AN ORDINANCE AMENDING THE SCHEDULE OF WATER RATES CONTAINED IN
ORDINANCE NO 98-263 FOR WATER SERVICE, AMENDING THE CHARGES FOR TAP
AND METER FEES, AMENDING THE WHOLESALE RAW WATER SERVICE RATE TO
UTRWD (WRW), AMENDING THE WHOLESALE TREATED WATER RATE TO UTRWD
(WW2), DELETING THE ADOPT-A-SPOT WATER SERVICE RATE (WGA), RECODING
THE OUTSIDE CORPORATE LIMITS RESIDENTIAL WATER SERVICE RATE FROM
(WRE) TO (WRO), RECODING THE OUTSIDE CORPORATE LIMITS COMMERCIAL &

THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS
SECTION 1 That the Rate Schedules for water service as provided for in Chapter 26 of the
Code of Ordinances, are amended to read as follows

MINIMUM BILLING
The minimum monthly billing shall be the sum of the monthly facility charge plus the monthly
subscribed demand rate charge
WATER DEMAND
The demand will be billed on a monthly basis at the Water Demand Rate for the subscribed MGD
water demand level Annual water demand charges will be retroactively adjusted up beginning m
June for each water year, if anytime during the fiscal year the actual peak demand required, as
established by the highest rate of flow controller setting for any one day during the fiscal year, is
greater than the peak demand subscribed during the fiscal year If the actual peak demand has an
~ncreased dally volume between 05 and 10 MGD from the subscribed demand (50,000 - 100,000

FEES FOR INSTALLATIONS NOT LISTED
For the ~nstallation of a tap, loop or meter for which a fee is not specified, the requestor shall pay ~n
advance a 50% deposit based upon the estimated cost of such installation, or similar work, plus an
administrative charge of 20% Upon completion of the installation, the apphcant shall be billed at
actual cost, as determined by the Utlhty Department, plus a 20% administrative charge
The installation charges may be wmved by the utility department for a request to ~nstall taps
exclusively dedmated to fire spnnkler systems

All serwce shall be offered from avmlable faclhtles If a customer service characteristic requires
facflmes and devices which are not normally and readily available at the location at which the
customer requests service, then the Ctty shall provide the service subject to paragraph 2 of this R~der
The total cost of all facflmes necessary to meet the customer's special reqmrements which are
~ncurred by the C~ty shall be subject to a specml contract entered xnto between the C~ty and the
customer Th~s contract shall be s~gned by both partxes prior to the C~ty prowdxng service to the
customer

SECTION 2 That all ordinances or parts of ordinances ~n force when the prows~ons of this
ordinance became effective which are ~nconslstent or in conflict with the terms of proms~ons
contmned in the amended schedule of rates hereby enacted by this ordinance, are hereby repealed to
the extent of any such conflict
SECTION 3 That if any section, subsection, paragraph, sentence, clause, phrase or word in
this ordinance, or apphcation thereof to any person or mrcmnstances is held invalid by any court of
competent jurisdiction, such holding shall not affect the validity of the remaining portions of this
ordinance, and the City Council of the C~ty of Denton, Texas, hereby declares it would have enacted
such remmnlng portions despite any such mvahd~ty
SECTION 4 That the amendment to Schedule WW2 (Wholesale Treated Water Service
To Upper Tnmty Regional Water D~stnct), as herein adopted, is retroactively ratified and approved
effective June 1, 1999
SECTION 5 That the Schedule of Rates herein adopted (except for Schedule WW2 as
provided in Section 4 herein) shall be effective, charged and applied to all water consumption
occtm'lng on or after October 1, 1999, and a copy of smd rates, fees, and charges shall be maintained
on file in the Office of the City Secretary
