AN ORDINANCE VACATING A UTILITY EASEMENT RECORDED IN CABINET H,
PAGE 196 OF THE PLAT RECORDS OF DENTON COUNTY, TEXAS, AS IT PERTAINS
TO LOT 1, BLOCK A OF THE LISSBERGER ADDITION, AND PROVIDING FOR AN
EFFECTIVE DATE
WHEREAS, the City of Denton has recmved a request for the abandonment of a certmn
utility easement, and
WHEREAS, the Development Rev, ew Committee of the City of Denton, Texas reviewed
the requested abandonment and recommended approval, and
WHEREAS, the Council of the C~ty of Denton, Texas has determined that the utility
easement being vacated is no longer needed for public use since the applicant has dedicated other
easements to facilitate the installation of utilities ~n the Lmsberger Addition, and
Wi-IEREAS, the fair market value of the utility easement has been determined and
received, as reqmred by section 272 001 of the Texas Local Government Code, NOW
THERFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS
SECTION 1 That the 8-foot utlhty easement illustrated an Exhabit A, attached hereto
and incorporated hereto by reference, and recorded in Cabinet H, Page 196 of the Plat Records of
Denton County, Texas, as it pertmns to Lot 1, Block A of the Llssberger Addition, an addatlon to
the City of Denton, is permanently vacated and extlngmshed as a public easement, to the extent
described m smd exhibit
SECTION 2 That by reason of such vacation the City of Denton's property ~nterest in
the easement shall, by operation of law, revert to the owner or owners abutting the easement
herein abandoned, and the C~ty of Denton releases any and all clmms to the use of the vacated
property as a public easement
SECTION 3 That this ordinance shall become effective immediately upon 1ts passage
and approval
