSJ No.: M1718DNTO). The Airport Advisory Board recommends approval (5-0). Ordinance No. 2016-316 D. ID 16-1250 Consider adoption of an ordinance of the City of Denton, Texas authorizing the City Manager, or his designee, to enter into an Interlocal Agreement with the Denco Area 9-1-1 District (Denco) for providing a 911 database and related services for the benefit of the citizens of the City of Denton and providing an effective date. Ordinance No. 2016-317 E. ID 16-1259 Consider adoption of an ordinance approving a City sponsorship in an amount not to exceed $1,400 of in-kind services and resources for the Backing the Blue-Denton, to be held at the Civic Center at 321 E. McKinney Street, November 19, 2016; and providing an effective date. Ordinance No. 2016-319 G. ID 16-1288 Consider adoption of an ordinance of the City of Denton authorizing the City Manager or his designee to execute a contract through the State of Texas for the purchase of temporary labor services for various City departments as awarded by the State of Texas Contract 962-M3; and providing an effective date (File 5215-Purchase of Temporary Labor Services awarded to Texas Industries for the Blind and Handicapped (TIBH Industries, Inc. in the not to exceed amount of $300,000). ID 16-1289 Consider adoption of an ordinance awarding a contract for the purchase of security products and continued vendor support of the Palo Alto Firewall software as awarded by the State of Texas Department of Information Resources (DIR) through the Go DIRect Program, Contract Number DIR-TSO-2700; providing for the expenditure of funds therefor and providing an effective date. (File 4970-awarded to Solid Border, Inc. in the three (3) year not-to-exceed amount of $309,000). Ordinance No. 2016-321 I. ID 16-1290 Consider adoption of an ordinance authorizing the City Manager to execute a professional services agreement for survey services on a work order basis for various City of Denton departments; providing for the expenditure of funds therefor; and providing an effective date (File 6189-awarded to Teague Nall and Perkins, Inc. in an amount not-to-exceed $500,000). Ordinance No. 2016-322 J. ID 16-1291 Consider adoption of an ordinance of the City of Denton, Texas providing for, authorizing, and approving three (3) year software maintenance for continued vendor support of the Denton Municipal Electric (DME) ArcFM Solution and associated software modules along with new hardware and software upgrades, which is available from only one source and in accordance with Chapter 252.022 of the Texas Local Government Code such purchases are exempt from the requirements of competitive bidding; and providing an effective date (File 5770 awarded to Telvent USA, LLC for a three (3) year not-to-exceed amount of $129,401). Ordinance No. 2016-325 M. Ordinance No. 2016-326 N. ID 16-1296 Consider adoption of an ordinance of the City of Denton authorizing the City Manager, or his designee, to execute on behalf of the City of Denton a lease of office space located in the North Lakes Annex Building, 1117 Riney Road between the City of Denton and Denton Explorium; and providing for an effective date. Ordinance No. 2016-327 O. ID 16-1298 Consider adoption of an ordinance of the City of Denton, Texas providing for, authorizing, and approving the expenditure of funds for the purchase of traffic signal hardware including traffic signal controllers, video detection systems, battery backup systems, and network switches, for the City of Denton Traffic Department, which is available from only one source and in accordance with Chapter 252.022 of the Texas Local Government Code such purchases are exempt from the requirements of competitive bidding; and providing an effective date (File 6248 awarded to Paradigm Traffic Systems in the annual estimated amount of $290,000 for a three (3) year not to exceed amount of $870,000). Ordinance No. 2016-328 P. ID 16-1299 Consider adoption of an ordinance authorizing the City Manager to execute a professional services agreement for financial planning and rate modeling services for Denton Municipal Electric and Water/Wastewater Utilities; providing for the expenditure of funds therefor; and providing an effective date (File 6229-awarded to NewGen Strategies & Solutions, LLC in an amount not-to-exceed $215,000). The Public Utilities Board recommends approval (6-0). Ordinance No. 2016-329 Q. ID 16-1300 Consider adoption of an ordinance of the City of Denton, Texas authorizing the City