2020-01-28 Council Airport Committee Minutes City Council Airport Committee Tuesday,January 28, 2020 Meeting Minutes After determining that a quorum is present, the Council Airport Committee of the Denton City Council convened in a Closed Meeting on Tuesday,January 28,2020,at 9:03 a.m. in the City Hall, City Hall Conference Room at 215 E. McKinney St., Denton, Texas at which the following item will be considered: PRESENT: Council Member Jesse Davis and Council Member Paul Meltzer. REGRETS: Council Member John Ryan. STAFF PRESENT: Scott Gray, Airport Manager, Trey Lansford, Deputy City Attorney, Chase Patterson, Airport Operations/Maintenance Supervisor, and Leanne Hood, Recording Secretary. OTHERS PRESENT: Mike Sykes, US Aviation Group, and Scott Sykes,US Aviation Group. Gray brought the meeting to order and requested nominations for an acting Chair in the absence of Chair Ryan. Council Member Davis nominated Council Member Meltzer as acting Chair, Council Member Meltzer seconded. The motion was approved with a vote of 2-0. 1. REGULAR MEETING A. CAC20-002—Consider approval of the meeting minutes of August 27, 2019. Council Member Davis made a motion to approve the minutes as presented. Council Member Meltzer seconded the motion. The motion was approved with a vote of 2-0. B. CAC20-001 —Receive a report, hold a discussion and consider a recommendation to City Council to adopt the Proposed Airport Guiding Documents, including updating Chapter 3 of the Code of Ordinances and creation of Airport Rules and Regulations and Airport Minimum Operating Standards. Gray presents the Airport Guiding Documents background, overview, timeline, and public process. Gray discusses the comments received and changes made for Chapter 3, Rules and Regulations, and Minimum Operating Standards as a result of the public process. Council Member Davis inquires for examples and reasons for previous issues with Rules and Regulations. Gray responds with an experimental aircraft example and how the need for fire safety was needed and meeting the FAA new guidelines. Gray discusses the proposed Chapter 3 updates, including rulemaking authority, Airport business permits, enforcement options and procedures. City Council Airport Committee Minutes January 28,2020 Page 2 Council Member Meltzer inquires about the fees and the hierarchy of which they are approved. Trey Lansford responds that any change made to the Rates and Fees schedule must go through City Council for approval. Council Member Davis states that he likes the role of the Airport Advisory Board and the new authority it will give them. Council Member Meltzer opens the presentation to the public members present. Mike Sykes speaks to the support from their Airport business and opposes the FBO and Land Usage minimum standards due to vagueness. Gray responds that the comment made is not relevant to Chapter 3 and a response will be discussed during in the Minimum Operating Standards presentation. Gray discusses the proposed Rules and Regulations updates including updated definitions and areas where changes occurred based on comments. Gray discusses the proposed Minimum Operating Standards including application process, insurance, fixed base operators, and other businesses. Gray addresses the issue pertaining to Mr. Sykes's opposition. Council Member Meltzer declares that the issue being addressed is due to an opposition in proposed language and the meeting is not being used for hearing regarding Mr. Sykes's situation. Council Member Meltzer and Council Member Davis express the need for flexibility for the Airport to make decisions in the future and agree that the proposed verbiage in the Minimum Operating Standards is appropriate and should not be changed base on Mr. Sykes opposition. Gray discusses the recommendations given to the Council Airport Committee. Council Member Davis made a motion to recommend option 1, recommend to the City Council the adoption of the proposed ordinance adopting the Airport Guiding Documents as an action item for individual consideration at the net available Council meeting.Council Member Meltzer seconded the motion. The motion was approved with a vote of 2-0. 1.
