General Information & Status Updates
A.Mosquito Response – In May 2024, the City deployed traps as the mosquito season began.The Mosquito Surveillance and Response Plan (MSRP) outlines a five-level risk
assessment process. The season started at Risk Level 2 due to the detection of West Nile
Virus (WNV) in mosquito pools the previous year. On June 28, the City elevated the riskto Level 3 after additional mosquito pools tested positive for WNV. By Sept. 20, aconfirmed human case of WNV in Denton prompted the City to raise the risk to Level 4.At this level, the City will finalized all actions needed to prepare for ground-level spraying.
For ground-level spraying to be authorized, the City Council must pass a resolution.However, ground-level spraying becomes a possible control action at MSRP Risk Level 5and following an approved resolution. B.Development Activity Report – The City’s Development Services team recently launchedthe Development Activity Report. This report is a tool for residents to understand how theCity is developing around them. The report dashboard includes metrics related todevelopment activities, including active development projects, residential and commercial

C.Robinwood Reconstruction – On Thursday, Sept. 26, at 6 p.m., the City will host a virtualcommunity meeting for the Robinwood Reconstruction project. This project consists of a
full-depth road reconstruction of the following street segments: Robinwood Lane, Clover
Lane, Live Oak Street, Shadywood Street, and Mistywood Lane. Improvements includesubgrade stabilization, asphalt paving, concrete curb and gutter, and driveway replacementif necessary. D.Invasive Plant Mitigation – The Parks and Recreation Department will begin applying pre-emergent herbicide to City-owned properties beginning Sept. 23 through mid-November.Pre-emergent is an herbicide chemical that provides a barrier against weed growth. It isincluded in the City’s annual Integrated Pest Management Program and helps maintain turf

Responses to Council Member Requests for Information
A.Roselawn Drive Street Closures – On Sept. 13, Mayor Pro Tem Meltzer forwarded aninquiry regarding the construction closure of Roselawn Drive. The contractor experiencedunexpected delays, and the road is now projected to reopen following the installation ofguardrails in early October. Staff contact: Trevor Crain, Capital Projects

B.Vegetation Management – On Sept. 15, Council Member McGee received an inquiry froma resident regarding tree branch trimming. In general, the adjacent property owner isresponsible for the maintenance of trees. The City has the authority to remove hazardous,
dead, or dying trees in public rights-of-way. Staff contact: Marshall McGee, Parks and

C.Road Construction Suspension – On Sept. 17, Council Member Beck forwarded a requestfrom residents regarding the suspension of road construction in the Broken Arrow
neighborhood. The project has been paused to address an issue with the subgrade, the
material that forms the foundation for the layers above it, such as asphalt.
The City’s contracted quality assurance firm is conducting core sampling to evaluate thesituation and fully determine the best steps forward. Their recommendations are expected
within the next two weeks. During this time, inspection staff will ensure that safety
measures, such as protecting valves and manhole covers, remain in place with appropriatetraffic control. Staff contact: Taylor Holt, Capital Projects
D.Construction Operating Hours – On Sept. 18, Council Member Beck shared an inquiry
from a resident regarding development contractors operating outside of approved hours.

E.Council Vote History – On Sept. 19, Council Member Beck requested information
regarding the online record of Council votes. At the May 7, 2024, Council Meeting, theCouncil reauthorized sharing voting history on the City’s website. The reauthorizationincluded a request from staff for six (6) months to review and implement a new process.Staff is on course to bring this back online at the six-month mark in November. INFORMAL STAFF REPORT TO MAYOR AND CITY COUNCIL
SUBJECT:
Update on the City of Denton’s 2024 Mosquito Season Risk Level and Mosquito Surveillance and Response Plan process.
EXECUTIVE SUMMARY:
In May 2024, the City deployed traps at the beginning of mosquito season. The Mosquito Surveillance and Response Plan (MSRP) outlines the City’s process which includes five risk
levels. The city began the 2024 mosquito season at Risk Level 2 due to occurrence of West Nile
Virus (WNV) in mosquito pools in the previous season. On June 28, the City elevated to Risk Level 3 with mosquito pools testing positive for West Nile Virus. On September 20, the City was notified of a confirmed WNV human case within the City of Denton and elevated to Risk Level 4. At Risk Level 4, the City will initiate necessary actions for ground-level spraying. To authorize
ground-level spraying, the City Council is required to take action on a Resolution. However, it is
at MSRP Risk Level 5 that ground-level spraying be part of the implemented vector control actions.
BACKGROUND:
The City of Denton prepared the first Mosquito Surveillance and Response Plan (MSRP) in 2002 and has reviewed it annually. The last revisions were made in 2021 following the 2020 Mosquito
Season, which included ground-level spraying. Denton works with the University of North Texas
(UNT) to deploy, collect, and test mosquitoes across the city. Collected mosquitoes are sent to the Texas Department of State Health Services (DSHS) for actual analysis of the West Nile Virus. Additionally, the City works closely with Denton County to share mosquito trap locations as well as WNV test results. An interactive map on the Denton County website integrates mosquito
trapping results from participating communities. Denton County is the Public Health Authority
and is the entity to be notified of any positive WNV human cases.
The City of Denton offers a limited supply of Bti briquettes (kill mosquito larva) to residents (two per resident while supplies last) to assist in controlling the mosquito populations. Proof of
residency is required:

