Dear Mayor Brock:
The Flood Insurance Rate Map (FIRM) for Denton County, Texas and Incorporated Areas, which includes the City of Denton, has been revised by this Letter of Map Revision (LOMR) to reflect
the Regency Oaks project. The subject area is located along an unnamed tributary to Hickory Creek, from Hobson Lane to approximately 1,980 feet downstream of Hobson Lane, and the project
involves channelization, the placement of fill, and the construction of a culvert at Regency Court. This revision was initiated by Dale Hoelting, P.E., C.F.M., of the
City of Denton, in a letter dated March 12, 2002. We issued a conditional LOMR for this project on January 9, 1998.
We received hydrologic and hydraulic analyses, certified topographic work map, an annotated FIRM, certification that the fill placed is “reasonably safe from flooding”, maintenance agreement,
property owner notification and acceptance, community acceptance, and all applicable forms to reflect the revised conditions, prepared by Greg Edwards, P.E., of Surveyors and Engineers
of North Texas, in support of this revision.
We received all of the data required to perform a technical review of the LOMR request as of May 1, 2002.
Based on our review of the submitted data, we are issuing this LOMR to reflect the Regency Oaks project, which involves channelization, the placement of fill, and the construction of
a culvert at Regency Court. This LOMR revises the 1% annual chance (100-year) floodplain (Zone A) along the unnamed tributary to Hickory Creek, as shown on the enclosed annotated portions
of Denton County, Texas and Incorporated Areas, FIRM number 48121C0370 E, dated April 2, 1997. A maximum increase in the 1% annual chance floodplain of 200 feet occurs approximately
1,320 feet downstream of Hobson Lane, and a maximum decrease in the
1% annual chance of 365 feet occurs approximately 1,350 feet downstream of Hobson Lane.
This revision will become effective as of the date of this letter.
We based this determination on the 1% annual chance discharges computed in the submitted hydrologic model. Future development of projects upstream could cause increased discharges,
which could cause increased flood hazards. A comprehensive restudy of your community’s flood hazards would consider the cumulative effects of development on discharges and, therefore,
could establish greater flood hazards in this area.
This LOMR is based on minimum floodplain management criteria established under the National Flood Insurance Program (NFIP). Your community is responsible for approving all floodplain
development and for ensuring all necessary permits required by Federal or State law have been received. State, county, and community officials, based on knowledge of local conditions
and in the interest of safety, may set higher standards for construction in the Special Flood Hazard Area (SFHA). If the State, county, or community has adopted more restrictive or
comprehensive floodplain management criteria, these criteria take precedence over the minimum NFIP criteria.
This revision has met our criteria for removing an area from the 1% annual chance floodplain to reflect the placement of fill. The community must ensure that any structures placed within
the subject area be constructed such that they are “reasonably safe from flooding.” “Reasonably safe from flooding” means base flood waters will not inundate the land or damage structures
to be removed from the SFHA and that any subsurface waters related to the base flood will not damage existing or proposed buildings. The community and engineers should review and use
FEMA Technical Bulletin 1001, Ensuring that Structures Built on Fill In or Near Special Flood Hazard Areas are Reasonably Safe From Flooding, which may be downloaded directly from
the Federal Emergency Management Agency (FEMA) website at http://www.fema.gov/mit/tb1001.pdf.
NFIP regulations Subparagraph 60.3(b)(7) requires communities to ensure that the floodcarrying capacity within the altered or relocated portion of any watercourse is maintained. This
provision is incorporated into your community’s existing floodplain management ordinances; therefore, responsibility for maintenance of the modified channel and culvert rests with your
community. We may request that your community submit a description and schedule of the channel and culvert maintenance activities.
We will not print and distribute this LOMR to primary users, such as local insurance agents or mortgage lenders; instead, the community will serve as a repository for the new data.
We encourage you to disseminate the information in this LOMR by preparing, for publication in your community’s newspaper, a news release that describes the revision and explains how
your community will provide the data and help interpret the NFIP maps. In that way, interested persons, such as property owners, insurance agents, and mortgage lenders, can benefit
from the information.
Use the map panel listed above and revised by this letter for flood insurance policies and renewals issued in your community.
We have enclosed an updated version of a document titled List of Current Flood Insurance Study Data, which includes this letter, to help your community maintain all information for floodplain
management and flood insurance. If any of the items in that document are not filed in your community’s map repository, please contact the FEMA Map Assistance Center at the telephone
number listed below for information on how to obtain those items.
We have made this determination pursuant to Section 206 of the Flood Disaster Protection Act of 1973 (P.L. 93234) and in accordance with the National Flood Insurance Act of 1968, as
amended (Title XIII of the Housing and Urban Development Act of 1968, P.L. 90448), 42 U.S.C. 40014128, and 44 CFR Part 65. Pursuant to Section 1361 of the National Flood Insurance
Act of 1968, as amended, communities participating in the NFIP are required to adopt and enforce floodplain management ordinances that meet or exceed minimum NFIP criteria. These criteria,
including adoption of the FIRM, and the modifications made by this LOMR, are the minimum requirements for continued NFIP participation and do not supersede more stringent State or local
requirements to which the regulations apply.

