05/04/25 Mayor Hudspeth Work Session B 25-840 In the future I think we should have a standing rule to take a position With Council direction,the City can take a position on all bills affecting city revenues.The majority of bills that impact city
on any bill that affects a city revenue stream(HB 3964).Please revenue fall under the City's legislative program.There may be outliers and it may not always be clear what position the
provide status and viability updates on..HB 3964,SB3'House City should take.For example,the City must balance what is in it's best interest and in the best interest of it's residents.

HB 3964 by Rep.Vasut would eliminate the ability of cities to regulate nuisance claims.The bill was left pending in House
Committee on April 23,and has not been brought up for a vote.The longer a bill sits pending in committee,especially at
this stage of session,the less likely it is to pass.
SB 3 by Senator Perry seeks to regulate consumable hemp and hemp-derived cannabinoids.The bill passed by the Senate
on March 19 would ban the sale of all consumable hemp products that contain THC.The bill was recently heard and
amended in the House State Affairs Committee.The House Committee approved changes that would tighten the regulation
of hemp products,but still allow for the sale of edibles,drinks,and low-dose smokable hemp.The bill,as amended by the
House Committee,will now be considered by the Calendars Committee for placement on the House Floor for a vote.It is
2 unclear whether the changes made by the House Committee will be acceptable to the bill author or Lt.Governor,who have
been pursuing a full ban of THC products.
SB 3016 by Senator Creighton would preempt city and county regulation of land use,structures,businesses,municipal
boundaries,and annexation.The bill would extend the subject matter preemption from last session's HB 2127,which has
been challenged in the courts. It was voted out of Senate Committee on April 28,and has been placed on the Senate Floor
Intent Calendar for May 5.With such a late start,it is not likely to be a priority to House or Senate leadership and it would
be difficult to get through both Chambers with enough time to pass.
SB 1824 by Senator Schwertner seeks to address the issues of long term land-use,decommissioning and Battery Energy
Storage System(BESS)accountability to the landowners by establishing a statewide comprehensive legal framework for
agreements between non-utility BESS operators and landowners that clarifies developer responsibilities for proper
recycling and disposal of components,requires grantees to provide financial assurances,and enforces environmental
protections to safeguard landowners and communities.The bill was heard in Senate Committee on March 27 and has been
left pending in committee.The House Companion Bill,HB 3809,has passed out of the House and is now waiting for the
Senate to act.Staff have not heard of any opposition to this bill or any reason that it would not pass.
