AN ORDINANCE OF THE CITY OF DENTON, TEXAS PROVIDING FOR THE
SCHEDULE OF MISCELLANEOUS FEES, DEPOSITS, BILLINGS AND PROCEDURES
FOR ADMINISTRATIVE SERVICES TO CITY CUSTOMERS AND TAXPAYERS
CONTAINED IN ORDINANCE NO 98-265, PROVIDING FOR A REPEALER, PROVIDING
FOR A SEVERABILITY CLAUSE, AND PROVIDING FOR AN EFFECTIVE DATE
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS
SECTION 1 That the schedule of fees and charges for general utility services as
generally ,provided for in Chapter 26 of the Code of Ordinances, and for services to other City of
Denton customers and taxpayers, are hereby established as follows

INSUFFICIENT FUND CHECK HANDLING CHARGE
APPLICATION
Applicable when a customer's or taxpayer's check for payment of fees, fines, court costs, taxes,
utilities, or other charges has been dishonored by the maker's bank and returned to the City of
Denton unpmd

SERVICE DEPOSITS
APPLICATION
Applicable when a customer requests utlhty service for the first time in the City of Denton
service area and does not have 12 months of good credit standing wxth Denton or another utfixty
system for the type of service requested, or does not have a co-signer with 12 months of good
credit standing with Denton or another electric utility system
FEE
Residential Customer
$150 00 or an amount equal to 1/6 of the last
12 months of billing at the service location
If utility service is disconnected for non-
payment, then the customer will be required
to pay a deposit sum equal to 1/6 of the last
12 months of billing
Commercial Customer
$300 00 or an amount equal to 1/6 of the last
12 months of billing at the service location,
whichever is greater
Deposits will earn interest for the customer The rate of interest will be adjusted semi-annually
to equal the interest rate of a one year United States Treasury Note on October 1 and April 1 of
each year If refund of deposit is made within thirty (30) days of receipt of deposit, no interest
payment will be made If the City retmns the deposit more than thirty (30) days, payment of
interest shall be made retroactive to the date the deposit was paid
A Payment of the interest to the customer shall be made at the time the deposit is returned
or credited to the customer's account

B The depostt shall cease to earn ~nterest on the date it is returned or credited to the
customer's account
INTEREST EARNED ON CONTRACT RETAINAGE
Contract retalnage will earn interest for the contractor as prowded by TEX REV CIV STAT
ANN Article 6252, Sec 5b (Vernon Supp 1992) The rate of ~nterest will be adjusted sem~-
annually to equal the ~nterest rate of a one year Umted States Treasury Note on October 1 and
April 1 of each year Payment of the interest shall be made at the t~me the retmnage is prod to the
contractor

SECTION 2 That all ordinances or parts of ordinances ~n force when the provisions of
th~s ordinance became effective whmh are inconsistent, or m conflict w~th the terms or
prows~ons contmned m th~s ordinance are hereby repealed to the extent of any such conflict
SECTION 3 That ff any section, subsection, paragraph, sentence, clause, phrase or
word in th~s ordinance, or apphcatlon thereof to any person or c~rcumstances ~s held invalid by
any court of competent jurisdiction, such holding shall not affect the vahd~ty of the remmmng
portions of this ordinance, and the Cay Council of the C~ty of Denton, Texas, hereby declares ~t
would have enacted such mmmmng portions despite any such mvahd~ty
SECTION 4 That this ordinance shall become effective, charged, and apphed to all
services occumng on and after October 1, 1999, and a copy of said fees and charges shall be
malntmned on file ~n the office of the C~ty Secretary