We received a check in the amount of $4,000 from Mr. Arthur V. King to defray the cost of the technical review for this Letter of Map Revision (LOMR) request. Since the amount written
on the check is greater than the requested review fee of $3,400, we are returning this check in a separate cover.
FEMA has implemented a procedure to recover costs associated with reviewing and processing requests for modifications to published flood information and maps. Effective June 1, 2000,
FEMA revised that fee schedule. A copy of the notice summarizing the current fee schedule, which was published in the Federal Register, is enclosed for your information. In accordance
with this schedule, the fee for your request is $3,400 and must be submitted before we can continue processing your request. Payment of this fee must be made in the form of a check
or money order, made payable in U.S. funds to the National Flood Insurance Program, or credit card payment. For identification purposes, the case number referenced above must be included
on the check or money order. We will not perform a detailed technical review of your request until payment is received.

Please submit documentation of individual legal notices that were sent to property owners who are adversely impacted by any widening and/or shifting of the 1% annual chance floodplain
for the unnamed Tributary to Hickory Creek.
If you submit notification and acceptance from the adversely impacted property owners, FEMA can issue a LOMR effective the date of issuance.
If you submit notification of, but not acceptance by, the adversely impacted property owners, FEMA may issue a LOMR effective three to six months after the date of issuance.
If you submit neither notification of nor acceptance by the adversely impacted property owners, FEMA can either defer the map change, if minor, or revise the map by reissuance rather
than by letter. Reissued maps are typically effective nine to twelve months after issuance of a preliminary map.
Please send the required data to us at the address shown at the bottom of the first page. If the required item is not submitted within 90 days of the date of this letter, FEMA will
treat any subsequent request as an original submittal, and it will be subject to all submittal/payment procedures.
If you are unable to meet the 90day deadline for submittal of required items and would like FEMA to continue processing your request, you must request an extension of the deadline.
This request must be submitted to us in writing and must provide (1) the reason why the data cannot be submitted within the requested timeframe and (2) a new date for the submittal
of the data. FEMA receives a very large volume of requests and cannot maintain inactive requests for an indefinite period of time. Therefore, the fees will be forfeited for any request
for which neither the requested data nor a written extension request is received within 90 days.

locations between Cross Sections 1842 and 2465 compared with the effective conditions. These increase are not shown on the submitted annotated FIRM. Please resubmit the annotated
FIRM to show these increases in the 1% annual chance floodplain width consistent with the submitted work map.

Mr. Hoelting,
I have being reviewing the hydraulic models and work maps for the Regency Oaks project and discovered the following – the annotated FIRM for the project does not match the topographic
map submitted by Mr. Greg Edwards. I contacted Mr. Edwards and discussed this matter with him yesterday. He told me that the work map had been done using more detailed data; therefore
it was more accurate than the annotated FIRM. The main issue is that there are floodplain increases in 2 areas, which are not indicated on the annotated FIRM. I have re-done the annotated
FIRM, showing approximately where the increases are located (it is included in this fax).
Mr. Edwards thinks that the 2nd increase is on the King’s property, and since they are aware of it, there would be no property owner notification required from them. The 1st increase
though, seems to be out of their property, so a letter notifying the owners of that land is required. Mr. Edwards will be re-doing the annotated FIRM to include these floodplain increases.
I contacted Ms. Becky King yesterday and explained these floodplain increases to her. Ms. King expressed that she would like this issue and LOMR resolved and approved as soon as possible,
so I am going to work with Mr. Edwards to resolve the map issues. I am sending you this fax to try to obtain the property owner notification letter from you as soon as possible, so
I can go ahead and approve this case.

