June 7, 2021 MinutesCITY OF DENTON CITY COUNCIL MINUTES June 7, 2021 After determining that a quorum was present, the City Council of the City of Denton, Texas convened in a Work Session on Monday, June 7, 2021, at 1 1:30 a.m. in the Council Work Session Room at City Hall, 215 E. McKinney Street, Denton, Texas. PRESENT:Mayor Gerard Hudspeth, Mayor Pro Tem Paul Meltzer and Council Members Vicki Byrd, Brian Beck, Jesse Davis, Alison Maguire, and Deb Armintor ABSENT: None Also present were Interim City Manager Sara Hensley and Interim City Attorney Catherine Clifton Note: Mayor Gerard Hudspeth, Mayor Pro Tem Paul Meltzer, and Council Members Vicki Byrd, Brian Beck, Jesse Davis, Alison Maguire, and Deb Armintor participated in the work session, closed meeting and meeting via video/teleconference under the provisions allowed by the Texas Government Code Section 551.127 The posted agenda noted the registration process for public participation at this virtual meeting. However, there were no online registrations or call ins on any items on the agenda. WORK SESSION 1.Requests for clarification of agenda items listed on this agenda. • Clarification was requested on the following items: o None 2. Work Session Reports A. ID 21-855 Receive a report, hold a discussion, and give staff direction regarding funding for a new Economic Development Catalyst Fund. The item was presented and discussion followed. Following discussion, City Council consensus was for staff to provide the following at a future work session: • Timeline for adding the item to the ballot (future election); • Funding mechanism; and • General timeline regarding the State’s decision and potential funding impacts to the City City of Denton City Council Minutes June 7, 2021 Page 2 B. ID 21-1084 Receive a report, hold a discussion, and give staff direction on filling the City Attorney position and the recruitment process. The item was presented and discussion followed. Following discussion, City Council consensus was to select GovHR firm as the recruitment firm for the City Attorney search. C.ID 21-1065 Receive a report, hold a discussion and give staff direction regarding FY 2021 22 departmental budget presentations for: Municipal Judge/Municipal Court - Presented Internal Audit - Presented Economic Development - Not Presented - Moved to June 15, 2021 The item was presented and discussion followed. The meeting was recessed at 12:52 p.m. in order to convene the Joint Meeting with the Denton Housing Authority Board of Commissioners scheduled to start at 1 :00 p.m. At 2:54 p.m., the work session was reconvened to continue with presentation of the item. Following discussion, there was no direction or modifications to the proposted budgets as presented for the noted departments. The work session ended at 3:16 p.m. CLOSED MEETING 1.The City Council convened into a Closed Meeting at 3:16 p.m. consistent with Chapter 551 of the Texas Government Code, as amended, or as otherwise allowed by law, as follows. A ID 21-1157 Consultation with Attorneys Under Texas Government Code Section 551.071 Consultations with City’s attorneys regarding legal issues associated with contemplated litigation and a settlement offer involving Tracy Whitten, where a public discussion of these legal matters would conflict with the duty of the City’s attorneys to the City of Denton and the Denton City Council under the Texas Disciplinary Rules of Conduct of the State Bar of Texas, or would jeopardize the City’s legal position in any administrative proceeding or potential litigation. DELIBERATED The item related to Individual Consideration Item 1.A (ID 21-1153) scheduled for consideration at the Special Called Meeting to follow later in the day. ID 21-1153 Consider adoption of an ordinance of the City of Denton authorizing the Interim City Manager to execute a Separation Agreement and General Release of All Claims with Tracy Whitten; authorizing expenditures; and providing an effective date. The item related to Closed Meeting Item 1. A (ID 21-1157) deliberated earlier in the day. There were no online registrations or call-ins on the item. The item was not presented and no discussion followed. Citizen comments received are noted in Exhibit A. Council Member Armintor moved to adopt the item as presented.
