"Grantee", for the purpose of erecting a public slope and retaining wall Improvements, together with the customary uses
attendant thereto, including the right to enter upon and to pass and repass over and along said easement, the right of
ingress and egress and deposit tolls, implements and other materials thereon by Grantee, Its officers, agents, and
employees and by any contractor, his agents and employees engages by Grantee, whenever, wherever necessary for the
purposes for construction, maintenance, repair, replacement, removal or enlargement of the public slope and retaining wall
improvements within the 5' Slope and Wall Easement Area; provided however, Grantee shall repair and restore and
damage to the remaining property caused by the construction of the retaining wall improvements.
The Grantor reserves the continued use of the surface of said real property, subject to the condition that the erecting of
buildings, masonry walls, masonry fences, and other structures, the planting or growing of trees or shrubs, the changing of
the surface grade, the installation of privately -owned pipelines, the construction or installation of any object below the
elevation of the top of the adjacent retaining wall, or the construction or installation of any object deeper than three (3) feet
below the finish surface grade shall be prohibited unless written permission Is first obtained from the Grantee, provided that
any underground utility lines existing as of the date hereof and located within the 5' Slope and Wall Easement may be
maintained in place and repaired and replaced as necessary.
