1998-110AN ORDINANCE AMENDING SECTION 10-128 OF ARTICLE VI OF CHAPTER 10 OF THE CODE OF ORDINANCES OF THE CITY OF DENTON, TEXAS, TO PROVIDE FOR A CONTINUATION OF THE QUALIFICATION PERIOD FOR SEEKING PARTIAL TAX EXEMPTIONS FOR DESIGNATED HISTORIC SITES TO THE YEAR 2008, PROVIDING OWNERS THAT QUALIFY FOR A DESIGNATED HISTORIC SITE FIFTEEN (15) YEARS OF PARTIAL TAX EXEMPTION, PROVIDING FOR A SEVERABILITY CLAUSE, PROVIDING FOR A SAVINGS CLAUSE AND PROVIDING FOR AN EFFECTIVE DATE THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS ~ That Chapter 10 of the Code of Ordinances of the City of Denton, Texas, be amended by revising Article IV so that hereafter Section 10-128 shall read as follows ARTICLE IV TAX EXEMPTION OF DESIGNATED HISTORIC SITES Sec 10-128 Partial Tax Exemption of Designated H~stonc Sites (a) Any property which is a designated Instonc site on the first day of January for any year beginning with 1989 and extending to and ~ncludlng 2008, shall be exempt form real property ad valorem taxes levied by the City of Denton to the extent of fifty (50%) percent of the assessed value of the designated historic site The exemption provided for hereto shall apply for a maximum of fitteen (15) successive years, beginning with first year the property is entitled to the exemption during the specified years and contlnmng and including each and every year of the fourteen (14) successive years thereafter dunng winch the property is a designated historical site on the first day of January of those fourteen (14) years (b) Immediately after the first day of January of each year, the Director of Econonnc Development shall notify the chief appraiser of the Denton County Apprtusal District of all designated Instoncal sites that quahfy for the tax exemption for that year To receive the exemption provided herein, a person claiming the exemption must apply for the exemption by filing an application form w~th the chief apprmser of the Denton County Appraisal Dlstnct as provided for by State law ~ That if any section, subsection, paragraph, sentence, clause, phrase or word m this ordinance, or application thereof to any person or circumstance ~s held mvahd by any court of competent jurisdiction, such holding shall not affect the vahdlty of the remalmng portions of tins orchnance, and the City Council of the City of Denton, Texas, hereby declares ~t would have enacted such remalmng portions despite any such invalidity ~ All provisions of the Code of Ordinances of the C~ty of Denton, Texas, in conflict with the provisions of this Ordinance are hereby repealed, and all other provisions of the Ordinance of the City of Denton, Texas, not m conflict with the provisions of th~s Ordinance, shall remain in full force and effect ~ That this ordinance shall become effective immediately upon its passage and approval PASSED AND APPROVED this the~/ day 1998 ATTEST JENNIFER WALTERS, CITY SECRETARY PAGE2
