McKinney Street, Denton, Texas Board Members: Chair Susan Parker, Vice Chair Billy Cheek, Secretary Ed Soph, Karen DeVinney, Russell Bafford, and Charles Parker Absent: Barbara Russell Ex Officio Member: Mario Canizares, Assistant City Manager REGULAR MEETING 1. CONSENT AGENDA A. PUB19-181 - Consider recommending adoption of an ordinance of the City of Denton, a Texas home-rule municipal corporation, authorizing the City Manager to execute a contract with IDEXX Distribution, Inc. c/o IDEXX Laboratories, for drinking water compliance testing, and for laboratory services and animal testing materials for the Denton Animal Shelter, which is the sole provider of these services; in accordance with Texas Local Government Code 252.022, provides that procurement of commodities and services that are available from one source are exempt from competitive bidding; and if over $50,000 shall be awarded by the governing body; and providing an effective date (File 7133 - awarded to IDEXX Distribution, Inc. c/o IDEXX Laboratories in the five (5) year not-to- exceed amount of$600,750). B. PUB19-186 - Consider recommending adoption of an ordinance of the City of Denton, a Texas home-rule municipal corporation, authorizing the City Manager or his designee, to execute a contract with International Business Machines (IBM) Corporation for Weather Forecasting Services; Pattern Recognition Technologies, Inc., for Load Forecasting Service; and Radiant Geospatial Solutions, LLC, for Wind and Solar Forecasting Services; providing for the expenditure of funds therefor; and providing an effective date (RFP 7057 - awarded to the lowest responsive bidder for each line item, Weather Forecasting contract awarded to International Business Machines (IBM) Corporation for a three (3) year not-to-exceed amount of$63,030, Load Forecasting contract awarded to Pattern Recognition Technologies, Inc., a three (3) year not-to-exceed amount of$118,800 and Wind and Solar Forecasting contract awarded to Radiant Geospatial Solutions LLC for a three (3) year not-to- exceed amount of$66,000 for all years). Board Member Bafford asked the value of the middle and long-range forecast tools. Terry Naulty answered explaining the worth of all forecast tools. There were a few more questions and some discussion. Board Member Soph motioned to approve this item with a second from Board Member Cheek. Vote 6-0. PUB19-187—Consider recommending adoption of an ordinance of the City of Denton, a Texas home-rule municipal corporation, authorizing the City Manager to execute a Professional Services Agreement with Raftelis Financial Consultants, Inc., for Water and Wastewater Utilities Cost of Service and Rate Design Study as set forth in the contract; providing for the expenditure of funds therefor; and providing an effective date (RFQ 7105 -Professional Services Agreement for Water and Wastewater Utilities Cost of Service and Rate Design Study awarded to Raftelis Financial Consultants, Inc., in the not-to-exceed amount of$108,470). D. PUB19-190 - Consider recommending adoption of an ordinance of the City of Denton, a Texas home-rule municipal corporation, authorizing the approval of Change Order No. 1 to the contract between the City of Denton and Wilson Contractor Services, LLC, for the Allred and John Paine Road Water Transmission Main Project; providing for the expenditure of funds therefor; and providing an effective date (IFB 7038 - Change Order No. 1 in the not-to-exceed amount of$399,141.26 for a total contract award aggregated to $5,275,366.64). E. PUB19-191 - Consider recommending adoption of an ordinance authorizing the City Manager, or his designee, to execute a Contract of Sale between the City of Denton, a Texas home-rule municipal corporation("Denton"), as Buyer, and the City of Garland, a Texas home-rule municipality, ("Garland"), as Seller, to acquire fee title to a 2.194 acre tract and an access easement covering 0.076 acres, both situated in the Mary L. Austin Survey, Abstract No. 4, City of Denton, Denton County, Texas, and more particularly described in Exhibit "A", for the purchase price of Two Hundred Ninety- Eight Thousand One Hundred Thirty-Two Dollars and No Cents ($298,132.00), and other consideration, as prescribed in the Contract of Sale; authorizing the expenditure of funds therefor; providing a savings clause; and providing an effective date. Board Member Bafford pulled this item for questions regarding the property purchase. Brent Heath gave a short presentation. There were questions by the Board Member,with staff addressing them. Board Member C. Parker motioned to approve this item with a second by Board Member Cheek. Vote 6-0. F. PUB19-194 - Consider recommending adoption of an ordinance of the City of Denton, a Texas home-rule municipal corporation, authorizing the City Manager, or his designee, to execute a contract with Holt CAT through the Sourcewell Cooperative Purchasing Network Contract Number 032119- CAT, for the purchase of one (1)D-9 Dozer for the Solid Waste Landfill Department; authorizing the expenditure of funds therefor; and declaring an effective date (File 7182 - awarded to Holt CAT, in the not-to-exceed amount of$1,057,079.89). Board Member Bafford pulled this item for questions regarding the dozer. Ethan Cox answered questions along with Terry Kader. Bafford asked if we have looked at used equipment. Kader answered we have an agreement with NCTCOG and only new equipment can be purchased. There were a few more questions. Board Member Cheek motioned to approve this item with a second by Board Member Devinney. Vote 5-1. Board Member C. PUB19-192 - Consider approval of the Public Utilities Board Meeting minutes of August 26, 2019. Approved with a change, members present was incorrect. B. PUB19-188 - Consider recommending adoption of an ordinance of the City of Denton, Texas to declare the intent to reimburse capital program expenditures of the Electric Utility($37,649,374), Solid Waste ($3,120,000), Water($2,421,800), Wastewater($11,360,000), and General Government ($36,331,000)with Tax-Preferred Obligations (Certificates of Obligation and General Obligation Bonds)with an aggregate maximum principal amount not to exceed $90,882,174; and providing an effective date. David Gaines gave a short presentation for this item. There were a few questions by the Board Members. Board Member Cheek motioned to approve this item with a second by Board Member Soph.
