1998-009 O ANCENO AN ORDINANCE PROVIDING FOR THE EXPENDITURE OF FUNDS FOR THE NECESSARY REPAIRS TO A 973 CATERPILLAR TRACK LOADER WHICH IS AN EMERGENCY PURCHASE IN ACCORDANCE WITH THE PROVISIONS OF STATE LAW EXEMPTING SUCH PURCHASES FROM REQUIREMENTS OF COMPETITIVE BIDS, AND PROVIDING AN EFFECTIVE DATE (PURCHASE ORDER # 82071 TO DARR EQUIPMENT) WHEI~AS, state law and orchnance reqmre that certain contracts reqmnng an expenditure or payment by the C~ty m an mount exceechng $15,000 be by competitive bids, except an the case of pubhc calamity where ~t becomes necessary to act at once to appropriate money to relieve the necessity of the mt~zens, or to preserve the property of the city, or it is necessary to protect the public health or safety of the cmzens of the city, or in case of unforeseen damage to pubhc property, machinery or eqmpment, and, WHEREAS, the City Manager has recommended to the Caty Council that it as necessary to purchase goods or services due to the followmg emergency concht~ons outlined an the memorandum attached hereto as Exlublt "A", mcorporated herein by reference, NOW, THEREFORE, THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS SECTION I That the City Council hereby determanes that there m a public calamity that makes at necessary to act at once to appropriate money to reheve the necessity of the mtazens, or to preserve the proparty of the city, or to protect the public health of the c~tizens of the city, or to provide for unforeseen damage to pubhc property, maclunery or eqmpment, and by reason thereof, the following emergency purchases of materials, eqmpment, supplies or services, as described m the "Purchase Orders" attached hereto, are hereby approved PURCHASE ~ VENDOR AMOUNT 82071 DARR EQUIPMENT $29,139.19 ~ That because of such emergency, the City Manager or demgnated employee is hereby authorazed to purchase the materials, eqmpment, supphes or servmes as described m the attached Purchase Orders and to make payment therefore in the amounts therein stated, such emergency purchases bemg m accordance w~th the provmlons of state law exemptmg such purchases by the City from the reqmrements of competitive bads SECTION IV That this ordinance shall become effective ~mmed~ately upon its passage and approval day of ,1998 ATTEST JENNIFER WALTERS, CITY SECRETARY HERBERT L PROUTY, CITY ATTORNEY SOLE sOURCE
