AN ORDINANCE APPROVING THE EXPENDITURE OF FUNDS FOR THE PURCHASE OF
LIFEPAK DEFIBRILLATORS, MONITORS AND PERIPHERAL, AVAILABLE FROM ONLY
ONE SOURCE IN ACCORDANCE WITH THE PROVISIONS OF STATE LAW EXEMPTING
SUCH PURCHASES FROM REQUIREMENTS OF COMPETITIVE BIDS, AND PROVIDING
AN EFFECTIVE DATE (PURCHASE ORDER 00972 - MEDTRONIC PHYSIO-CONTROL, FOR
LIFEPAK 12 DEFIBRILLATORS, MONITORS AND PERIPHERALS AND UPGRADES TO
LIFEPAK 10 DEFIBRILLATORS IN THE AMOUNT OF $98,201 50)
WHEREAS, Section 252 022 of the Local Government Code provides that procurement of
items that are only avmlable from one source, including, items that are only avmlable from one
source because of patents, copyrights, secret processes or natural monopolies, films, manuscripts or
books, electricity, gas, water and other utility purchases, captive replacement parts or components
for equipment, and library materials for a public library that are avmlable only from the persons
holding exclusive &stnbutlon rights to the materials, need not be submitted to competit~ve bids, and
WHEREAS, the City Council washes to procure one or more of the items mentioned in the
above paragraph, NOW, THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS
SECTION I That the following purchase of matenals, eqmpment or supplies, as descnbed
in the "Purchase Orders" hsted hereon, and on file in the office of the Purchasing Agent, are hereby
approved

SECTION II That the acceptance and approval of the above items shall not constitute a
contract between the City and the person submltung the quotation for such items until such person
shall comply with all reqmrements specified by the Purchasing Department
~ That the City Manager 1s hereby authorized to execute any contracts relating
to the items specffied in Section I and the expenditure of funds pursuant to smd contracts ~s hereby
authorized
SECTION IV That ttus ordinance shall become effective munedmtely upon its passage and
approval
