AN ORDINANCE AMENDING THE COMPOST AND WOOD MULCH RATES CON-
TA1NED WITHIN THE SCHEDULE OF WASTEWATER RATES SET FORTH 1N ORDI-
NANCE NO 97-238 FOR COMPOST AND WOOD MULCH SERVICE, PROVIDING FOR A
SEVERABILITY CLAUSE, PROVIDING FOR A SAVINGS CLAUSE, AND PROVIDING
FOR AN EFFECTIVE DATE
WHEREAS, the City Council deems it in the public interest to amend its wastewater
rates by amending the rates for compost and wood mulch service, NOW, THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS
SECTION I. That the rate schedule for wastewater service contmned in Ordinance No
97-238 is hereby amended as provided for in Chapter 26 of the Code of Ordinances by amending
the rates within Schedule CWM, compost and wood mulch rates conttuned on pages 30 and 31 of
stud ordinance as follows

Applicable to any and all customers, whether residential, commercial, or wholesale, who elect to
acquire the City of Denton compost and/or wood mulch for their use The City of Denton re-
serves the right to restrict or limit the sale of compost or wood mulch to any customer at any
time
RATE
Compost and wood mulch will be sold by volume on a cubic yardage basis, and are to be pur-
chased in, cubic yardage increments Quantities will not be sold in volumes less than one-half
cubic yard
A Compost
1 Dyno Soil (Top Soil Blend) $25 00 per cubic yard
2 Dyno Dirt $20 00 per cubic yard
B Wood Mulch
1 Dyno Mulch $15 00 per cubic yard
2 Dyno Ctups $ 7 00 per cubic yard
Purchases greater than 10 cubic yards will receive a 20% discount, and purchases greater than
100 cubic yards will receive a 40% discount
PRODUCT AVAILABILITY
The City of Denton produces compost and wood mulch throughout the year in varying limited
quantities, The City of Denton does not guarantee the avtulabfl~ty of either product, and ex-
pressly reserves the right to restrict the sale of either product based upon available volumes

WHOLESALE PURCHASES
All compost or wood mulch purchased wholesale, for resale to the public, is to be identified as a
City of Denton manufactured product The wholesale purchaser must promde the City of Denton
selling price infonnatton to the retml customer ff it is requested
RECEIPT OF PRODUCT
Following payment for compost or wood mulch products, the customer may submit their receipt
to the load attendee on duty located at the Pecan Creek Water Reclamation Plant, 1100 Maylull
Road, Denton, Texas Load attendees are only avmlable to load products on Wednesdays and
Saturdays dunng the hours of 7 00 a m - 3 00 p m, exclusive of legal holidays
~ That If any section, subsection, paragraph, sentence, clause, phrase, or
word In this ordinance, or application thereof to any person or c~mmnstance ts held Invalid by
any court of competent jurisdiction, such holding shall not affect the vahdlty of the remmmng
portions of this ordinance, the City Council of the City of Denton hereby declares that they
would have enacted such remmnmg portions despite any such validtty
SECTION III That save and except as amended hereby, all the wastewater rate sched-
ules, the sections, sentences, and clauses contained tn Ordtnance No 97-238 shall remain in full
force and effect
SECTION IV That the schedule of rates being Schedule CWM - Compost & Wood
Mulch hereto adopted shall be effective, charged and applied to all such wastewater service
crmng on or at~er the effective date of this ordinance or March 18, 1998, and a copy of stud rates
shall be mmntmned on file at the office of the C~ty Secretary
