1999-310F \SHARED\D~,pTxLGL\Our Documents\Ordmances\99\Tovang Fee Ordinance doc ORDINANCE NO qq --.~/'/~ AN ORDINANCE OF THE CITY OF DENTON, TEXAS AMENDING ARTICLE IV ENTITLED "STOPPING, STANDING, AND PARKING" OF THE MOTOR VEHICLES AND TRAFFIC CHAPTER OF THE CODE OF ORDINANCES OF THE CITY OF DENTON, TEXAS BY AMENDING SECTION 18-104(a) RELATING TO STORAGE AND IMPOUNDMENT FEES FOR IMPOUNDED VEHICLES, AMENDING ARTICLE IV ENTITLED "POLICE-INITIATED TOWING SERVICES" OF THE POLICE CHAPTER OF THE CODE OF ORDINANCES OF THE CITY OF DENTON, TEXAS BY AMENDING SECTION 23-87 TO ESTABLISH A STANDARD TOW FEE AND AN ADDITIONAL CHARGE IF DOLLIES ARE USED, PROVIDING A SEVERABILITY CLAUSE, PROVIDING A SAVINGS CLAUSE, AND DECLARING AN EFFECTIVE DATE WHEREAS, the City Manager, m consultataon with the Police Department, recommended to the City Council an increase m eertmn fees related to the towing of vehicles m the upconung 1999-2000 budget proposal, and WHEREAS, the City Council deems it m the pubhc interest to increase these fees, NOW, THEREFORE, THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS SECTION 1 That Section 18-104(a) of the Code of Ordananees of the City of Denton, Texas is hereby mended to read as follows See. 18-104. Impoundment of standing or parked vehicles. (a) A vehicle removed and towed under the authority of Vemon's Texas Transportation Code Annotated, Seetmn 545 305 shall be kept at the place designated by the pohee department untal appheatlon for redemption is made by the owner or his authorized agent or other person legally entttled to possession of the vehicle The pohce department shall reqmre adequate proof of ownership or proof of the right to possession of the vehicle The fees for towing and storage of vehicles are as follows (1) Towmg Fees Towing fees shall be as established in Chapter 23, Article IV of this Code (2) Storal~e fees Storage fees for any vehicle shall be fifteen dollars ($15 00) per day, or any part ora day, after the first twenty-four hours (3) Impound fee The impoundment fee shall be fifteen dollars ($15 00) (4) Notfficataon fee The notffication fee for any towed vehicles relostered in the State of Texas shall be twenty-five dollars and shall be charged to the registered owner of the vehicle Notification will be sent to the vehicle's last registered owner and all recorded henholders by certified or regostered marl no sooner than twenty-four hours after receipt of the velucle and no later than five days after receipt of the velucle SECTION 2 That Section 23-87 of the Code of Ordinances of the City of Denton, Texas is hereby mended to read as follows See. 23-87 Fees charged; bills The towing fee for any vebacle shall be fifty dollars ($50 00) with an additional twenty-five dollar ($25 00) charge ff dollies are used SECTION 3 That if any prows~on of th~s ordinance or the apphcatlon thereof to any person or mrcumstance is held mvahd, such mvahd~ty shall not affect other provisions or apphcat~ons, and to tins end the provlmons oft/us or&nance are severable SECTION 4 That all provisions of the ordinances of the City of Denton ~n conflict with the provisions of tins orchnance are hereby repealed, and all other provisions of the ordinances of the C~ty of Denton, not in conll~ct w~th the provisions of this ordinance, shall remain m full force and effect SECTION 5 That ttus orchnance shall become effective October 1, 1999, and the City Secretary is hereby d~rected to cause the captmn of t!us ordinance to be pubhshed twice in the Denton Record-Chromcle, the official newspaper of the City of Denton, Texas, w~thm ten (10) days of the date of its passage PASSED PROVED th s the day of , 999 JA~I~LER, MAYOR ATTEST JENNIFER WALTERS, CITY SECRETARY HERBERT L PROUTY, CITY ATTORNEY
