357131PurposeThepurposeofthissubsectionistoensuretheprotectionandpreservationoftheWestOakAreaHistoricDistrictbyprovidingregulationsfortheuseconstructionalterationrepairimprovementandalterationofbuildingsstructurespropertiesandsiteswithinthedistrict357132DefinitionsThefollowingwordsternsandphraseswhenusedinthissubsectionshallhavethemeaningsascribedtotheminthissectionexceptwherethecontextclearlyindicatesadifferentmeaningCommissionmeansthehistoriclandmarkcommissionauthorizedandappointedinaccordancewithSection3543DistrictmeanstheareaencompassedintheWestOakAreaHistoricDistrictasestablishedbyanddescribedinOrdinanceNo87224asamendedwhichisonrileintheofficeofthecitysecretary357133ApplicabilityconflictswithotherprovisionsAOtherregulationsapplicabletotheWestOakAreaHistoricDistrictascontainedinanyothersectionofthischapterorCodeshallcontinuetoapplytothedistrictexceptasspecificallymodifiedinthissubsectionBIfanyprovisionofthissubsectionconflictswithanyotherprovisionofthisCodetheprovisionsofthissubsectionshallgovernandcontrolCWhereanyprovisionofthissubsectionmodifiesanyprovisionofanyotherordinanceapplicabletothedistrictthewordsusedinthissubsectionshallhavethemeaningasdefinedintheprovisionsoftheordinancemodifiedunlessthedefinitionisotherwiseprovidedforinthissubsection357134CertificateofappropriatenessAItshallbeunlawfulforanypersontodoortoalloworcauseanyotherpersontodoanyofthefollowingactsonanypropertylocatedwithintheWestOakAreaHistoricDistrictwithoutfirstapplyingforandreceivingacertificateofappropriatenessfromtheHistoricLandmarkCommission1Constructinganewbuildingormakinganadditiontoanexistingbuilding2Reconstructingalteringchangingorrestoringtheexteriorfagadeofanyexistingbuilding3Placingorlocatinganybuilding4Performinganyactforwhichacertificateofappropriatenessisrequiredbythisarticle5ConstructingorerectingafencewallsignorotherpermanentimprovementwhichissubjecttoregulationbythissubsectionBAnyconstructionalterationorimprovementmadeonanypropertywithinthedistrictwhichwouldnotrequireacertificateofappropriatenessbyreasonofitnotbeingvisiblefromanypublicstreetasprovidedinthisarticleshallbesubmittedtothe commissionpriortothebeginningoftheworkforitsdeterminationofwhethertheimprovementwouldbevisiblefromapublicstreetTherequirementsandproceduresofSection3576providingforapplicationandissuanceofcertificatesofappropriatenessshallapplyandbefollowedforanycertificateofappropriatenessrequiredinthissubsectionprovidedhoweverthatnocertificateofappropriatenessrequiredbySection3576orthissectionshallbegrantedexceptuponcompliancewiththeadditionalregulationsofthissectionwhereapplicable357135ArchitecturalRequirementsArchitecturalrequirementsintheWestOakAreaHistoricDistrictshallbeasfollowsAMainbuildingMainbuildingsmustbecompatibleinscalewithstructuresexistinginthedistrictBAccessorybuildingsAccessorybuildingswhicharevisiblefromanypublicstreetotherthananalleyasdeterminedbythehistoriclandmarkcommissionmustbecompatiblewiththescaleshaperoofformmaterialsdetailingandcolorofthemainbuildingCArchitecturaldetailMaterialscolorsstructuralanddecorationelementsandthemannerinwhichtheyareusedappliedorjoinedtogethermustbecompatiblewithnearbyandadjacentstructuresDAwningsMetalandcorrugatedplasticawningsareonlypermittedonanaccessorybuildingortherearfagadeofamainbuildingifnotvisiblefromanypubicstreetotherthananalleyasdeterminedbythecommissionOtherawningsmustbetypicalofanyproposedstructureandthecharacterofthemainbuildingEBuildingplacementAllbuildingsmustbeplacedsoastonotadverselyaffecttherhythmofspacesbetweenbuildingsontheblockAthirty30footsetbackisstandardinthisareaandnewconstructionshallfollowthatstandardFChimneysAllchimneysmustbecompatiblewiththestyleoftheproposedbuildingChimneysmustbeconstructedofbrickstuccostoneorothermaterialscompatibleintexturecolorandstylewiththeproposedmainbuildingGAdditionsAlladditionstoabuildingmustbecompatiblewiththedominanthorizontalorverticalcharacteristicsscaleshaperoofformmaterialsdetailingandcoloroftheexistingbuildingHColor1CertaincolorsprohibitedFluorescentmetalliccolorsarenotpermittedontheexteriorofanystructureinthedistrict2DominantandtrimcolorsAllstructuresmusthaveadominantcolorwhichshallnotbeofvividsaturationThecolorsofastructuremustbecomplementarytoeachotherandtheoverallcharacterofthemainbuilding3GuttersanddownspoutsGuttersanddownspoutsmustbeofacolorthatmatchesorcomplementsthecolorschemeofthemainbuilding4RoofcolorsRoofcolorsmustcomplementthestyleandoverallcolorschemeofthestructure