DISCUSSION:
The City of Denton began the 2024 Mosquito Season at Risk Level 2 – Enhanced Response
because of positive West Nile Virus (WNV) tests detected in 2023 mosquito pools within city
limits. On June 28, the City elevated to Risk Level 3 – Public Health Concern due to mosquito

pools being reported as positive for WNV by the Texas DSHS. On September 20, the City elevated
to Risk Level 4 - Public Health Warning due to notification from Denton County Public Health
of a confirmed WNV human case within the City of Denton.
At Risk Level 4, the probability of human outbreak is moderate to high and WNV is reported in
multiple mosquito pools with a single human case confirmed through laboratory testing. At Risk
Level 4, the City would continue enhanced efforts to promote source reduction and personal
protection. Possible breeding areas on City controlled property are treated regularly with larvicide.
In accordance with the City’s Integrated Pest Management (IPM), we would proceed to use
Bacillus thuringiensis israelensis (Bti) and Spinosad products (bacterial insecticide). The City
would finalize all actions for implementing ground level spraying activities using ULV
applications of pyrethroids.
In Risk Level 5, laboratory testing would confirm human outbreak with multiple human cases. The
City would increase outreach efforts across the community and intensify larviciding efforts using
Bti in targeted areas. Larvidices containing Insect Growth Regulators (IGR) or pesticides such as
Spinosad may be applied at this time. Additionally, standing water in our City parks would be the
target of intense treatments. If the threat to human health is considered imminent, the City would
consider targeted adulticide applications using ground-based Ultra-Low Volume (ULV)
equipment. The decision to spray would be made by a Council Resolution prior to the first
application, for each mosquito season. ULV application should be implemented in the vicinity
(approximately 1 mile) of areas where positive human cases were detected.
The City of Denton last used ULV spraying in 2020, and that effort utilized Merus 3.0®, an organic
pyrethrin product that does not contain petroleum distillates. Natural pyrethrins are a botanical
insecticide produced primarily by flowers from the chrysanthemum family. Merus 3.0® is Organic
Review Materials Institute (OMRI) and meets National Organic Program (NOP) standards for
adult mosquito control. The use of Merus 3.0®, or any organic-certified pesticides that may
become available, would continue to be used as the preferred option for ground-level spraying
operations in accordance with integrated pest management.
Spraying, if performed, uses city-owned spray equipment operated by a third-party licensed
contractor. Advanced community alerts of the spraying operation would include a news release,
social media messaging, website posts, text campaigns, phone calls, and road signs.
NEXT STEPS:
City Council should reach out to Michael Gange with any questions by Tuesday, Oct. 1. Staff are
preparing to bring a Resolution forward for Council consideration at the Tuesday, Oct. 15, 2024,
Council Meeting.

CONCLUSION:
The City of Denton has elevated to Risk Level 4 based on the positive WNV mosquito pools and the confirmed human WNV case. This Report is an effort to clarify how the City elevated risk
levels and the necessary action of Council should ULV spraying be required within the City of Denton. The current Risk Level, link to the mosquito trapping map, and other mosquito awareness information may be round on the City’s website.