4/11/02 – I gave Mr. Edwards a call regarding the annotated FIRM and the work map. The annotated FIRM seems to reflect only decreases in the floodplain, while the work map shows two
areas where the floodplain increases. I discussed this with Mr. Edwards, who tried to locate them on the work map. The locations of the increases are approximate, so it is not certain
that they are contained on the King’s property. The 1st increase seems to be outside of their property, while the second in on their property.
Once Mr. Edwards and I had located the increases on the annotated FIRM, it was agreed that he would resubmit a more accurate FIRM and contact the Kings and Mr. Hoelting to try to obtain
property owner notification from the Kings and 2nd property owners. I told him that I would contact Becky King and explain this matter to her, as well as fax her a copy of the more
accurate annotated FIRM. I also told Mr. Edwards that I would check the rest of the work map to make sure that it was correct and then mail him a letter by the end of next week.
4/17/02 – Mr. Edwards called me back to ask if I was done with the technical review and I told him that I was and had a few discrepancies between the floodplain widths on the work map,
and the HEC-RAS widths. He explained that there were a few ineffective flow areas located near those specific cross-sections, he helped me to locate those and we resolved the problem
swiftly. I told him that the 316-AD was ready to be sent out and I just requested that he resubmit a new annotated FIRM, showing the increases in floodplain widths and their location.
He told me that the 2nd property owners had been contacted and had drafter up a property owner notification notice themselves. They were aware of all the changes to be made on their
property, and so those letters would be mailed out to me along with the new annotated FIRM.

Ms. King called me with regards to the 316-ACK and 316-RETURN. I explained to her that we do not deposit checks, which are written for an amount greater than what is required. It is
much simpler and quicker to just write another check and mail it in.
She wanted to know if anything else was required and I asked if she had received the 316-ACK. She wasn’t too sure about that, so I simply let her know that we were looking for property
owner notification. She told me that themselves and 2 other property owners were impacted by the changes.
I told her to contact the community (the 316-ACK was originally sent in to Dale Hoelting, the floodplain administrator) and to have a simple letter sent in, which states that the City
has contacted the owners to make them aware of the changes taking place.

Ms. King,
I tried to return your call yesterday, but your voicemail picked up my
call,
so I am emailing you instead. I looked at the annotated FIRM again and
the
modifications to the floodplain - since none of the 3 property owners
affected by this revision will be taken out of the floodplain
completely, it
is not necessary to get a letter from the community, stating that all
property owners have been notfied. I received a call from Mr. Dale
Hoelting
during lunch time today, and we have agreed to forget about the letter
from
the community.
This being taken care of, the only thing I am missing from your case is
the
fee of $3,400. If you could get that to us as soon as possible, I will
review the technical models and maps, and if everything is good on that
end,
I will go ahead and write up the approval letter for your case.

