AN ORDINANCE AMENDING CHAPTER 35, "ZONING" OF THE CODE OF
ORDINANCES OF THE CITY OF DENTON, TEXAS, SECTION 35-3, "DEFINITIONS",
SECTION 35-76, "DEFINITIONS AND EXPLANATIONS, AND SECTION 35-301, "OFF-
STREET PARKING AND LOADING", PROVIDING FOR A PENALTY IN THE AMOUNT
OF $2,000 FOR VIOLATIONS THEREOF, PROVIDING FOR A SAVINGS CLAUSE,
PROVIDING FOR A SEVERABILITY CLAUSE, AND PROVIDING FOR AN EFFECTIVE
DATE
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS
SECTION 1, That Artmle I, Section 35-3 "Definlt~ons" of Chapter 35 of the Code of
Ordanances Is amended to read as follows
Section 35-3 Definitions
Apartment means a room or state of rooms ~n a mult~famfly dwelhng or apartmem house
arranged, designed or occupied as place of residence for not more than one (1) family
Bedroom untt means one (1) or more rooms ~n a dormitory, fratem~ty or sorority house designed
and furnished for the occupancy of not more than two (2) students
Dwelhng, one famtly shall have the same meamng and effect as the defimt~ons commned ~n
section 35-76 of this chapter for one-family dwelhng (attached) or one-family dwelling
(detached)
Dwelhng, two famdy shall have the same meaning and effect as the defimtlon commned in
section 35.76 of this chapter for two-family dwelling
SECTION 2 That Article III, Section 35-76 "Defimt~ons and explanations" of Chapter
35 of the Code of Ordinances ~s amended to read as follows
Section 35-76 Deflmtlons and explanations
Group Home means a commumty-based residential famhty prowdlng 24 hour care ~n a protected
living arrangement for not mom than 15 residents plus 1 supervmor per 4 ms,dents This
classfficatlon includes homes for the hand~capped as defined ~n 42 U S C Sec 3602(h)
SECTION 3~ That Article VI, Section 35-301 "Off-street parking and loading" of
Chapter 35 of the Code of Ordinances is amended to read as follows

Section 35-301. Vehicle parking regulations
(c) The mlmmum off-street parking spaces for residential use shall be as follows
(2) Multi family dwellings
a One (1) space per occupant for the mammum allowable occupancy of the
structure as reqmred by the Bmldmg/Flre Code for dormitories, roommghouses,
fraternity or sorority structures or other group housing structures (but not
including "group homes" as defined in th~s chapter)
b One and one-fourth (1 25) spaces for each efficiency umt
c One and one-half(1 50) spaces for each one-bedroom unit
d One (1) space for each bedroom for each two-bedroom or larger unit
e In addition to the reqmrements of thru paragraph, subsections a through d,
each multlfamfly dwelling must provide for visitor's parking one space for every
ten (10) bedrooms, except a multi-family dwelling with less than 50 dwelling
units and comprised exclusively of one-bedroom dwelling units
(d)
(30) Group home One (1) space for each employee and one (1) space for each
ten (10) residents A circular drive that will adequately serve the same traffic
load, approved by the Director of Engineering and Transportation, may be
substituted for the required public parking
SECTION 4 That any person molatlng any provls~on of this ordinance shall, upon
convmtlon, be fined a sum not exceeding $2,000 00 Each day that a provision ofth~s ordinance
is violated shall constitute a separate and distinct offense
SECTION 5, That the provisions of this ordinance as they apply to Sec 35-3, Sec 35-76
and 35-301, Code of Ordinances, City of Denton, Texas, shall govern and control over any
conflicting provmlon of Sec 35-3, Sec 35-76 and Sec 35-301, Code of Ordinances, City of
Denton, Texas, but all the other provisions of Sec 35-3, Sec 35-76 and Sec 35-301 Code of
Orchnances, City of Denton, Texas, not in conflict with such amendments, shall continue in force
and effect
SECTION 6 That if any section, sub-section, paragraph, clause, phrase, or provisions of
this ordinance shall be adjudged invalid or held tmconstltut~onal, the same shall not effect the
validity of this ordinance as a whole or any part or provisions hereof, other than the part so
decided to be invalid or unconstitutional

SECTION 7 That this ordtnance shall become effective fourteen (14) days from the date
of this passage, and the City Secretary ts hereby directed to cause the captton of thts ordmance to
be pubhshed twine tn the Denton Record Chromcle, the officml newspaper of the City of Denton,
Texas, withm ten (10) days of its passage