INFORMAL STAFF REPORT TO MAYOR AND CITY COUNCIL
SUBJECT: Nominations to the Board of Directors of the Denton Central Appraisal District.
EXECUTIVE SUMMARY:
The Denton Central Appraisal District (DCAD) has notified the City that the term for members on the current DCAD Board of Directors expires on Dec. 31, 2024. Therefore, DCAD is seeking nominations from the 61 taxing jurisdictions in the district. The City Council can make up to five nominations for the Board of Directors. Once DCAD receives nominations, a ballot will be sent to the City. The City Council will then vote to elect Board members at the Dec. 3, 2024, City
Council meeting.
BACKGROUND: During the second special session of the 88th Legislature, the passing of Senate Bill 2 changed
the terms and composition of the board. The DCAD Board of Directors will increase from a five-
member board to a nine-member board. The new board composition will include five voting members and three publicly elected members. No changes were made to the nomination and appointment process for taxing jurisdictions. Board members will now serve staggered four -year terms instead of two-year terms for all.
DISCUSSION: The number of votes a taxing unit has is determined by their proportional share of the total levy in the district from the prior tax year. There is a total of 5,000 votes throughout the district. Current allocated votes for the City of Denton are being calculated by DCAD. The five
candidates who receive the largest cumulative vote totals are appointed to the board.

SUBJECT: Request for Nominations for DCAD Board of Directors

It is time again for the Denton County taxing entities to select five individuals to serve as the
DCAD Board of Directors. Each jurisdiction may nominate by written resolution up to five
people to be considered for the DCAD Board of Directors. According to Section 6.03 of the
Texas Property Tax Code, it is the chief appraiser’s responsibility to initiate this process, which is
the purpose of this memo.
Please note that a chief appraiser does not have the authority, or the duty, to investigate or
judge the qualifications of the nominees. Further, a chief appraiser cannot extend the deadline
for receiving nominations.
Please return your nomination(s) by written resolution before October 15, 2024.
Please provide the name and address of the nominee(s). The District will send a questionnaire
to each nominee requesting additional information to assist the entities in the voting process.
CALENDAR FOR APPOINTMENTS:
1. Before October 1st - Each jurisdiction will be advised of the number of votes they are entitled
to cast in the election of the board of directors (those numbers are included in this email).
2. Before October 15th - The governing body of each jurisdiction may nominate by written
resolution up to five candidate(s) to the DCAD Board of Directors. (The number of votes that
each jurisdiction has is not relevant in the initial nomination phase.)
3. Before October 30th - A comprehensive list of the nominees will be compiled and this
information will be sent to the taxing jurisdictions in the form of a ballot.
4. Before December 15th - The taxing jurisdictions choose by written resolution the candidate,
or candidates, of their choice. The jurisdictions then submit the names of their candidates and
the votes they cast for each candidate before the December 15th deadline.
5. Before December 31st – A tabulation of the votes will be forwarded to the jurisdictions. The
five candidates that have received the most votes become the Board of Directors as of January
1st.

SELECTING A NOMINEE
AUTHORITATIVE GUIDELINES - The selection process is set forth in Section 6.03 of the
Property Tax Code. This process is not an “election” governed by the Texas Election Code. It is
an independent procedure unique to the property tax system.
ELIGIBILITY - An appraisal district director must reside in Denton County for at least two years
immediately preceding the date he or she takes office. Most residents are eligible to serve as a
director. An individual that is serving on the governing body of a city, county, or school district is
eligible to serve as an appraisal district’s director.
An employee of a taxing unit served by the appraisal district is not eligible to serve as a director.
However, if the employee is an elected official, he or she is eligible to serve.
A statute relevant to the Board selection process prohibits nepotism and conflict of interest for
appraisal district directors and chief appraisers. In summary, the law states that:
.......... “a person may not serve as director if closely related to anyone in the appraisal district or
if related to anyone who represents owners in the district, or if the person has an interest in a
business that contracts with the district or a taxing unit. A chief appraiser may not employ
someone closely related to a member of the board of directors”.
TERM OF OFFICE – Section 5.13(d) of SB2 Second Special Session 88th Legislature redefined
the terms for appointed positions on the appraisal district board of directors. For the term of
office beginning on January 1, 2025, officers will serve either a one or a three year term. All
terms thereafter will be 4 year staggered terms. Term length each appointed position will be
determined by drawing during the first calendar meeting of 2025.
FREQUENCY OF MEETINGS - The applicable statutes require the board of directors to meet a
minimum of once each calendar quarter.
