AN ORDINANCE OF THE CITY OF DENTON, TEXAS ADOPTING A CITY LOGO, TO BE
USED AS THE OFFICIAL LOGO OF THE CITY OF DENTON, ADOPTING A LOGO TO
BE USED AS THE OFFICIAL LOGO FOR THE FLAG OF THE CITY OF DENTON,
PROHIBITING THE USE OF OFFICIAL CITY LOGOS BY ANY PERSON, FIRM,
CORPORATION, OR ORGANIZATION, OTHER THAN THE CITY OF DENTON
WITHOUT WRITTEN APPROVAL OF THE CITY COUNCIL, PROVIDING THAT THE
REQUIREMENTS OF THE TEXAS FLAG CODE APPLY TO THE DISPLAY AND
TREATMENT OF THE CITY OF DENTON FLAG, PROVIDING FOR A PENALTY NOT TO
EXCEED FIVE HUNDRED DOLLARS FOR EACH DAY OF VIOLATION, PROVIDING
FOR A REPEALER CLAUSE, PROVIDING FOR A SEVERABILITY CLAUSE, AND
PROVIDING FOR AN EFFECTIVE DATE
WHEREAS, on April 19, 1994, the Ctty Council enacted Ordtnance No 94-074 wtuch
adopted an official Logo to be used on all official C~ty of Denton materials, eqmpment, and
supphes; and thereafter, on January 9, 1996 the City Council enacted Ordinance No 96-011
amending Ordinance No 94-074 an several respects, and
WHEREAS, the Ctty of Denton finds that the proper use of logos will foster a sense of
umty and commumty pride, and
WHEREAS, the C~ty of Denton desires to develop and adopt a new ctty logo and to
adopt the prewous mty logo as the logo for City of Denton Flag, and
WHEREAS, as to the offieml City Logos, the Ctty Council is of the optmon that the same
should not be used by any other person, firm, corporaUon, or orgamzat~on for any purpose
without the written approval of the City Cotmcfl, NOW, THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS
~ That the Logo as set forth in the attached Exhtbtt "A" lS hereby approved
and adopted as the Officml Logo of The C~ty of Denton Ttus Official Logo shall be reflected
and uUhzed on all Ctty of Denton, supplies, and materials ordered or purchased after the
effective date of tins ordanance according to pohcy heretnafter adopted by the City
~ That the Logo as set forth in the attached Exhibit "B" ~s hereby approved
and adopted as the offictal Logo for Ctty of Denton Flag Tlus official Logo for City of Denton
Flag shall be reflected and uuhzed on the offictal City of Denton Flag and bear the words
"Denton, Texas" underneath the Logo to be dtsplayed prommantly for all to see The use of the
offimal etty flag or the logo for City of Denton Flag by any person, firm, organlzatmn, or
corporaUon, other than the City of Danton, m any way as any part of any material, eqmpment, or
other matter of such person, firm, orgamzaUon, or corporauon shall do so m a manner consistent
w~th the treatment of the State Flag under theTexas Flag Code, Tex Rev C~v Stat Ann Art
6139c (Vernon 1995) as currently adopted or as hereinafter amended
~ That the current supply ofpnnted matenals and pubhcatlons shall be used
and depleted without regard to any new pohcy or guldehnes hereinafter adopted
~ That no person, finn, corporation, or organization, other than the City of
Denton shall adopt, use, chsplay, incorporate, or appropriate the official Logo of The City of
Denton or the official Logo for C~ty of Denton Flag when not affixed to a flag, as any part of any
material, leqmpment, or other matter of such person, finn, corporation, or orgamzatlon wahout
written application to and written approval of the City Council
~ A person, firm, organization or corporation shall not use, &splay,
incorporate or appropriate the official Logo or Logo for City of Denton Flag in any manner
which would vaolate any State civil or enmmal statute
~ That any person, finn, corporation or organization violating any provision
of this ordinance shall, upon conviction, be fined a sum not exceeding Five Hundred Dollars
($500 00) Each day that a promslon of tins ordinance is violated, shall constitute a separate and
distinct offense
~ That all ordinances or parts of ordinances iff force when the provisions of
this orchnance became effective, which are inconsistent or in conflict with the terms or
prowslons contained in tins ordinance, are hereby repealed to the extent of any such conflict
S~uC.~)..~.~ That if any sectlon, subsection, paragraph, sentence, clause, phrase or
word contmned m tins ordinance, or application thereof to any person or circumstances is held
invalid by any court of competent junsdmtion, such holding shall not affect the validity of the
remmnmg pomons of thas ordinance, and the City Council of the C~ty of Denton, Texas, hereby
declares it would have enacted such remalmng portions despite any such mvahchty
~ That this ordinance shall become effective fourteen (14) days from the
date of ars passage, and the C~ty Secretary is hereby directed to cause the caption of this
ordinance to be published twice m the Denton Record-Chromcle, the official newspaper of the
Ctty of Danton, Texas, wlttun ten (10) days of the date of its passage
