Public Meetings & Agendas | Denton, TX (civicplus.com) 2 General Information & Status Updates A.Landfill Scale House Construction- Construction of the new landfill scale house will start in October 2024, necessitating temporary traffic changes at the facility. A temporary scale house will be set up to maintain continuous service. The upgrade will improve site access,scale wait times, traffic flow, and safety. Since opening in 2007, the current scale house'swaste handling capacity has increased from 600 tons to 1,500 tons per day. Temporaryoperations will feature attended and automated scales for both public and commercial use, with clear signage for traffic changes. The project is expected to last six months. Staff contact: Brian Boerner, Solid Waste &Recycling B.Utility System Maintenance – Starting Friday, Sept. 6 at 6 p.m. through Sunday, Sept. 8, the utility billing system will be offline to perform system maintenance. During this period,customers will be unable to make payments or engage in self-service activities. Scheduled disconnects for non-payment will resume on Tuesday, Sept. 10. Customers may call customer service during business hours, Monday through Friday, 8 a.m. to 5 p.m. at (940) 349-8700 or email customer.service@cityofdenton.com if they experience an issuewith their bill. Staff contact: Christa Foster, Customer Service C.South Branch Library Temporary Closure – The South Branch Library will be closed for facility improvements beginning Friday, Sept. 6 at 6 p.m. The library will reopen on Tuesday, Sept. 10, with regular hours. During this time, the North Branch and EmilyFowler Central Libraries will maintain regular operating hours, including book dropservices. Staff contact: Jennifer Bekker, Library D.Recycling Contamination Decline – In August 2024, the Solid Waste and Recycling (SWR) Department achieved a contamination rate of 25 percent for collected recycling materials,marking the department’s lowest rate in three years. Recycling contamination occurs when non-recyclable materials are placed in recycling containers, or recyclables are not adequately cleaned before disposal. Reduction strategies included cart/container tagging, removing contaminants before collection, and educatingcustomers on proper recycling practices. Staff contact: Brian Boerner, Solid Waste andRecycling E.Fall Lights Out – Peak fall bird migration is from Sept. 5 to Oct. 29; during this time, Texaswill see nearly a quarter of all U.S. migratory birds in our skies, most at night. The City ofDenton recognizes “Lights Out Nights” during the peak migration period and encouragesresidents and businesses to turn off non-essential lighting between 11 p.m. and 6 a.m. Essential lighting should follow dark sky-friendly practices, such as using shields to directlight downwards. On Sept. 5, 2024, Denton Municipal Electric began dimming residentialstreetlights for peak migration and will return them to normal levels after Oct. 29, 2024. 3 Sign up for local bird migration alerts through Local Bird Migration Alerts - BirdCast to stay current on peak migration nights. Staff contact: Karen Boerner, Environmental Services & Sustainability Responses to Council Member Requests for Information A.Parks Signage – On Monday, Sept. 2, Council Member Byrd requested informationregarding park signage. Parks and Recreation staff post park rule signs at all parks. These signs indicate park hours and provide a list of prohibited activities. Staff contact: Ziad Kharrat, Parks and Recreation B.Parking Patrol – On Wednesday, Sept. 4, Mayor Hudspeth requested information aboutparking lot patrol and overnight parking in city-owned lots. Staff coordinated and addressed concerns about inoperable vehicles in a city-owned parking lot. Following an inspection that identified a vehicle with expired tags, front-end damage, and a flat tire, staffposted the vehicle for impound. Staff identified an approach to regular inspection, patrol,and options to expedite future removals of such vehicles. Staff will continue monitoringand provide updates as needed. Intergovernmental Affairs On Thursday, Sept. 5, the Senate Committee on Local Government convened to discuss interim charges on several city-related matters, including the implementation of Senate Bill 2038 (S.B. 2038). This legislation states that residents and landowners may petition to have an area within a city’s extraterritorial jurisdiction (ETJ) removed from the ETJ. The bill outlines two methods for ETJ release: (1) a petition initiated by residents or landowners or (2) an election held within the ETJ area to determine the outcome. The City of Denton and 37 other cities submitted a letter to the committee outlining concerns about the law’s impact and its practical challenges. In addition, the Texas Municipal League provided testimony, offering recommendations on how the legislation could better align with inter-local agreements, local administration of public improvement districts (PID), certificates of convenience and necessity (CCNs), and development agreements. City staff will continue to monitor developments on this issue. D.Street Closure Report ............................................................................................................ 