1999-319 FILE REFERENCE FORM 99-319 FILE(S) Date Initials Amendd by Ordinance No. 2005-321 10/18/05 JR O INANCENO AN ORDINANCE OF THE CITY OF DENTON, TEXAS AMENDING ORDINANCE NO 99- 265, TO PROVIDE FOR THE APPROVAL OF A DETAILED PLAN CONTAINING 2 8 ACRES WITHIN THE CONCEPT PLAN FOR PLANNED DEVELOPMENT 173 (PD-173) ZONING DISTRICT CLASSIFICATION AND USE DESIGNATION LOCATED EAST OF FLORENCE ROAD AND APPROXIMATELY 500 FEET NORTH OF CRAWFORD ROAD, PROVIDING A SAVINGS CLAUSE, PROVIDING FOR A PENALTY IN THE MAXIMUM AMOUNT OF $2,000 00 FOR VIOLATIONS THEREOF, AND PROVIDING FOR AN EFFECTIVE DATE (Z- 99-055) WHEREAS, on August 3, 1991, by Ordinance the City Council approved a concept plan for Planned Development 173 (PD-173) Zomng District cncompassmg 2,725 acres of landed, as more particularly described therein, and WHEREAS, Robson Denton Development L L C, has applied for a detailed plan for Planned Development 173 (PD-173) contalmng 2 8 acres of land, and WHEREAS, on August 11, 1999, the Planning and Zomng Commission recommended approval of the detailed plan, and WHEREAS, the City Council finds that the detailed plan will be in compliance with the concept plan, NOW, THEREFORE, THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS ~ That Ordinance No 99-265 approving Planned Development District No 173 is amended by approving the Detailed Plan attached hereto and incorporated herein by reference as Exhtblt "B" for 2 8 acres more particularly described in Exhibit "A", which is attached hereto and mcorporated herein by reference ~ That a copy oftbas ordinance shall be attached to Ordinance No 99-265, showing the amendment herein approved ~ All provisions of Ordinance No 99-265 in conflict with the provisions of this Ordinance are hereby repealed, and all other provisions of Ordinance No 99-265, not in conflict with the provisions of this Ordinance, shall remain in full force and effect ~ That any person violating any provision of this ordinance shall, upon conviction, be fined a sum not exceeding $2,000 00 Each day that a provision of this ordinance is violated shall constitute a separate and distinct offense ~ That this ordinance shall become effective fourteen (14) days from the date of its passage, and the City Secretary is hereby directed to cause the caption of this ordinance to be pubhshed twine in the Denton Record-Chromcle, a daily newspaper pubhshed in the City of Denton, Texas, watlun ten (10) days of the date of its passage ATTEST JENNIFER WALTERS, CITY SECRETARY APPROVED AS TO LEGAL FORM HERBERT L PROUTY, CITY ATTORNEY Page 2 EXHIBIT A DESCRIPTION OF PROPERTY Being a 2 824 acre tract of land situated in the T & P R R Survey, Abstract No. 1501 and the W.L.
