Denton Municipal Utilities - Terms of Service City of Denton Utility and Solid Waste Terms of Service 1. The Applicant acknowledges utility accounts and deposits are not transferable between customers and the utility deposit will only be refunded to the customer named on the account. 2. The Applicant acknowledges the electric and water utility meters are the property of the City and they can be turned on or off only as authorized by the City. Applicant further acknowledges trash and recycle containers are property of the City and may only be used and removed as authorized by the City. 3. The City has a right of access to all meters whenever necessary. Failure to provide access to all utility meters may result in disconnection of service. 4. The Applicant agrees that they may be responsible for the past unpaid utility bills of any person served at another service connection and who is allowed to live with the Applicant or to occupy any building that has utility service in the Applicant's name. The Applicant authorizes the City of Denton to transfer the balances of such unpaid utility bills attributable to a different service connection to the Applicant's account and to disconnect Applicant's utilities if those balances are not paid in full. The Applicant understands that the City may refuse to authorize service until all outstanding balances are paid in full. 5. Any unauthorized connection or disconnection of a meter is illegal and will result in the immediate termination of service and will result in meter tampering and/or damage charges. 6. If there is any failure to pay any charge for service or repair when it is due, the City may discontinue service and/or remove any and all city-owned property serving the Applicant until arrears and all appropriate fees are paid. 7. The Applicant acknowledges and understands that if payment of monthly bills is unsatisfactory, the City may require a new or additional deposit to secure payment of current bills. If the additional deposit is not paid, service may be denied or discontinued, as appropriate. 8. By accepting utility service from the City of Denton, the Applicant authorizes the City to contact the Applicant. The City may contact any number associated with the Applicant's account by telephone. The City may also contact the Applicant via text message or by electronic mail to any email address provided to the City by the Applicant. Methods of contact may include using pre-recorded or artificial voice messages and/or the use of an automatic dialing device, as applicable. By accepting utility service from the City, Applicant agrees the City is not responsible for any charges to the Applicant that result from the City's communications. 9. The Applicant agrees the City is not responsible for loss resulting from electric service irregularities or interruptions. 10.The Applicant acknowledges the City of Denton is the sole provider for solid waste service within the City limits, and all active utility accounts must include City-provided solid waste service. 11.Commercial Applicants acknowledge that all commercial properties must engage in recycling to decrease waste sent to the landfill. 12.The Applicant agrees to abide by and consider as part of this Agreement any ordinances, rules, and regulations the City adopts concerning solid waste and utility service, municipal and rural. Applicable ordinances, rules, and regulations, as amended, can be found in the Code of the City of Denton, Texas, Chapters 24 and 26, and the City's applicable rate ordinances. 13.The Applicant understands and agrees acceptance of utility and solid waste service binds the Applicant to all the terms and conditions listed herein, the same as if the Agreement were signed with pen and ink.
