AN ORDINANCE PARTIALLY VACATING A CERTAIN SEWER AND DRAINAGE
EASEMENT FROM H D ROBERTS AND WIFE, STELLA ROBERTS TO THE CITY
OF DENTON BY EASEMENT DEED ON MARCH 3rd, 1960 AND RECORDED
WITH CLERK'S FILE NUMBER 3881, AND PROVIDING FOR AN EFFECTIVE
DATE
WHEREAS, the C~ty of Denton has received a request for the part~al
abandonment of a certain sewer and drmnage easement, and
WHEREAS, the Planning and Zomng Commmmon of the C~ty of Denton, Texas
remewed the requested abandonment and recommended approval, and
WHEREAS, the Council of the C~ty of Denton, Texas has detenmned that the
sewer and drmnage easement being vacated ~s no longer needed for public use, and
WHEREAS, the fmr market value of the drmnage easement has been determined
and received, as reqmred by section 272 001 of the Texas Local Government code and
DENTON, TEX CODE ch 2 art IV (1991), NOW THERFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS

Exhibit A, attached hereto and incorporated here~n by referenced, and recorded w~th the
Clerk's File Number 3881, ~s permanently vacated and extmgmshed as a pubhc
easement, to the extent descnbed m smd exhibit
~ That by reason of such vacation the C~ty of Denton's property
~nterest m the vacated port,on of smd easement shall, by operation of law, revert to the
owner or owners abutting the easement here~n abandoned, and the C~ty of Denton
releases any and all clmms to the use of the vacated port~on of smd property as a pubhc
easement
~ That thru ordinance shall become effectwe ~mmedmtely upon ~ts
passage and approval

~nterest m the vacated portion of said easement shall, by operation of law, revert to the
owner or owners abutting the easement herein abandoned, and the C~ty of Denton
releases any and all clmms to the use of the vacated portion of said property as a public
easement
