2012-02-28 Council Airport Committee MinutesCity Council Airport Committee February 28, 2012 Approved Meeting Mfnutes After determining that a quorum is present, the Airport Committee of the I7enton City Council convened in a regular meeting on Tuesday, February 28, 2012, at 10:37 a.rn. in the City Hall Conference Room, 215 E. McKinney Street, Denton, Texas. P SENT: Council Member and Chair, Jim Engelbrecht; Mayar Pra Tem Pete Kamp, and Council Member Chris Watts STAFF P SENT: Jan Foriune, Assistant City Manager; Bryan Langley, Chief Financial Officer; John Knight, Deputy City Attorney; Mark Nelson, Director of Transpartation; Quentin Hix, Airport Manager; and Theresa Jaworski, Recording Secretary. 1) Consider approval of minutes from the meeting held on February 14, 2012. Council Member Chris Watts rnotioned ta approve the minutes followed by a second by Mayor Pra Tem Pete Kamp. Motion passed unanimausly. 2} Receive reports by citizens and other interested persons. With no reports by citizens or other interested persons, Council Member Jim Engelbrecht addressed Item Three. Cauncil Member Engelbrecht asked the Committee if Agenda Items Three through Six, being similar and having the exact terms and conditions, cauld be heard and considered, then followed by a Committee vote. Mayor Pro Tem Kamp and Council Member Watts agreed. John Knight, Deputy City Attorney, recammended that all items be heard at one time but voted on separately. Quentin Hix, Airport Manager, described the size, structure, position, and conditions of the properties, as well as the requirements set aut in the praposed leases. All faur leases have expired and the tenants are currently leasing on a month-to-month basis. All four tenants have agreed and signed the leases. Staff recarnrnends appraval of the new leases. Follawing a discussion of various requirements set out in the proposed leases, Council Member Watts made a motion to recommend Council's approval of Agenda Item Three, an ordinance authorizing the City Manager, or his designee, to execute on behalf of the City of Dentan an Airport Lease Agreement between the City af Denton, Texas and Bill Davidsan for the property located at 4824 Lackheed, Denton Municipal Airport. Mayor Pro Tem Kamp seconded the motion. Matian carried unanimously. Mayar Pro Tem Kamp made a rnotion to recommend Council's approval of Agenda Item Four, an ordinance authorizing the City Manager, or his designee, to execute on behalf af the City of Denton an Airport Lease Agreement between the City of Denton, Texas and Hangars Plus, L.L.C. for the property located at 4846 Lockheed, Denton Municipal Airport. Council Mernber Watts seconded the motion. Motion carried unanimously. Discuss, deliberate, and receive information from staff and provide staff with direction pertaining ta the lease or value of real property located at 4600 Taxiway 66YT999 a tract of land being approximately 30,000 square feet or 0.689 acres, in the 11 Williarn Neil Survey, Abstract No. 970 in the City of Denton, Denton County, Texas and being a part of a tract of land described in the Deed to the City of Denton recorded in Volume 305, Page 216 of the Deed Records af Denton County, Texas where the deliberation of same in an open meeting would have a detrimental effect on the position of the gavemrnental body in negotiations with a third person. Consultation with the City's attorneys regarding legal issues associated with lease of the tract referenced above where a public discussion of these legal matters would conflict with the duty of the City's attorneys ta the Airpart Committee of the Denton City Council under the Texas Rules of Disciplinary Conduct af the State Bar of Texas, or would jeopardize the City's legal pasition in any administrative proceedings or poteniial litigation. 2. Discuss, deliberate, and receive information from staff and provide staff with direction pertaining to the lease or value of real property located at 4703 Spartan Drive, a tract of land being approximately 16,200 square feet or 0.372 acres, in the T. Toby Survey, Abstract No. 970, City of Denton, Denton Couniy, Texas and being a part of Lot 1, Block 1 of Sautheast Airport Addition, an additian to the City of Denton, Denton County, Texas, according to the plat thereof recorded in Cabinet G, Page 295, Plat Records of Denton County, Texas where the deliberation of same in an open meeting would have a detrimental effect on the position of the govemmental body in negotiations with a third person. Receive a report, hold a discussfon and provide a recommendation regarding an ordinance authorizing the City Manager, or his designee, to execute on behalf of the Cfty of Denton a Third Amendment to an Airport Lease Agreement approved by Ordinance 2009- 018 dated January 6, 2009 and amended by Ordinance 2009-323 dated December 15, 2009 and amended by Ordinance 2010-193 dated August 17, 2010 between the City of Denton, Texas and Sykes-Vaughn Investments, LLC, which includes among other provisions the right to sell avfation fuel to the public for a fnel flowage fee and to provfde commercfal hangar and tfe-down servfce at the Denton Mnnicipal Airport for real property located at 4600 Taxiway "H"; and, providing an effective date. Receive a report, hold a discussfon and provide a recommendatfon regarding an ordinance authorizing the Cfty Manager, or hfs desfgnee, to execute on behalf of the Cfiy of Denton a Fourth Amendment to an Airport Lease Agreement approved by Ordinance 2009-018 dated January 6, 2009 and amended by Ordrnance 2009-323 dated December 15, 2009 and amended by Ordinance 2010-193 dated August 17, 2010 and amended by Ordinance dated March 6, 2012 between the Cfty of Denton, Texas and Sykes-Vaughn Investments, LLC, which fncludes among other provisions the right to sell aviation fuel to the public for a fuel flowage fee and to provide commercial hangar and tie-down service at the Denton Municipal Airport for real property located at 4703 Spartan Drive; and, providfng an effective date. Hix explained Item Seven as the 30,000 square foot ramp to be installed by the City of Denton and leased to Sykes-Vaughan Investtnents, LLC for use as an aircraft ramp. Council Member Engelbrecht requested a report for future Committee discussian on Airport parking. The report should include the status of parking with the additional parking spaces provided in the lease considered today. The repart should also indicate whether the additional parking will be sufficient or if there will be a need for future parking irnprovernents.