5 Date: September 06, 2024 Report No. 2024-033 INFORMAL STAFF REPORT TO MAYOR AND CITY COUNCIL SUBJECT: 2024 Atmos Rate Filing and Approval EXECUTIVE SUMMARY: Atmos Mid-Tex filed for a system-wide rate increase for the next year, beginning Oct. 1, 2024. The City of Denton, through its membership in a coalition of cities, has evaluated the requested increase and negotiated a reduction in Atmos’ overall request. The City of Denton retains original jurisdiction over gas utility rates and must approve any rate increases. BACKGROUND: The City of Denton (“City”), along with 181 other Texas cities served by Atmos Energy Corp., Mid-Tex Division (“Atmos Mid-Tex”), is a member of the Atmos Cities Steering Committee (ACSC). In 2007, ACSC and Atmos Mid-Tex settled a rate application filed by Atmos for an interim rate adjustment, commonly referred to as a GRIP filing, arising out of the Gas Reliability Infrastructure Program legislation. That settlement created a new rate review process, called Rate Review Mechanism (“RRM”), as a substitute for the GRIP statute in future rate filings. This process has been in place with some modifications since that time. DISCUSSION: On or about April 1, 2024, Atmos Mid-Tex filed a rate request pursuant to the RRM Tariff adopted by ACSC members. The Company claimed that its cost-of-service in a test year ending December 31, 2023, entitled it to additional system-wide revenues of $196.8 million. Applying the standards set forth in ACSC’s RRM Tariff reduces the Company’s request to $182.5 million, $132.6 million of which would apply to ACSC members. After reviewing the filing and conducting discovery, ACSC’s consultants concluded that the system-wide deficiency under the RRM regime should be $149.6 million instead of the claimed $182.5 million. After several settlement meetings, the parties have agreed to settle the case for $164.7 million. This is a reduction of $32.1 million to the Company’s initial request. This includes payment of ACSC’s expenses. Summary: $196.8M: Atmos Original Request (system-wide) $182.5M: RRM Tariff Applied Standard (system-wide) $149.6M: RRM Tariff Reviewed of Applied Standard (system-wide) $164.7M: Agreed Upon Review/Negotiation $32.1M: Savings from Atmos Original Request 6 Date: September 06, 2024 Report No. 2024-033 Bill Impact: The settlement's impact on average residential rates is an increase of $5.52 monthly or 6.84 percent. The increase for average commercial usage will be $13.39, or 3.44 percent. A bill impact comparison containing these figures is attached. RRM Savings Over GRIP: The GRIP process does not allow any review of the reasonableness of capital investment. It does not allow cities to participate in the Railroad Commission’s review of annual GRIP filings or allow recovery of Cities’ rate case expenses. The Railroad Commission undertakes a mere administrative review of GRIP filings (instead of a full hearing), and rate increases go into effect without any material adjustments. In ACSC’s view, the GRIP process unfairly raises customers’ rates without any regulatory oversight. In contrast, the RRM process has allowed for a more comprehensive rate review and annual evaluation of expenses and revenues, as well as capital investment. While residents outside municipal limits must pay rates governed by GRIP, some cities served by Atmos Mid-Tex chose to remain under GRIP rather than adopt RRM. When new rates become effective on October 1, 2024, ACSC customers will maintain a monthly cost advantage over GRIP and DARR rates. CONCLUSION: The RRM process has proven to result in a more efficient and less costly (both from a consumer rate impact perspective and from a rate-making perspective) than the GRIP process. Given Atmos Mid-Tex’s claim that its historic cost of service should entitle it to recover $196.8 million in additional system-wide revenues, the RRM settlement at $164.7 million for ACSC members reflects substantial savings to ACSC cities. Settlement at $164.7 million is fair and reasonable. Staff will recommend the City Council approve an ordinance approving the proposed rates at the September 17, 2024 Council meeting, with the new rates becoming effective on October 1, 2024.