Manager to execute a Second Amendment to a Professional Services Agreement by and between the City of Denton, Texas and Nelson + Morgan Architects, Inc. for architectural, structural, mechanical, and engineering design services to support the design of the new City of Denton Fleet Services Annex Facility to be located at 1527 South Mayhill Road; providing an effective date (File No. 5497 in the additional amount not-to-exceed $158,035.00; aggregating a total not-to- exceed $202,948.09). The Public Utilities Board recommends approval (6-0). Ordinance No. 2016-330 R. ID 16-1353 Consider adoption of an ordinance terminating an award for a public works contract for the construction of hangars at Denton Enterprise Airport; and providing an effective date of the termination. (RFP 5753- previously awarded to Mag City of Denton City Council Minutes October 18, 2016 Page 9 Construction Services, LLC in the not-to-exceed amount of $617,801.65 on April 21, 2015). Ordinance No. 2016-314 B. ID 16-1165 Consider adoption of an ordinance accepting competitive bids and awarding a public works contract for the construction of the Northwest Denton Park Loop Trail Project for the City of Denton Parks and Recreation Department; providing for the expenditure of funds therefor; and providing an effective date (IFB 6131C-awarded to North Rock Construction LLC in the not-to-exceed amount of $1,723,855.91). Jim Mays, Superintendent of Park Planning, presented an update on the issue. He reviewed the background of the proposal; an overview of the trail; and the construction company that was awarded the bid. Willie Hudspeth presented a Speaker Card and asked questions of staff. He did not have a formal comment. Council Member Briggs motioned, Mayor Pro Tem Roden seconded to adopt the ordinance. Motion carried unanimously. Ordinance No. 2016-318 F. ID 16-1287 Consider adoption of an ordinance of the City of Denton, Texas to declare the intent to reimburse capital program expenditures of the Electric Utility ($65,000,000), Solid Waste ($23,580,000), and General Government ($12,335,000) with Tax Preferred Obligations (Certificates of Obligation and General Obligation Bonds) with an aggregate maximum principal amount equal to $100,915,000; providing an effective date. Tony Puente, Assistant Director of Finance, presented an overview of the item, the purpose being to meet State requirements to spend funds before the bonds were issued. A long lead time was needed so the process was started before the issuing of the bonds. This was only a portion of the CIP. Council Member Briggs asked if there needed to be a separate vote on the GO bonds and COs. Puente stated that the only intent here was to reimburse the City when the bonds were issued. It gave authority to expend the funds when needed. Council Member Bagheri asked if this debt was DME debt or City debt. Puente stated that it was coming out of the Enterprise Funds. Mayor Pro Roden stated that this was part of the CIP budget voted on when Council passed the budget. Motion carried unanimously. 5.ITEMS FOR INDIVIDUAL CONSIDERATION - CONSIDERATION OF THE USE OF EMINENT DOMAIN TO CONDEMN REAL PROPERTY INTERESTS A. ID 16-1271 Consider adoption of an ordinance finding that a public use and necessity exists to acquire fee simple title to a 1.253 acre tract of land situated in the J.S Collard Survey, Abstract No. 297, City of Denton, Denton County, Texas, and of the Real Property Records of Denton County, Texas ("Property Interests"), for the public use of, expansion, construction, maintenance, and operation of an electric transmission lines, ancillary facilities and structures; authorizing the City Manager, acting City Manager, or his designee, to make initial and final offers to execute a contract of sale, between the City of Denton, Texas ("City"), as buyer, and Pensco Trust Company Custodian FBO Randall D. Smith Roth IRA, Bonnie Brae Malone County, Inc., Trustee of the COTI Property Trust, and Edward F. Wolski, et. al. ("Owner"), as seller, to acquire fee title to the Property Interests for the total purchase price of $166,859.00, and other consideration; authorizing the filing of eminent domain proceedings to acquire the Property Interests if the final offer is not accepted; authorizing the expenditure of funds; and providing an effective date. \[North Lakes to Denton North TM Line\] This item was not considered. 