October 4, 2021CITY OF DENTON CITY COUNCIL MINUTES October 4, 2021 After determining that a quorum was present, the City Council of the City of Denton, Texas convened in a Special Called Meeting on Monday, October 4, 2021, at 11 :34 a.m. in the Council Chambers at City Hall, 215 E. McKinney Street, Denton, Texas. PRESENT IN PERSON: PRESENT VIRTUALLY: ABSENT: Mayor Gerard Hudspeth and Council Members Vicki Byrd, Brian Beck, Jesse Davis, and Alison Maguire None Mayor Pro Tern Paul Meltzer and Council Member Deb Armintor Also present were Interim Assistant City Manager Frank Dixon, Interim City Attorney Catherine Clifton, and City Attorney Mack Reinwand. The posted agenda noted the registration process for public participation at this virtual meeting. However, there were no online registrations or call ins on any items on the agenda. CLOSED MEETING -NOT HELD 1. The City Council did not convene into a Closed Meeting. A. ID 21-2180 Deliberations regarding a Personnel Matter -Under Government Code, Section 551.074; and Consultation with Attorneys -Under Texas Government Code, Section 551.071. Deliberate and discuss the appointment, employment, duties, and contract of the City Attorney; consultation with the City's attorneys regarding associated legal issues where a public discussion associated with these legal matters would conflict with the duty of the City's attorneys to the City of Denton and the Denton City Council under the Texas Disciplinary Rules of Professional Conduct of the State Bar of Texas. NOT DELIBERATED As noted, the item was not deliberated as the closed meeting was not held. SPECIAL CALLED MEETING 1. ITEMS FOR INDIVIDUAL CONSIDERATION A. ID 21-2181 Consider adoption of an ordinance of the City of Denton appointing a City Attorney; authorizing the Mayor to execute an employment agreement setting the compensation and terms for the City Attorney; providing for the expenditure of funds; and providing an effective date. Following commentary, Council Member Davis moved to adopt the item as presented appointing Mack Reinwand as City Attorney. Motion seconded by Council Member Maguire. Motion carried. ID 21-2182 Consider a motion to reconsider the September 28, 2021 approval of an ordinance of the City of Denton, Texas, regarding a change in the zoning district and use classification from Mixed-Use Neighborhood (MN) and Residential 4 (R4) Districts to Mixed-Use Neighborhood (MN) District on approximately 0.326 acres of land generally located southeast of the intersection of Robertson Street and Skinner Street, in the City of Denton, Denton County, Texas. (Z21-0005d, 418 Robertson Fourplex, Tina Firgens). NOT ADOPTED There were no online registrations or call-ins on the item. The item was presented and discussion followed. Following Council Member Maguire's inquiry, City Attorney Reinwand clarified that Mayor Pro Tern Meltzer was not required to be present on reconsideration of the item even though the item was scheduled for reconsideration at his request. Mayor Hudspeth moved to adopt the item as presented and subsequently withdrew the motion following City Attorney Reinwand's advisement that someone on the prevailing side would have to make the motion to reconsider. Mayor Hudspeth called for a motion on the item; and with no motion made by any Council Member on the prevailing side at the time the original ordinance was adopted, the item was not presented for a vote. There was no public registration process as this was a work session only. 1. Work Session Reports A. ID 21-1319 Receive a report, hold a discussion, and give staff direction regarding the Fiscal Year 2021-22 Annual Internal Audit Plan. [Estimated Presentation/Discussion Time: 30 minutes] The item was presented and discussion followed. Following discussion, City Council consensus was in support of the following: • Creation of an Internal Audit Finance Committee • The following Internal Audit Department Goals: o DME Energy Management Office Admin; o Technology Services Series; o Police Body-Worn Crupera Usage; o Wastewater Operations; o Warehouse Operations. • FY 21-22 Follow-Up Review Options: o Second Review: Procurement o Economic Development o CIP Phase 2: Property Acquisition o Facilities Maintenance o Grants Management o Utility Payment Assistance Program The work session was recessed for a short break at 12:01 p.m. and reconvened at 12:11 p.m. Council Member Armintor arrived at 12:12 p.m. City of Denton City Council Minutes October 4, 2021 Page4 B. Following discussion, City Council consensus was for Staff to continue to refine the draft recommendations presented, develop the implementation plan, and finalize the draft report for presentation at a future date. 2.