CMaterialsAfencemustbeconstructedofone1ormoreofthefollowingmaterialscastmetalwroughtironwoodstonebrickpatternedconcreteorstuccoExposedconcreteblocksarenotpermittedDColorandstyleFencesmustbeofacolorstyleandmaterialwhichiscompatibletothemainbuildingEMasonrycolumnsandbasesThecolortexturepatternanddimensionsofmasonryandthecolorwidthtypeandelevationofmortarjointsinafencecolumnorbasemustmatchthemasonryandmortarjointsofthemainbuildingasnearlyaspracticableFWoodenfences1Allwoodenstructuralpostsmustbeatleastfour4inchesindiameter2Thesideofawoodenfencefacingapublicstreetmustbethefinishedside3Woodenfencesmaybepaintedorstainedacolorthatiscomplimentarytothemainbuilding357137SignsAspecialsigndistrictisherebyestablishedimposingadditionalregulationsuponallsignslocatedwithintheWestOakAreaHistoricDistrictsubjecttotheadditionalprovisionsofSubchapter3515ofthisCodeexceptasmodifiedasfollowsAAdditionalWallandstakesignregulations1NumberofwallsignsOnlyone1wallsignperpremisesispermitted2SizeNowallsignshallhaveamaximumdimensionwhichisgreaterthantwo2feetmeasuredalongthegreaterdistanceofanyone1linewhichdefinestheeffectiveareaofthesignNostakesignshallhaveaneffectiveareagreaterthanten10squarefeetBWinddevicesignsNowinddevicesignsarepermittedinthedistrictexceptthatone1nationalone1stateandone1registeredcorporatelogoflagmaybedisplayedonanyone1premisesasagroundsignwallsignorprojectingsignIfaflagisdisplayedasagroundsignorprojectingsignthesetbackrequirementsapplicabletogroundsignsinresidentialdistrictsshallapplyAcorporatelogoflagmayonlybedisplayedonapremisesownedorcontrolledbythecorporationNoflagshallhaveadimensionastoanyone1sidewhichisgreaterthansix6feetCAddressornamesignsThesignregulationsofthissectionshallnotapplytothesignsornumberswhichareusedsolelytoidentifythestreetaddressofthepremisesortheidentifybynametheoccupantsofaresidentialbuildingDApprovalprocedureforwallsignsNonewwallsignsshallbeconstructedorlocatedandnoexistingwallsignshallbealtereduntilacertificateofappropriatenessisissuedbythehistoriclandmarkcommissioninaccordancewiththeprocedureapplicabletoalterationsorchangesoftheexteriorarchitecturalfeaturesofbuildingsasprovidedforinthisSubchapter 357138ParkingTheprovisionsofSubchapter3514ofthisCodeshallapplytotheWestOakAreaDistrictexceptasmodifiedasfollowsALocationAlloffstreetparkingspacesforanybuildingusedasamultifamilydwellingorforanonresidentialuseshallbelocatedbetweenthebuildingfrontingthepublicstreetandtherearpropertylineBNumberofparkingspacesEachspecifieduseshallprovidethefollowingnumberofparkingspaces1Multifamilybuildingsshallhaveaminimumoftwo2parkingspacesforeachdwellingunit2Nonresidentialusesshallprovideoneandonehalf15thenumberofparkingspacesrequiredforthatusebySubchapter3514SECTION4IfanysectionsubsectionparagraphsentenceclausephraseorwordinthisordinanceorapplicationthereoftoanypersonorcircumstanceisheldinvalidbyanycourtofcompetentjurisdictionsuchholdingshallnotaffectthevalidityoftheremainingportionsofthisordinanceandtheCityCounciloftheCityofDentonTexasherebydeclaresitwouldhaveenactedsuchremainingportionsdespiteanysuchinvaliditySECTION5AnypersonwhoshallviolateaprovisionofthisordinanceorfailstocomplytherewithorwithanyoftherequirementsthereoforofapermitorcertificateissuedthereundershallbeguiltyofamisdemeanorpunishablebyafinenottoexceedTwoThousandDollars200000EachsuchpersonshallbedeemedguiltyofaseparateoffenseforeachandeverydayorportionthereofduringwhichaviolationofthisordinanceiscommittedorcontinuedanduponconvictionofsuchviolationshallbepunishedwithinthelimitsaboveSECTION6Thisordinanceshallbecomeeffectivefourteen14daysfromthedateofitspassageandtheCitySecretaryisherebydirectedtocausethecaptionofthisordinancetobepublishedtwiceintheDentonRecordChronicletheofficialnewspaperoftheCityofDentonTexaswithinten10daysofthedateofitspassagePASSEDANDAPPROVEDthisthedayof2008PERVMCNEILLMAYOR
