AN ORDINANCE PARTIALLY VACATING A CERTAIN UTILITY EASEMENT
RECORDED IN THE PLAT RECORDS OF DENTON COUNTY, TEXAS AT
CABINET I, PAGE 118, AS IT PERTAINS TO LOT 2R, BLOCK A, OF THE BELL
PLACE ADDITION, AND PROVIDING FOR AN EFFECTIVE DATE
WHEREAS, the C~ty of Denton has received a request for the partml
abandonment of a certmn utility easement, and
WHEREAS, the Planmng and Zomng Commmslon of the City of Denton, Texas
reviewed the requested abandonment and recommended approval, and
WHEREAS, the Council of the Cxty of Denton, Texas has determined that the
utlhty easement being partially vacated is no longer needed for public use, and
WHEREAS, the fair market value of the utlhty easement has been determined and
received, as reqmred by section 272 001 of the Texas Local Government code and
DENTON, TEX, CODE ch 2 art IV (1991), NOW THERFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDA1NS
SECTION I. That the portion of the utdity easement described ~n Exhibit A,
attached hereto and ~ncorporated herem by referenced, and recorded ~n Cabmet I, Page
118 of the Plat Records of Denton County, Texas, as it pertmns to Lot 2R, Block A of the
Bell Place Addition, xs permanently vacated and extmgmshed as a pubhc easement, to the
extent described m smd exbablt
SECTION II That by reason of such vacatmn the Cxty of Denton's property
~nterest m the vacated portion of smd easement shall, by operation of law, revert to the
owner or owners abuttmg the easement here~n abandoned, and the C~ty of Denton
releases any and all clmms to the use of the vacated port~on of said property as a pubhc
easement
SECTION III That this ordinance shall become effective immediately upon xts
passage and approval
