AN ORDiNANCE OF THE CITY OF DENTON, TEXAS, PROVIDING FOR A CHANGE
FROM THE AGRICULTURAL (A) ZONING DISTRICT CLASSIFICATION AND USE
DESIGNATION TO THE OFFICE CONDITIONED (O[c]) ZONING DISTRICT
CLASSIFICATION AND USE DESIGNATION FOR 0 316 ACRES OF LAND LOCATED
ON THE EAST SIDE OF WOODROW LANE APPROXIMATELY 400 FEET SOUTH OF
EAST McKINNEY STREET, PROVIDING FOR A PENALTY IN THE MAXIMUM
AMOUNT OF $2,000 FOR VIOLATIONS THEREOF, AND PROVIDING FOR AN
EFFECTIVE DATE
WHEREAS, Greg Edwards Engineering, on behalf of James W Simmons, initiated a
change ln,zomng for 0 316 acres of land from the Agricultural (A) zoning district classification
and use designation to the Office Condmoned (O[c]) zomng dtsmct classification and use
designation, and
WHEREAS, on February 25, 1998, the Planmng and Zomng Commission recommended
approval of a change from the Agricultural (A) zomng dlsmct classification and use designation
to the Office Conchtioned (O[c]) zomng district classification and use designation, and
WHEREAS, the City Council finds that the change in zoning will be m compliance with
the Denton Development Plan, NOW THEREFORE
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS
n That the zomng chstnct classification and use demgnatlon of the 0 316 acres
of landExtublts A and B, attached hereto and incorporated by reference herein, is
changed from the Agricultural (A) zoning chsmct clasmficatlon and use deslgnaUon to the Office
Conditioned (O[c]) zomng district classification and use designation under the comprehensive
zomng ordinance of the City of Denton, Texas, subject to the following conditions
1 Lighting on the property shall be designed and mmntalned so as not to shine on, or
otherwise disturb surrounding residential property or to shine and project upward to
, prevent the diffusion into the mght sky,
2 Maximum building height shall be two stones, and
3 A landscaped bufferyard along the side and rear property lines shall be required The
setback shall be a minimum of ten feet in width and contmn a mlmmum of rune
understory trees Bufferyard reqmrements may be used to meet any landscape
requirements
~ That the City's official zoning map is amended to show the change m
zoning district classification
~ That any person vlolatlng any provision of this ordinance shall, upon
conviction, be fined a sum not exceeding $2,000 00 Each day that a provision of thas ordinance
~s wolated shall constitute a separate and dlstmet offense
~ That tins ordananee shall become effeetave fourteen (14) days from the
date of ~ts passage, and the City Secretary ~s hereby directed to cause the caption of th~s
ordmance to be pubhshed twice m the Denton Record- Chronicle, a daaly newspaper pubhshed ~n
the City of Denton, Texas, w~th~n ten (10) days of the date or,ts passage
