AN ORDINANCE DECLARING m PUBLIC NECESSITY EXISTS AND FINDING THAT
PUBLIC WELFARE AND CONVENIENCE REQUIRES THE TAKING AND ACQUIRING
OF A STREET RIGHT-OF-WAY EASEMENT IN 1 83 ACRES OF LAND LOCATED IN
THE M FOR_REST SURVEY, ABSTRACT NO 417, OWNED BY RALPH T BULLARD,
AUTHORIZING THE CITY MANAGER OR HIS DESIGNEE TO MAKE AN OFFER TO
PURCHASE THE PROPERTY FOR ITS FAIR MARKET VALUE AND IF SUCH OFFER IS
REFUSED, AUTHORIZING THE CITY ATTORNEY TO iNSTITUTE THE NECESSARY
PROCEEDINGS IN CONDEMNATION IN ORDER TO ACQUIRE THE PROPERTY
NECESSARY FOR THE PUBLIC PURPOSE OF CONSTRUCTING LAKEVIEW
BOULEVARD FROM U S HIGHWAY 380 TO 1200 FEET SOUTH OF U S HIGHWAY 380,
AND DECLARING AN EFFECTIVE DATE
WHEREAS, ~t ,s hereby determined that a pubhc necesmty exists and that pubhc welfare
and convemence hereby reqmre the acqmmt~on of a street right-of-way easement m the
hereinafter described land for the pubhc purpose of constructing Lakewew Boulevard from U S
H~ghway 380 to 1200 feet south ofU S H~ghway 380 and that the C~ty of Denton should acqmre
smd property necessary for stud purpose, and
WHEREAS, the hereinafter described property ~s owned by Ralph T Bullard, NOW,
THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS
SECTION I. That pubhc necestuty exists and pubhc welfare and convemence reqmre the
acqmmt~on of an mghty (80) foot w~de street right-of-way easement ~n the hereinafter described
land for the pubhc purpose mentioned below
SECTION II. That the C~ty Manager or hm demgnee ~s hereby authorized and d~rected to
make an offer for the property to the owner of smd hereinafter described property, based on just
compensation recommended by an independent apprtusal prepared at the C~ty Manager's
d~rect~on
SECTION III. That m the event the offer as described ~n Section II ~s refused by the
owner of smd property, the C~ty Attorney m hereby authorized and d~rected to file the necessary
condemnation proceedings or stat and take whatever action that may be necessary agtunst Ralph
T Bullard to acqmre a street right-of-way easement ~n 1 83 acres of land located ~n the M
Forrest Survey, Abstract No 417, for the publ, c purpose of acqumn§ such property for the
construction of Lakewew Boulevard from U S H~ghway 380 to 1200 feet south ofU S H~ghway
380 upon the land more partmularly described as follows
All that pomon of land lying and being mtuated ~n the C~ty of Denton, Denton County,
Texas, described m Exhibit "A" attached hereto and made a part hereof for all purposes,
to which reference m here made for a more particular description
SECTION IV. That ~f it should be subsequently detenmned that adtht~onal part~es other
than those named here~n have an ~nterest m sand property, then in that event, the C~ty Attorney ~s
authorized and chreeted to jo~n sand part~es as Defendants ~n sa~d condemnation
S]~CTION V. That tins ordinance shall become effective ~mmedmtely upon ~ts passage
and approval
