AN ORDINANCE AMENDING THE SCHEDULE OF WATER RATES CONTAINED IN
ORDINANCE NO 97-237 FOR WATER SERVICE BY CORRECTING AND AMENDING
THE WHOLESALE RAW WATER SERVICE TO UPPER TRINITY REGIONAL WATER
DISTRICT SCHEDULE (WRVO, PROVIDING FOR A REFUND, PROVIDING FOR A
SEVERABILITY CLAUSE, AND PROVIDING FOR AN EFFECTIVE DATE
WHEREAS, on the 2nd day of September, 1997, the City Counml passed and approved
Ordinance No 97-237 adopting the rate schedules respecting water service for the City of
Denton Included wlttun smd ordinance was Schedule WRW perttunmg to Wholesale Raw
Water Service To Upper Tnmty Regional Water Dmmct The applicable raw water rate stated in
the ordinance was $0 3679/1000 gallons However, City staff dascovered that an inadvertent
error occurred m their calculation of said rate, and that the correct raw water rate should have
been expressed as $0 3602/1000 gallons, and
WHEREAS, the City Council desires to correct the applicable raw water rate pertmmng
to Schedule WRW, effective October 1, 1997, the effective date of the Schedule WRW
heretofore adopted by Ordinance, NOW, THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS
SECTION I. That the Schedule of Rates for Water Service as provided for in Ordinance
No 97-237 and m Chapter 26 of the Code of Ordinances, is amended to add the corrected
Schedule WRW, Wholesale Raw Water Service to Upper Tnmty Regional Water Dmtnct, which
amended Schedule is attached hereto and incorporated herewith by reference, and hereby cancels
and supercedes the Schedule WRW heretofore adopted ~n Ordinance No 97-237
SECTION II. That the Assistant City Manager/Utilities is hereby authorized to expend
funds to issue a refund to the Upper Tnmty Regional Water Dmtnct, in the event and to the
extent that the C~ty has collected greater than $0 3602/1000 gallons from Upper Tnmty Regional
Water District from and after October 1,1997 pursuant to Schedule WRW
~]~CTION III That if any section, subsection, paragraph, sentence, clause, phrase or
word in tlus ordinance, or application thereof to any person or c~mumstances is held invalid by
any court of competent junsdmtlon, such holding shall not affect the vahchty of the remmmng
portions of thru ordinance, and the City Council of the City of Denton, Texas, hereby declares it
would have enacted such remalmng portions despite any such lnvahdaty
SECTION IV. That the scheduled rate herein adopted shall be effective, charged, and
applied to all water usage occumng on or after October 1, 1997, and a copy of said rate shall be
mmntmn~d on file in the office of the City Secretary

Interim Sale of Wholesale Raw Water Contract
MONTHLY CHARGES
The monthly charge for servme shall be expressed as a volume price per 1,000 gallons
Volume Charge $0 3602 per 1,000 gallons
PAYMENT
Denton shall render bills by the tenth (10th) day of each month Bills shall be due and payable
within 20 calendar days of the date a bill ~s rendered
BILL PAYMENT DELINOUENCY
Bills are considered delinquent ~fnot prod w~th~n 20 calendar days from the date a bill for service
~s rendered There shall be a ten percent per annum ~nterest charge on the amount due, from the
date when due until prod, ff not prod w~th~n 20 calendar days of the date a bill for service is
rendered