Dear Mayor Brock:
The Flood Insurance Rate Map (FIRM) for Denton County, Texas and Incorporated Areas, which includes the City of Denton, has been revised by this Letter of Map Revision (LOMR) to reflect
the Regency Oaks project. The subject area is located along an unnamed tributary to Hickory Creek, from Hobson Lane to approximately 1,980 feet downstream of Hobson Lane, and the project
involves channelization, the placement of fill, and the construction of a culvert at Regency Court. This revision was initiated by Dale Hoelting, P.E., C.F.M., of the
City of Denton, in a letter dated March 12, 2002. We issued a conditional LOMR for this project on January 9, 1998.
We received hydrologic and hydraulic analyses, certified topographic work map, an annotated FIRM, certification that the fill placed is “reasonably safe from flooding”, maintenance agreement,
property owner notification and acceptance, community acceptance, and all applicable forms to reflect the revised conditions, prepared by Greg Edwards, P.E., of Surveyors and Engineers
of North Texas, in support of this revision.
We received all of the data required to perform a technical review of the LOMR request as of May 1, 2002.
Based on our review of the submitted data, we are issuing this LOMR to reflect the Regency Oaks project, which involves channelization, the placement of fill, and the construction of
a culvert at Regency Court. This LOMR revises the 1% annual chance (100-year) floodplain (Zone A) along the unnamed tributary to Hickory Creek, as shown on the enclosed annotated portions
of Denton County, Texas and Incorporated Areas, FIRM number 48121C0370 E, dated April 2, 1997. A maximum increase in the 1% annual chance floodplain of 200 feet occurs approximately
1,320 feet downstream of Hobson Lane, and a maximum decrease in the
1% annual chance of 365 feet occurs approximately 1,350 feet downstream of Hobson Lane.
This revision will become effective as of the date of this letter.
We based this determination on the 1% annual chance discharges computed in the submitted hydrologic model. Future development of projects upstream could cause increased discharges,
which could cause increased flood hazards. A comprehensive restudy of your community’s flood hazards would consider the cumulative effects of development on discharges and, therefore,
could establish greater flood hazards in this area.
This LOMR is based on minimum floodplain management criteria established under the National Flood Insurance Program (NFIP). Your community is responsible for approving all floodplain
development and for ensuring all necessary permits required by Federal or State law have been received. State, county, and community officials, based on knowledge of local conditions
and in the interest of safety, may set higher standards for construction in the Special Flood Hazard Area (SFHA). If the State, county, or community has adopted more restrictive or
comprehensive floodplain management criteria, these criteria take precedence over the minimum NFIP criteria.
This revision has met our criteria for removing an area from the 1% annual chance floodplain to reflect the placement of fill. The community must ensure that any structures placed within
the subject area be constructed such that they are “reasonably safe from flooding.” “Reasonably safe from flooding” means base flood waters will not inundate the land or damage structures
to be removed from the SFHA and that any subsurface waters related to the base flood will not damage existing or proposed buildings. The community and engineers should review and use
FEMA Technical Bulletin 1001, Ensuring that Structures Built on Fill In or Near Special Flood Hazard Areas are Reasonably Safe From Flooding, which may be downloaded directly from
the Federal Emergency Management Agency (FEMA) website at http://www.fema.gov/mit/tb1001.pdf.
NFIP regulations Subparagraph 60.3(b)(7) requires communities to ensure that the floodcarrying capacity within the altered or relocated portion of any watercourse is maintained. This
provision is incorporated into your community’s existing floodplain management ordinances; therefore, responsibility for maintenance of the modified channel and culvert rests with your
community. We may request that your community submit a description and schedule of the channel and culvert maintenance activities.
We will not print and distribute this LOMR to primary users, such as local insurance agents or mortgage lenders; instead, the community will serve as a repository for the new data.
We encourage you to disseminate the information in this LOMR by preparing, for publication in your community’s newspaper, a news release that describes the revision and explains how
your community will provide the data and help interpret the NFIP maps. In that way, interested persons, such as property owners, insurance agents, and mortgage lenders, can benefit
from the information.
Use the map panel listed above and revised by this letter for flood insurance policies and renewals issued in your community.
We have enclosed an updated version of a document titled List of Current Flood Insurance Study Data, which includes this letter, to help your community maintain all information for floodplain
management and flood insurance. If any of the items in that document are not filed in your community’s map repository, please contact the FEMA Map Assistance Center at the telephone
number listed below for information on how to obtain those items.
We have made this determination pursuant to Section 206 of the Flood Disaster Protection Act of 1973 (P.L. 93234) and in accordance with the National Flood Insurance Act of 1968, as
amended (Title XIII of the Housing and Urban Development Act of 1968, P.L. 90448), 42 U.S.C. 40014128, and 44 CFR Part 65. Pursuant to Section 1361 of the National Flood Insurance
Act of 1968, as amended, communities participating in the NFIP are required to adopt and enforce floodplain management ordinances that meet or exceed minimum NFIP criteria. These criteria,
including adoption of the FIRM, and the modifications made by this LOMR, are the minimum requirements for continued NFIP participation and do not supersede more stringent State or local
requirements to which the regulations apply.

We received a check in the amount of $4,000 from Mr. Arthur V. King to defray the cost of the technical review for this Letter of Map Revision (LOMR) request. Since the amount written
on the check is greater than the requested review fee of $3,400, we are returning this check in a separate cover.
FEMA has implemented a procedure to recover costs associated with reviewing and processing requests for modifications to published flood information and maps. Effective June 1, 2000,
FEMA revised that fee schedule. A copy of the notice summarizing the current fee schedule, which was published in the Federal Register, is enclosed for your information. In accordance
with this schedule, the fee for your request is $3,400 and must be submitted before we can continue processing your request. Payment of this fee must be made in the form of a check
or money order, made payable in U.S. funds to the National Flood Insurance Program, or credit card payment. For identification purposes, the case number referenced above must be included

Please submit documentation of individual legal notices that were sent to property owners who are adversely impacted by any widening and/or shifting of the 1% annual chance floodplain
for the unnamed Tributary to Hickory Creek.
If you submit notification and acceptance from the adversely impacted property owners, FEMA can issue a LOMR effective the date of issuance.
If you submit notification of, but not acceptance by, the adversely impacted property owners, FEMA may issue a LOMR effective three to six months after the date of issuance.
If you submit neither notification of nor acceptance by the adversely impacted property owners, FEMA can either defer the map change, if minor, or revise the map by reissuance rather
than by letter. Reissued maps are typically effective nine to twelve months after issuance of a preliminary map.

treat any subsequent request as an original submittal, and it will be subject to all submittal/payment procedures.
If you are unable to meet the 90day deadline for submittal of required items and would like FEMA to continue processing your request, you must request an extension of the deadline.
This request must be submitted to us in writing and must provide (1) the reason why the data cannot be submitted within the requested timeframe and (2) a new date for the submittal
of the data. FEMA receives a very large volume of requests and cannot maintain inactive requests for an indefinite period of time. Therefore, the fees will be forfeited for any request
for which neither the requested data nor a written extension request is received within 90 days.

