After determining that a quorum was present, the City Council of the City of Denton, Texas
convened in a Work Session on Tuesday, June 15, 2021, at 2:00 p.m. in the Council Chambers at
City Hall, 215 E. McKinney Street, Denton, Texas.
PRESENT IN PERSON:Mayor Gerard Hudspeth, and Council Members Vicki Byrd, Brian
Beck, and Jesse Davis

A. ID 21-1242 Receive a report, hold a discussion, and give staff direction regarding the display
of non-government related flags at City of Denton facilities.
Council Member Armintor requested the item be moved to later in the meeting to allow her
to better participate remotely. Mayor Hudspeth reported it would remain as the first item to
be presented as it was duly posted as such for the public.
The item was presented and discussion followed.
Following discussion, City Council consensus was to pursue Option 2 - Establish a Policy,
By Request: Which consists of creating a policy to accept requests from a person or group to
be considered, providing parameters and a process for review and approval as well as have
visual elements for a proclamation. Whether the policy will be approved at the City Council
or administratively by the City Manager to be determined at a later date when an item is
scheduled for future deliberation.
B.ID 21-452 Receive a report, hold a discussion and give staff direction regarding FY 2021-22
departmental budget presentations for Finance, Economic Development, Library and
Procurement/Compliance/Warehouse.
The item was presented and discussion followed.
Following discussion, City Council consensus was for the Economic Development
Department to provide additional information regarding revenue and spending line items
associated with incentives and the Stoke map update. No follow up was needed from other
presenting departments. The presentation for the Finance Department was postponed to a
later date.
The work session was recessed for a short break at 4:24 p.m. and reconvened at 3:40 p.m.
C ID 21-865 Receive a report, hold a discussion, and give staff direction regarding the 2021-
2023 Boards & Commissions Nominee Screening and Appointment Process.
The item was presented and discussion followed.
Following discussion, City Council consensus was as follows:

Continue with the general practice that any one council member cannot nominate to
more than one at-large/alternate seat on any one board, commission, or committee;
Postpone all upcoming appointments to both the Community Development Advisory
Board and Human Services Advisory Board until such time as the City Council
makes a determination on the upcoming presentation from the Community Services
Department on the possibility of merging both noted boards, with such discussion
scheduled for the June 22, 2021 meeting;

Establish a process by which the Zoning Board of Adjustments, whose membership
is low resulting from existing vacancies, meets regularly rather than when they
absolutely have to so as to better engage members and allow them to stay active;
Continue outreach with existing members that to date had not submitted an
application seeking reappointment and encourage them to reapply.
Provide information on those existing members that serve on more than one board,
as well as include that information in the fUture appointment packet provided as part
of the B&C Appointment Process each year; and
Develop a policy to address the "felony" restrictions for board/commission members
and options to provide for appointment, with exceptions; and present for discussion
at a future date.

D. ID 21-1188 Receive a report, hold a discussion, and give staff direction regarding a proposed
high-performance computing operation on leased property at the Denton Energy Center
under development by Tenaska.
The item related to Closed Meeting Item 1.A (21-1187) scheduled for deliberation later in
the day.

Following discussion, City Council consensus was to provide a 120-day exclusivity period
regarding the Denton Emergency Center site.
E ID 21-561 Receive a report, hold a discussion, and give staff direction on pending City
Council requests for:
1) Work session on updating and editing our Council Rules and Procedure (Sec. 2-29) for
maximum public benefit.
2) Work session to discuss policy to authorize staff to re-negotiate the on-street parking
ordinance with UNT staff and then bring it back to the City Council for approval before it
auto-renews.
3) Work session for Council to revisit the issue of a comprehensive non-discrimination
ordinance for the City of Denton.

of the Texas Government Code, as amended, or as otherwise allowed by law, as follows.
A.ID 21-1187 Deliberations Regarding Certain Public Power Utilities: Competitive Matters -
Under Texas Government Code Section 551.086; and Deliberation Regarding Certain
Economic Development Negotiations Under Texas Government Code Section 551.087.
Receive a presentation from staff regarding public power competitive and financial matters
and economic development negotiations with Tenaska and associated customers regarding
the siting of and provision of electric power to a prospective large electric demand customer,
discuss, deliberate, and provide direction to staff regarding same. This discussion shall
include commercial and financial information the City has received from Tenaska that is
subject to a non-disclosure agreement between the City and Tenaska.

At Council Member Davis’ request for clarification, Interim City Attorney Clifton confirmed
the nomination was out of order as the Resolution presented for consideration provided for
an appointment. As a result, the motion and second to nominate Council Member Davis was
not considered.

Denton, Texas, regarding a change in the zoning district and use classification from
Neighborhood Residential 4 (NR4) District to a Planned Development (PD) District and 5.25
acres from Neighborhood Residential 7 (NR7) District to a Planned Development (PD)
District, totaling approximately 100.43 acres. The 95.18-acre site is generally located
northwest of the intersection of Deerwood Parkway and Grant Parkway and the 5.25-acre
site is generally located northeast of the intersection of North Loop 288 and Kings Row, in
the City of Denton, Denton County, Texas; adopting an amendment to the City’s official
zoning map; providing for a penalty in the maximum amount of $2,000.00 for violations

Denton, Texas, regarding a change in the zoning district and use classification from Public
Facilities (PF) District to Suburban Corridor (SC) District on approximately 1.535 acres of
land generally located on the south side of West University Drive, approximately 972 feet
east of Malone Street, in the City of Denton, Denton County, Texas; adopting an amendment
to the City’s official zoning map; providing for a penalty in the maximum amount of
$2,000.00 for violations thereof; providing a severability clause and an effective date. The
Planning and Zoning Commission voted [6-0] to recommend approval the request. (221-
