USE DESIGNATION TO PLANNED DEVELOPMENT (PD) ZONING DISTRICT
CLASSIFICATION AND USE DESIGNATION FOR A 1 168 ACRE TRACT OF LAND
LOCATED IN THE RIVER OAKS ADDITION (LOT Q, BLOCK 1) IN THE CITY OF
DENTON, DENTON COUNTY, TEXAS, PROVIDING FOR APPROVAL OF A DETAILED
PLAN FOR THE DISTRICT, PROVIDING FOR A PENALTY IN THE MAXIMUM
AMOUNT OF $2,000 00 FOR VIOLATIONS THEREOF, AND PROVIDING FOR AN
EFFECTIVE DATE (Z-99-063)
WHEREAS, Fox and Jacobs Homes has applied for a change in zomng for a 1 168 acre
tract of land from One Family Dwelhng (SF-7) zomng district classfficatlon and use designation
to Planned Development (PD) zomng district classfficatlon and use designation, and
WHEREAS, on September 22, 1999, the Planning and Zoning Commisston
recommended approval of the requested change m zoning, and
WHEREAS, on September 22, 1999, the Planmng and Zoning Commission
recommended approval of the Detmled Plan shown as Exhibit "B", and
WHEREAS, the City Courted finds that the Detmled Plan ~s m compliance w~th the 1988
Denton Development Plan and 1998 Denton Plan Pohmes and the Growth Management Plan
Strategies, NOW, THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS
SECTION 1 That the zomng district classification and use designation of the 1 168 acre
property described m the legal description attached hereto and ~ncorporated hereto as Exhibit
"A" ~s changed from One Family Dwelling (SF-7) zomng d~stnct classfficat~on and use
designation to Planned Development (PD) zomng district classification and use designation and a
Detmled Plan for the 1 168 acres is adopted, smd detmled plan being attached hereto and
~ncorporated hereto as Exlublt "B" for all purposes, to allow an amemtles center in accordance
w~th the comprehensive zomng ordinance of the C~ty of Denton, Texas, subject to the following
conditions
1 Permanent bicycle racks shall be provided on s~te
2 The fence along the eastern side of the property shall be constructed of e~ther
decorative wrought ~ron or wood on steel post
~ That the City's official zoning map ~s amended to show the change m
zoning district classfficatlon
SI~(~TION 3 That any person wolatlng any provision of th~s ordinance shall, upon
conmct~on, be fined a sum not exceedmg $2,000 00 Each day that a provision of this ordinance
is violated shall constitute a separate and (hstlnct offense
SECTION 4 That th~s ordinance shall become effective fourteen (14) days from the date
of its passage, and the C~ty Secretary is hereby d~rected to cause the caption of this ordinance to
be published twice In the Denton Record Chronicle, official newspaper of the CRy of Denton,
Texas, within ten (10) days of the date of its passage,