Mr. Hoelting,
I have being reviewing the hydraulic models and work maps for the Regency Oaks project and discovered the following – the annotated FIRM for the project does not match the topographic
map submitted by Mr. Greg Edwards. I contacted Mr. Edwards and discussed this matter with him yesterday. He told me that the work map had been done using more detailed data; therefore
it was more accurate than the annotated FIRM. The main issue is that there are floodplain increases in 2 areas, which are not indicated on the annotated FIRM. I have re-done the annotated
FIRM, showing approximately where the increases are located (it is included in this fax).
Mr. Edwards thinks that the 2nd increase is on the King’s property, and since they are aware of it, there would be no property owner notification required from them. The 1st increase
though, seems to be out of their property, so a letter notifying the owners of that land is required. Mr. Edwards will be re-doing the annotated FIRM to include these floodplain increases.
I contacted Ms. Becky King yesterday and explained these floodplain increases to her. Ms. King expressed that she would like this issue and LOMR resolved and approved as soon as possible,
so I am going to work with Mr. Edwards to resolve the map issues. I am sending you this fax to try to obtain the property owner notification letter from you as soon as possible, so
I can go ahead and approve this case.

4/11/02 – I gave Mr. Edwards a call regarding the annotated FIRM and the work map. The annotated FIRM seems to reflect only decreases in the floodplain, while the work map shows two
areas where the floodplain increases. I discussed this with Mr. Edwards, who tried to locate them on the work map. The locations of the increases are approximate, so it is not certain
that they are contained on the King’s property. The 1st increase seems to be outside of their property, while the second in on their property.
Once Mr. Edwards and I had located the increases on the annotated FIRM, it was agreed that he would resubmit a more accurate FIRM and contact the Kings and Mr. Hoelting to try to obtain
property owner notification from the Kings and 2nd property owners. I told him that I would contact Becky King and explain this matter to her, as well as fax her a copy of the more
accurate annotated FIRM. I also told Mr. Edwards that I would check the rest of the work map to make sure that it was correct and then mail him a letter by the end of next week.
4/17/02 – Mr. Edwards called me back to ask if I was done with the technical review and I told him that I was and had a few discrepancies between the floodplain widths on the work map,
and the HEC-RAS widths. He explained that there were a few ineffective flow areas located near those specific cross-sections, he helped me to locate those and we resolved the problem
swiftly. I told him that the 316-AD was ready to be sent out and I just requested that he resubmit a new annotated FIRM, showing the increases in floodplain widths and their location.
He told me that the 2nd property owners had been contacted and had drafter up a property owner notification notice themselves. They were aware of all the changes to be made on their
property, and so those letters would be mailed out to me along with the new annotated FIRM.

Ms. King called me with regards to the 316-ACK and 316-RETURN. I explained to her that we do not deposit checks, which are written for an amount greater than what is required. It is
much simpler and quicker to just write another check and mail it in.
She wanted to know if anything else was required and I asked if she had received the 316-ACK. She wasn’t too sure about that, so I simply let her know that we were looking for property
owner notification. She told me that themselves and 2 other property owners were impacted by the changes.
I told her to contact the community (the 316-ACK was originally sent in to Dale Hoelting, the floodplain administrator) and to have a simple letter sent in, which states that the City
has contacted the owners to make them aware of the changes taking place.

Ms. King,
I tried to return your call yesterday, but your voicemail picked up my
call,
so I am emailing you instead. I looked at the annotated FIRM again and
the
modifications to the floodplain - since none of the 3 property owners
affected by this revision will be taken out of the floodplain
completely, it
is not necessary to get a letter from the community, stating that all
property owners have been notfied. I received a call from Mr. Dale
Hoelting
during lunch time today, and we have agreed to forget about the letter
from
the community.
This being taken care of, the only thing I am missing from your case is
the
fee of $3,400. If you could get that to us as soon as possible, I will
review the technical models and maps, and if everything is good on that
end,
I will go ahead and write up the approval letter for your case.