6.ITEMS FOR INDIVIDUAL CONSIDERATION A. ID 16-1354 Consider appointments to a Charter Review Committee. The following individuals were appointed to the Committee: Mayor Watts – Monica Glen and Joe Mulroy Mayor Pro Tem Roden – Jim Alexander, Colette Johnson and Stu Moorhead Council Member Bagheri – David Zoltner and Kyle Eaton Council Member Briggs – Erin Clegg and Annetta Ramsay Council Member Hawkins – Billy Cheek Council Member Wazny – Patrice Lyke, Michael Upshaw and Steve Sullivan Willie Hudspeth spoke about the nature of the way the Council had to appoint the members. Z16-0017a Hold a public hearing and consider adoption of an ordinance of the City of Denton, Texas regarding a rezoning from a Downtown Residential 1 (DR-1) District to a Downtown Residential 2 (DR-2) District on approximately 0.87 acres, generally located on the east side of McCormick Street, approximately 100 feet south of W. Eagle Drive. The Planning and Zoning Commission recommends approval 6- 0. (Z16-0017) Hayley Zagurski, Assistant Planner, presented the details of the item. She noted that the request was for a rezoning of the property from DR -1 to DR -2; presented the location of the property; the compatibility with the Denton Plan; considerations for approval; and public notification. The Planning and Zoning Commission recommended approval as well as staff. The Mayor opened the public hearing. Willie Hudspeth did not speak to the issue but spoke on the Charter Review Committee. Z16-0024a Hold a public hearing and consider adoption of an ordinance of the City of Denton, Texas, regarding a rezoning request to provide an initial zoning district designation of Regional Center Commercial Neighborhood (RCC-N) District to an approximately 0.375 acre property generally located on the north side of Crawford Road, approximately 675 east of the I-35W Crawford Road on-ramp. The Planning and Zoning Commission recommends approval (7-0). Julie Wyatt, Senior Planner, reviewed the current zoning of the property, future land use; the preferred growth concept; considerations for approval; and public notification. The Planning and Zoning Commission recommended approval as did staff. The Mayor opened the public hearing. Willie Hudspeth spoke again on the Charter Committee membership instead of the public hearing item. The Mayor closed the public hearing. Under Section 551.042 of the Texas Open Meetings Act, respond to inquiries from the City Council or the public with specific factual information or recitation of policy, or accept a proposal to place the matter on the agenda for an upcoming meeting AND Under Section 551.0415 of the Texas Open Meetings Act, provide reports about items of community interest regarding which no action will be taken, to include: expressions of thanks, congratulations, or condolence; information regarding holiday schedules; an honorary or salutary recognition of a public official, public employee, or other citizen; a reminder about an upcoming event organized or sponsored by the governing body; information regarding a social, ceremonial, or community event organized or sponsored by an entity other than the governing body that was attended or is scheduled to be attended by a member of the governing body or an official or employee of the municipality; or an announcement involving an imminent threat to the public health and safety of people in the municipality that has arisen after the posting of the agenda. Council Member Briggs requested a Work Session on the CAPR committee and the automatic renewal of the City Attorney contract. The discussion should include the renewal scope of the CAPR committee; determine the Committee process improvement; whether the entire Council should have a voice in the renewal of contracts; and the reappointment of members of committee. Council Member Briggs requested an update on the Community Market. Council Member Briggs requested a report on drones and policy for those. Council Member Briggs asked for a review of severance package and associated guidelines. Council Member Wazny asked for a discussion on a moratorium on SRO building. Council Member Bagheri asked for a discussion on the resolution that enacted the ethics policy and clarification of the policy, procedures, and scope of the actual application of that resolution. Mayor Watts questioned if the new markings on Hickory and Carroll were safe for bike lanes. Mayor Watts asked for a report on speeding on Woodland Street and the possibility of traffic calming devices to slow traffic down. B. Possible Continuation of Closed Meeting topics, above posted.
