Zoning Change Checklist - Criteria 5.24.21 Development Services 401 N Elm St., Denton, TX 76201  (940) 349-8541 Updated 07/24/20 Zoning Change Checklist 1 Zoning Change Checklist Items to be submitted: ☐ 1.1 Associated Fee(s): as listed on the Development Review Fee Schedule. ☐ 1.2 Project Narrative: Written proposal for the project, including the purpose and an explanation detailing how the proposal meets the General Criteria for approval in DDC Section 2.4.5E and the Specific Criteria for approval in DDC Section 2.7.2D. See “Approval Criteria” below. ☐ 1.3 Legal Description: Provide in Word format and include either: 1) a subdivision reference or 2) a metes and bounds description of the property prepared and sealed by a registered land surveyor. ☐ 1.4 Concept Plan: Non-binding document. Should include map legend, north arrow, labelled site access streets, general layout of proposed development, location and type of proposed uses, and preserved trees and Environmentally Sensitive Areas (if any). ☐ 1.5 Location Map ☐ 1.6 Trip Generation Analysis: Should be prepared based on either: 1) the proposed use or 2) on the most intense use possible in the requested new zoning district. Should be prepared by a licensed Civil Engineer using the most recent Institute of Transportation Engineers (ITE) manual. Results must include the peak hour and twenty-four (24) hour trip generation data. ☐ 1.6.1 Traffic Impact Analysis: If the traffic generation analysis shows that the site will produce 1,000 or more trips in a day, or 100 or more trips in an hour, or if Planning staff identifies that the proposed project has the potential to have significant specific negative offsite traffic impacts, a Transportation Impact Analysis (TIA) will be required to be submitted and approved prior to scheduling the Zoning case for a public hearing. ☐ 1.7 Owner Authorization Letter signed by all property owners ☐ 1.8 All documents, with the exception of the Legal Description, are required to be PDF files. Each sheet will be a single item and will be uploaded into ProjectDox. Approval Criteria: Pursuant to Section 2.7.3.D.1 of the Denton Development Code, applications may be approved when the following general and specific approval criteria are met: 1. General Criteria: a. The proposed development is consistent with the terms and conditions of any prior land use approval, plan, development agreement, or plat approval that is in effect Development Services 401 N Elm St., Denton, TX 76201  (940) 349-8541 Updated 07/24/20 Zoning Change Checklist 2 and not proposed to be changed. This includes an approved phasing plan for development and installation of public improvements and amenities. b. The proposed development is consistent with the Comprehensive Plan and any applicable plans. i. If development does not match the future land use designation in the Comprehensive Plan, an application may still be approved if it is determined by the approving body to meet the overall goals of the Comprehensive Plan. c. The proposed development shall comply with all applicable standards in this DDC, unless the standard is to be lawfully modified. d. The proposed development shall be consistent with any adopted interlocal and applicable development agreements, and comply with the terms and conditions of any such agreements incorporated by reference into this DDC. e. The proposed development should be designed to minimize negative environmental impacts and should not cause significant adverse impacts on the natural environment. f. The proposed development should not cause significant adverse impacts on surrounding properties. g. The proposed development should not result in significant adverse fiscal impacts on the city. h. As applicable, the proposed development shall comply with federal, state, county, service district, city and other regulatory authority standards, and design/construction specifications for roads, access, drainage, water, sewer, schools, emergency/fire protection, and similar standards. i. Adequate road capacity shall exist to serve the uses permitted under the proposed development, and the proposed uses shall be designed to ensure safe ingress and egress onto the site and safe road conditions around the site, including for emergency services. j. Adequate public service and facility capacity shall exist to accommodate uses permitted under the proposed development at the time the needs or demands arise, while maintaining adequate levels of service to existing development. 2. Specific Criteria for Zoning Changes: a. The proposed rezoning is consistent with the Comprehensive Plan; b. The proposed rezoning is consistent with relevant Small Area Plan(s); c. The proposed rezoning is consistent with the purpose statement of the proposed zoning district, as provided in Subchapter 3: Zoning Districts; d. There have been significant changes in the area to warrant a zoning change; e. The intensity of development in the new zoning district is not expected to create significantly adverse impacts to surrounding properties or the neighborhood; and f. There was an error in establishing the current zoning;
