February 19, 2021CITY OF DENTON CITY COUNCIL MINUTES February 19, 2021 Pursuant to the provisions of Chapter 551, V. T.C. A., Government Code, notice was given in advance of this Emergency Meeting consisting of a Closed Meeting and Work Session under the requirements ofSection 551.045 ofthe Texas Open Meetings Act on the grounds that an emergency and urgent public necessity exists as set forth in Governor Abbott ’s February 12, 2021 Declaration of Disaster, President Biden’s February 14, 2021 Emergency Declaration for Texas, and Mayor Hudspeth’s Declaration of Emergency for Denton; namely the severe snow storm, freezing temperatures, and utility service outages. After determining that a quorum was present and pursuant to the provisions of Chapter 551, V. T.C.A., Government Code, the City Council convened in an Emergency Meeting on Friday, February 19, 2021, at 9:01 a.m. in the Council Work Session Room at City Hall, 215 E. McKinney Street, Denton, Texas. CLOSED MEETING PRESENT: Mayor Gerard Hudspeth, Mayor Pro Tem Jesse Davis and Council Members Birdia Johnson, Connie Baker, John Ryan, Deb Armintor, and Paul Meltzer ABSENT: None Also present were City Manager Todd Hileman and City Attorney Aaron Leal. Note: Mayor Gerard Hudspeth, Mayor Pro Tem Jesse Davis and Council Members Birdia Johnson, Connie Baker, John Ryan, Deb Armintor, and Paul Meltzer participated in the work session, and special meeting via video/teleconference under the provisions allowed by the Texas Government Code Section 551.127. 1. The City Council convened into a Closed Meeting at 9:02 a.m. consistent with Chapter 551 of the Texas Government Code, as amended, or as otherwise allowed by law, as follows. A ID 21-346 Deliberation Regarding Certain Public Power Utilities Competitive Matters Under Texas Government Code Section 551.086; Consultation with Attorneys - Under Texas Government Code Section 551.071 Discuss and deliberate the City’s ability to purchase and sell power; receive a presentation from staff regarding financial matters and risk management information pertaining to the purchase and sale of energy during a declared state and local disaster in response to an extreme weather event and utility service outages; consultation with City’s attorneys regarding legal issues associated with pricing information, risk management, and contracts where discussions of these legal matters in an open meeting would conflict with the duty of the City’s attorney’s to the City of Denton and the Denton City Council under Texas Disciplinary Rules of Professional Conduct of the State Bar of Texas DELIBERATED City of Denton City Council Minutes February 19. 2021 Page 2 The item related to Work Session Item 1.A (ID 21-345), scheduled for discussion at the Special Called Meeting to follow later in the day. The closed meeting started at 9:03 a.m. and ended at 9:53 a.m, No votes or actions were taken during the closed meeting. WORK SESSION After determining that a quorum was present, the City Council of the City of Denton, Texas convened in Special Called/Emergency Meeting/Work Session on Friday, February 9, 2021, at 9:55 a.m. in the Council Work Session Room at City Hall, 215 E. McKinney Street, Denton, Texas. PRESENT: Mayor Gerard Hudspeth, Mayor Pro Tem Jesse Davis and Council Members Birdia Johnson, Connie Baker, John Ryan, Deb Armintor, and Paul Meltzer ABSENT: None Also present were City Manager Todd Hileman and City Attorney Aaron Leal. There was no registration process for public participation in the posted agenda as the meeting was a work session. 1. Work Session Reports A. ID 21-345 Receive a report, hold a discussion, and give staff direction on funding the purchase and sale of electricity during a declaration of state and local disaster in response to an extreme weather event and utility service outages. The item related to Closed Meeting Item 1.A (ID 21-346) pursuant to Texas Government Code Sections 551.086 (Certain Public Power Utilities Competitive Matters) and 551.071 (Consultation with Attorney) deliberated earlier in the day. The item was presented and discussion followed.
