Based on LOMR-F application for 201 W. Sycamore Steet Denton by Allison Engineering Group (elevation form dated August 15 2023). Together with <the following items provided April 25,
2023, FIRM with property location indicated, Property Deed, Exhibit A (metes and bounds description) dated August 15, 2023, updated BFE exhibit representing survey collected 7-24-23,
unsigned.
COMMENTS
Satisfied: (The provided Exhibit A includes a description of “Approximate Area Above BFE” that is described as “preliminary and approximate” and “not a legal description”. If this
is the case, what is actually being removed from the floodplain? <While it is understood that this is not a “legal description” from a property ownership perspective, the boundary must
be usable to determine whether any future structure will be located in or out of the floodplain. The boundary will be legally binding relative to regulation of the floodplain.< The
LOMR-F form states “A certified <metes and bounds description and map of the area to be removed, certified by a licensed land surveyor or registered professional engineer, are required”.
As a certified boundary it must be reproducible in the field or GIS and tied to the property boundary by satisfying the following: <
Satisfied: <If the first point described is not on the boundary of the area being removed, then the description should begin with “commencing” and give direction to the “point of beginning”.
The last measurement then returns “to the point of beginning”.
Satisfied: <Indicate if the TMB X-Cut used as a point of beginning (actually “point of commencement”) on the BFE exhibit is the X-Cut described as the southeast property in the property
deed. If not provide other tie into the property boundary.
Satisfied: <If it is not known if the bearings on the metes and bounds description are consistent with the bearings on the property deed, provide tie into two property corners.
Satisfied: <The boundary does not have to follow the exact point at which the ground reaches the flood elevation at every point, but rather the engineer/surveyor is certifying that the
lowest elevation within this certified boundary is at or above the base flood elevation. <
Satisfied: <Use of MT1 Form 2 (“Elevation Form” - Lowest Lot Elevation* field) is more appropriate for removal of a portion of a property rather than the Elevation Certificate provided
which is oriented to situations where a structure with a LAG & HAG is involved. <We suggest that usage of multiple lines may be required (one at top end and one at bottom minimum) due
to varying flood elevation over the area to be removed. We do not know if two lines will be adequate for FEMA or if more and/or every point on the boundary will be required by FEMA.
The engineer may use his judgement on <amount of data to be provided.
Satisfied: <Certify the boundary with an engineer’s or surveyor’s signature and seal.
Satisfied: <Remove references on the BFE exhibit to flood elevations being “approximate”. The submittal is certifying that the elevations are being appropriately interpreted and interpolated,
in the engineer’s/surveyor’s judgement, from the regulatory FEMA data. <MT-1, Item 3 indicates that only a portion of the property will be removed from the floodplain. Documents do
not include a metes and bounds description (bearing and distance description) of the boundary to be removed from the floodplain.

Copy of the effective FIRM panel on which property has been accurately plotted.
Recorded Subdivision Plat <or> Property Deed with Recorder’s stamp (accompanied by tax map).
No further information is required: <Informational: The shape of the parcel does not resemble the shape of 201 W Sycamore Street as shown in GIS.
No further information is required: <Informational: After approval, the City’s signature on the community acknowledgement form will be its certification that the property is, and will
remain, reasonably save from flooding. Therefore, any future structures on the property must comply with the City’s building protections standards of a lowest floor elevation 18” above
the fully developed flood elevation or 30” above the FEMA regulatory flood elevation.
