AN ORDINANCE ORDERING AN ELECTION TO BE HELD IN THE CITY OF DENTON,
TEXAS, ON MAY 2, 1998, AND, IF A RUNOFF ELECTION IS REQUIRED, ON MAY 30,
1998, FOR THE PURPOSE OF ELECTING COUNCILMEMBERS TO PLACES 5 AND 6 AND
ELECTING A MAYOR TO PLACE 7 OF THE CITY COUNCIL OF THE CITY OF DENTON,
TEXAS, I DESIGNATING VOTING PLACES, APPOINTING ELECTION OFFICIALS,
PROVIDING FOR EARLY VOTING, PROVIDING FOR BILINGUAL NOTICE OF THE
ELECTION, ORDERING THAT AN ELECTRONIC VOTING SYSTEM BE USED, AND
PROVIDING FOR AN EFFECTIVE DATE
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS
SECTION I That a mummpal elecUon is ordered to be held m the City of Denton, Texas, on
Saturday, May 2, 1998, such date being aumform eleeUon date as defined m TEX ELEC CODE
§41 001, ~s amended (the "Code"), for the purpose of electing Couneflmembers for Places 5 and 6
and electing a Mayor to Place 7 In the event a runoff is reqmred, the runoff elect~on shall be held
on Saturcl~y, May 30, 1998
SECTION II That the polling places, winch shall be open from 7 00 a rn to 7 00 p m, shall
be as follows

The premdmg judge of the Central Counting Statton and of each dastnct are authorized to
appoint a sufficient number of clerks as necessary to assist them ~n the election, including bdmgual
assistants as reqmred by law The rate of pay for elect~on judges and clerks shall be the maxtmum
amount proxaded for by State law
SECTION IV That early voting shall be conducted for the elect~on, and the runoff election if
necessary, by the Office of the C~ty Secretary in the Municipal Bmkhng at 215 East McKanney
Street ~n the C~ty of Denton, Texas The polls for early voting by personal appearance shall be open
between the hours of 8 00 a m and 5 00 p m Monday through Friday, commenmng April 15, 1998,
and ending on April 28, 1998 In add~taon, early voting shall be held on Saturday, April 18, 1998,
between the hours of 10 00 a m and 3 00 p m, at the same location as weekday early voting
SECTION V That the Mayor ~s hereby darected to promde notme of the electaon, and the
runoff elect~on if necessary, m accordance w~th Sections 4 002, 4 003, and 4 004 of Texas Elect~on
Code, the notace to be pnnted m the Spamsh language and the Enghsh language
SECTION VI That an electromc voting system using optically scanned ballots, meetang the
requirements of Chapter 124 of the Code, shall be used for stud elect~on Preparation of the
necessary eqmpment and offieml ballots for the elect~on shall conform to the mqmrements of the
Code
SECTION VII That C~ty Secretary ~s authorized to prepare the official ballot for the elect~on
and perform every act reqmred by the C~ty Charter and laws of the State of Texas for hol&ng
elections

SECTION VIII The elect~on officers named above shall make returns for the election in the
manner reqmred by law The ballots that are properly marked m conformance w~th the prowsaons
of the Texas Eleet~on Code for votes east both dunng the period of early voting and on the date of
the election shall be counted m the manner required by law
~ Substantial copaes of tins ordinance m both Enghsh and Spanish shall serve
as proper notice of the election and smd notice shall be (a) pubhshed at least once m a newspaper
of general,e~reulat~on pubhshed wltNn the C~ty, not less than the thirtieth day or later than the tenth
day before the electaon, (b) posted, not later than the twenty-first day before the eleet~on day, at a
pubhc place m each election rhstnct that ~s m the jurisdiction of the city, (c) posted, not later than
the twenty-first day before election day, on the bulletin board used for posting notices of meetings
of the C~ty Council of the City, and (d) posted, as may otherwise be reqmred by Tex Elec Code
§4 003 and other apphcable law
SECTION X That tins ordmanee shall become effective immediately upon ~ts passage and
approval

OFFICIALS FOR DISTRICT NO 4, PROVIDING A SAVINGS CLAUSE, AND PROVIDING
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS
~ That Section III5 of Ordinance No 98-036 m hereby amended by
substituting the following persons for elect~on offimals for D~stnct No 4
5 Joyce Shay, Presiding Judge and Carlotta Claiborne, Alternate Judge
~ That save and except as amended hereby, all the provisions, sections,
subsections, paragraphs, sentences, clauses, and phrases of Ordinance No 98-036 shall remain m
full force and effect
SET~ That thru ordinance shall become effective lmmedmtely upon Its passage
and approval
