AUTHORIZED BY CHAPTER 24 OF THE CODE OF ORDINANCES OF THE CITY OF DENTON, TEXAS, PROVIDING THAT THE PROVISIONS OF SECTIONS 26-3, 26-4, 26-5, 26-7, 26-8(a), AND 26-9 OF THE CODE OF ORDINANCES OF THE CITY OF DENTON, TEXAS SHALL EXPRESSLY APPLY TO CITY OF DENTON SOLID WASTE SERVICE, AMENDING THE CHARGES FOR INACCESSIBLE AND UNSERVICEABLE CONTAINERS, AMENDING THE CONTAINER LOCK INSTALLATION AND REMOVAL CHARGE, AMENDING THE BRUSH FEE CHARGE FOR BRUSH BROUGHT TO THE CITY OF DENTON LANDFILL, PROVIDING FOR A REPEALER, PROVIDING FOR A SEVERABILITY CLAUSE, AND PROVIDING FOR AN EFFECTIVE DATE THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS SECTION 1 That the charges for sohd waste collection services as authorized by Section 24-42(b) of Article II, Section 24-66 of Article III and Section 24-4 of Article I of Chapter 24, and by Section 32-90 of Arhcle IV of Chapter 32 of the Code of Ordinances of the C~ty of Denton, Texas, are hereby estabhshed as follows SOLID WASTE RATE SCHEDULES PAGE SWR Resldenhal Sohd Waste Collection Service 2 SWC Commercml and Institutional Sohd Waste Collection Servme 3 SWL Sanitary Landfill Use 8 SCHEDULE SWR RESIDENTIAL SOLID WASTE COLLECTION SERVICE (Effect~ve10/01/99) APPLICATION Applicable to individual family unit sohd waste collection service Individual family unit includes each side of a duplex, each hying unit per subdivided lot, and any unit or living space in winch a person or single family resides MONTHLY RATE $12 90 per 30 days SURCHARGE (State of Texas statutory charge for landfill use) $0 10 per 30 days The surcharge referenced above is hereby authorized to be remitted to the State as required by law, and should the State Legislature increase this fee, such increase is hereby authorized to be charged and collected MINIMUM BILLiNG $13 00 per 30 days OTHER CHARGES There will be no charge for the collection of bagged grass clippings and leaves, or brush and tree limbs winch are cut and stacked in 4' lengths, if the combined gross/leaves/brash total volume is not over eight cubic yards per week Any comblnaUon of grass, leaves, and brash is appropriate One cubic yard of grass or leaves equals 6 bags Bagged grass and leaves over eight cubic yards (48 bags) is charged at 50¢ per addlUonal bag Brash and tree limbs over eight cubic yards are charged at $5 00 per cubic yard for all cubic yards The charge for the A deposit on Open-Tops and Temporary Dumpsters will be charged based upon one-sixth (1/6) of the estimated annual billing amount or service contract A mammum of once per week pickup service as required for putreslble (food) waste containers A charge of $17 50 per cubic yard will be charged for whole trees and stumps delivered to the Denton landfill The charge for the collection of apphances fee, such increase is hereby authorized to be charged and collected LIMITATIONS Landfill permits Issued by the City of Denton prior to the effective date of this ordinance may be redeemed for their face value The customer must pay the difference between the current rate and the face value of the permit The customer is not entitled to a refund if the face value of the permit exceeds the current rate SECTION 2 That the Director of the Sohd Waste Department of the City of Denton is authorized to deny the use of the City of Denton landfill to customers for providing false information regarding the residency of the individual or the origin of the solid waste SECTION 3 That it is in the pubhc interest that the provisions of Sections 26-3, 26-4, 26- 5, 26-7, 26-8(a), and 26-9 of Article I of Chapter 26 of the City of Denton Code of Ordinances shall expressly apply to City of Denton Solid Waste service SECTION 4 That all ordinances or parts of ordinances in force when the provisions of this ordinance became effective which are inconsistent, or in conflict with the terms or provisions contained an this ordinance are hereby repealed to the extent of any such conflict SECTION 5 That if any section, subsection, paragraph, sentence, clause, phrase, or word in this ordinance, or the apphcatlon thereof to any person or under any circumstances ~s held invalid by any court of competent jurisdiction, such holding shall not affect the validity of the remaining portions of this ordinance, and the City Council of the City of Denton, Texas, hereby declares it would have enacted such remaining pomons despite any such invalidity SECTION 6 That this ordinance shall become effective, charged, and applied to all solid waste services rendered on and after October 1, 1999, and a copy of in pertinent part provided under "Other Charges" that "The charge for the collection of apphances is $10 00 per appliance", and WHEREAS, the Commercial and Institutional Sohd Waste Collection Service Schedule (SWC), was attached to and made a part of smd Ordinance, and m pertinent part provided under "Other Charges" that "The charge for the collection of epphances is $10 00 per item", and WHEREAS, the City Council has received information and recommendations from Staff regarding rate structure and related issues regarding the Solid Waste Department service respecting the collection of appliances as well as the collection of appliances contmmng the hazardous substances commonly referred to as "CFC's" [Chlorofluorocarbons] and "PCB's," [Polychlonnated Blphenyls] from both resldentml and commercial Solid Waste Department customers, and WHEREAS, the City Council has determxned that it is appropriate and m the pubhc interest that the above and foregoing Solid Waste Department rotes respecting the collection of appliances should be araended to read as follows Schedule SWR shall hereafter instead provide that "The charge for the collection of appliances contmnmg CFC's or PCB's is $20 00 per appliance" 2 Schedule SWC shall hereafter instead provide that "The charge for the collection of apphanees containing CFC's or PCB's is $20 00 per apphanee," NOW THEREFORE, THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS SECTION 1 That the Schedule of Rates for Solid Waste Department service as provided for in Chapter 24 of the Code of Ordinances of the City of Denton, Texas, and as
